    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

    On 02/21/20223, I spoke to the complainant. The complainant stated that Child A said that Ms. Aho took pictures of him while he was in the shower. There is a concern regarding the supervision and care provided in Ms. Aho's child care home. On 02/21/2023, I spoke to Child A's Mother. She reported that Child A attended Ms. Aho's care home from September 2021 to December 2021. Child A was two years old at the time he attended care at Ms. Aho's home. Child A told her that he took baths and showers with other children at the child care home. Additionally, Child A's Mother observed that Child A diapered his stuffed animal, propped it up, and took a picture of it. Child A's Mother asked Ms. Aho if she bathes children or if children shower while in her care. Ms. Aho informed her that children do not bathe or shower at the child care home. Ms. Aho told her that she has washed children's feet in the kitchen sink. Recently (an exact date is unknown), Child A talked about Ms. Aho's child care home while he ate Fruit Loops and called it his, "Sad day care." Child A's Mother stated she believed eating Fruit Loops reminded him of Ms. Aho, because she served Fruit Loops for meals and snacks and he called it his, "Sad daycare," because he cried at drop off times. Child A's Mother asked Child A if Ms. Aho ever took pictures of Child A in the shower and Child A stated that she did. Child A's Mother did not receive any photographs from Ms. Aho, outside of what is placed in the child care newsletter. Child A's Mother stated that newsletter pictures included things like children playing outside, art activities, and holiday events. On 02/24/2023 I completed an unannounced onsite inspection. I interviewed Ms. Aho and CCSM A (child care assistant). Ms. Aho informed me that children never take showers or baths at her child care home. She said she has washed children's feet in the sink and used washed clothes or wipes to clean children, if needed. Ms. Aho stated that she requests written permission from parents prior to taking photographs. The permission to photograph children is in the parent contract that parents sign annually. She takes pictures of children doing projects (documented learning), spirit days, circle time, or pictures that show the curriculum theme for the week. She said children are never propped up for photographs. Ms. Aho informed me she is a professional photographer and does have a camera that she will occasionally use to take photographs of children in care participating in different activities. I interviewed CCSM A. She started working for Ms. Aho in 2021. She stated she has never bathed or showered any children and never observed Ms. Aho do so. CCSM A stated that children are occasionally photographed while playing or engaging in 3 activities. Children are not propped up or positioned when photographs are taken. CCSM A has never observed any concerning behavior by Ms. Aho and feels appropriate care and supervision is consistently provided. I observed children in Ms. Aho's care engaged in a variety of developmentally appropriate activities, including playing with other children, playing with toys, and eating snacks. Ms. Aho and CCSM A displayed positive child interactions and communication. I observed the child care use space. The child care home has a bathroom on the main level. There is no shower or tub inside the main floor bathroom. Ms. Aho stated that this is the bathroom that children use. Children never use the second story of the home and do not use other bathrooms on other levels of the child care home. On 04/10/2023 I received child information records for Child B, C, D, E, F, and G. On 04/17/2023 I called Child B's Mother, Child C's Mother, Child D's Mother, Child E's Mother, and Child F's Mother. Child B's Mother stated Ms. Aho has provided care to her children for four to five years. She said Ms. Aho is always helpful and has been an amazing caregiver to her children. She stated that Ms. Aho does not provide baths an
