    The children's safety and well-being of children are not being met when Child A or Child B has a negative behavior. Multiple children and teachers have been physically harmed during these frequent episodes, requiring the teachers to remove the child from the room and therefore be out of ratio at times. This has also resulted in the children being evacuated from the classroom, children being moved in the classroom to avoid harm, or children being restricted from bathroom use when teachers are dealing with the negative behaviors.

    On 05/15/2023. 1 Woke with by telephone. She stated Child A spent part of his day at another agency before being bussed to the center when the incident occurred. I explained that there were other licensed programs located within Little Learners of Fraser Early Childhood Center with Dooley Head Start being one of them. A time frame of where Child A was during the day would be determined during the onsite. On 05/16/2023, and I completed an onsite at the center. stated she was told Child A was not enrolled in Dooley Head Start program and child care staff members did not know where Child A could be located. I interviewed the Administrative Assistant at the center, we provided Child A's name and was informed he was a student of the Early Childhood Special Education (ECSE) 2 program which is operated through Fraser school district and not a licensed program. would be speaking with her supervisor but there would be no further investigation as her department does not investigate special educational classes. On 05/17/2023, I completed the Exit Conference with Ms. Maralyn McNally, I informed Ms. McNally that a complaint was received however it was determined during the onsite investigation Child A is not enrolled in the head start problem. The investigation will be closed.

    On 09/20/2022, I received an email from the licensee designee and education specialist, Shana LaForest, regarding Child A being left unsupervised in the bathroom. On 09/21/2022, I received the written incident report from Ms. LaForest and informed her that a special investigation was being opened. On 09/21/2022, I conducted an onsite inspection at Dooley Head Start. I interviewed Ms. LaForest regarding the incident. Ms. LaForest stated that on 09/20/2022, she was notified that Child A had accidentally been left in the bathroom. Child A is in Nicole Heck's and Jessica Salada's classroom. They were coming in from outside and split into two groups to take the children to the bathroom. Ms. Salada had the girls in the bathroom along with some nurses and a student teacher. Ms. Salada was counting the children to leave the bathroom when she was asked for the room key by one of the nursing students. Ms. Salada lost count and thought she had all of the children, but when they returned to the classroom "within a few seconds" Child A was knocking on the door and the child care staff members realized she had been left in the bathroom. Ms. LaForest indicated that she went to the center on 09/20/2022 and retrained child care staff members on face to name counts, using their daily health and safety checklist and active supervision. I then interviewed Ms. Heck. Ms. Heck indicated that on 09/20/2022 at around 9:30a.m. or 9:40a.m., she and Ms. Salada were bringing the children in from outside. They did at count along the wall using the checklist and there were 13 children. Ms. Heck and Ms. Salada split the children into two groups to use the bathroom. Ms. Heck had six boys and Ms. Salada had seven girls. There were also nurses and a student teacher present. Ms. Heck stated that while inside she realized Ms. Salada had the key to the classroom so Ms. Heck asked one of the nurses to get the key from Ms. Salada. Ms. Heck got the key and walked her group into the classroom. She noticed Ms. Salada was also leaving the bathroom at the same time and they all went into the classroom. While in the classroom, they broke into small groups and the children went to their assigned tables. Ms. Heck then heard a knock on the door and Child A was crying at the door. Ms. Salada picked up Child A and comforted her. Ms. Heck stated that she thought the transition from the bathroom to small group was one to two minutes, but she could not say exactly how long Child A was unsupervised. She was confident that Child A was unsupervised for more than a few seconds. Ms. Heck indicated that Ms. Salada contacted Child A's Mother and informed her of the incident. Child A's Mother seemed fine at pick up and she did not express any concerns. 3 I asked Ms. Heck how children are accounted for. Ms. Heck indicated that she uses a transition song with face to name and a daily checklist. She acknowledged that face to name training is part of Head Start training. I asked if she had any concerns with Ms. Salada's care and supervision of children. Ms. Heck explained that Ms. Salada can get distracted, but did not have any quality of care concerns. During the onsite inspection, I interviewed Ms. Salada. Ms. Salada indicated that on 09/20/2022, at around 9:30a.m., she and Ms. Heck were bringing the children in from outside. They split the children into the two groups to take them to the bathroom. Ms. Salada had seven girls and Ms. Heck had six boys. Ms. Salada also confirmed that there were nurses and a student teacher present. While in the bathroom, Ms. Salada was counting the children before leaving when one of the nurses asked her for the room key. Ms. Salada was confused as to why the nurse needed to get into the room because they are not supposed to have the key. She peeked out of the bathroom and saw Ms. Heck waiting by the classroom door. Ms. Salada then gave the key to the nurse and walked out of the bathroom with the student teacher "as the caboose." Ms. Salada was distracted an
