On 07/13/2022, I arrived onsite to interview the child care staff members regarding the allegations. I interviewed Mr. DeBelko and Whitley Jones. Mr. DeBelko was the licensee designee and acting program director at the time of the onsite inspection. Ms. Whitley, who began working on 07/05/2022, was a child care staff member who had been the acting assistant program director upon her hiring. There were five CCSMs in addition to Mr. DeBelko and Ms. Whitley. Ms. Mikaila Martinez, Ms. Sharon Stephens, Ms. Janel Macklin, Ms. Chantal NTounta, and Ms. Sandy MacDougall. They were all hired on 07/08/2022 or prior. I asked if the staff received an orientation of the rules and the center's policies and procedures after being hired. Mr. DeBelko said they all had not. I requested all required documents. There was no TB test for Whitley Jones, Sandy MacDougall, Janel Macklin, Chantal NTounta, and Mikaila Martinez. Sharon Stephens had a TB on file. There was no CPR and first aid for Mikaila Martinez and Chantal NTounta. Whitley Jones, Sandy MacDougall, Janel Macklin, and Sharon Stephens had their CPR and first aid cards on file. There were no consent disclosure forms or signed abuse and neglect statements for any of the staff. There was no Health & Safety or other professional development trainings provided to the department available upon request during the check of records. On 08/10/2022, I completed another unannounced onsite inspection. I interviewed Ms. Meagan McLeod who said she was the acting program director since approximately 07/19/2022. There was an entirely new staff because all previous employees had resigned. The new staff consisted of child care staff members, Deanna Smolinski, Cherie Bridges, and Kyra Wilson. I asked to check all the child care staff members' certifications on file. Each child care staff member had consent disclosure forms, current CPR and first aid cards, medical clearances that showed negative TB tests, signed abuse and neglect statements, and a verbal statement by Ms. Meagan that they attended an orientation on the policies and procedures of the center as well as the licensing rules. 3
Child care staff members (CCSM) are not licensed or certified but are left alone with children. Construction is done in the presence of children leaving hazardous chemicals, ladders, and other debris. C. The children are being transported in a bus with no safety belts.

On 07/13/2022 I arrived onsite. I interviewed Mr. DeBelko and Ms. Whitley regarding the allegations. They said they would not have children in an area where they could be within reach of poisonous and toxic materials. Mr. DeBelko took me to an area that was being repaired. The area being repaired was in the child approve space, but it was away from where the children were. Dry wall was being finished. The gentleman who was working on the dry wall had a ladder and tools. The work area was approximately six feet from a table where children were sitting. There were no toxic or hazardous chemicals within reach of the children. There were about five accordion partitions that were affixed throughout the center. Mr. DeBelko and I took one of the partitions and moved it to enclose the gentleman who was working on the dry wall so that it would not be seen by the children who were in care. On 08/10/2022, I conducted an onsite inspection. There was no one working on dry wall. There were no poisonous or toxic materials within reach of the children.

When I arrived, there were five toddlers inside with two child care staff members and five preschoolers outside with one child care staff member. There was a total of 10 children present with three child care staff members. The center was in ratio. I interviewed Mr. DeBelko and Ms. Whitley regarding the allegations of ratio. Ms. Whitley said she often stays later than her scheduled time for the center not to be out of ratio. Mr. DeBelko said they have been out of ratio a few times; however, they work very hard not to be out of ratio. I interviewed Ms. Sandy regarding the issue of ratio. Ms. Sandy said she had been at the center since 02/2022 and on occasion had seen the center out of ratio. I interviewed Ms. Mikaila and asked her how often she has seen the center out of ratio. Ms. Mikaila said a few times since she has been hired, she has seen the center was out of ratio. I interviewed Sharon Stephens regarding the allegations of ratio. Ms. Sharon said she had not seen the center out of ratio. On 08/10/2022 when I arrived onsite, there were 10 children present with three child care staff members present. Three children were toddlers and seven were preschoolers. There was enough staff present for the number of children in care.
On 07/13/2022 I arrived onsite and interviewed Mr. DeBelko and Ms. Whitley regarding the allegations. I asked to see the bus. Mr. DeBelko, Ms. Whitley, and I went outside and got on the bus. There were 14 seats on the bus. All seats had working seatbelts. Mr. DeBelko said each time the children are transported, they ensure the children are wearing their seatbelts.

On April 20, 2022, I initiated this complaint via telephone with the complainant. The complainant stated licensee designee, El-Marty DeBelko was outside of the center when their child and another child were left in the center alone. The complainant was not aware if this has happened prior to the date of this incident, April 14, 2022. On May 6, 2022, during an unannounced on-site inspection, I interviewed El-Marty DeBelko, licensee designee. Mr. DeBelko admits that he was working at the center on April 14, 2022. He denied that children were left alone. He said that he had to leave to pick up his wife from work. He stepped out the door and inform the staff member who was outside that she needed to come back in because he had to leave. Mr. DeBelko said that his mother, Chantal Ntounta was present in the center. Ms. Ntounta, who volunteers at the facility, entered the building through the rear door, so it would appear that the children were left alone if no one saw her come in. On May 12, 2022, Chantal Ntounta, unsupervised volunteer, was interviewed via telephone. Ms. Ntounta said that she helps as a volunteer at the child care center and was present on April 14, 2022. She could not remember the time that she arrived but knew it was in the afternoon. She said that she entered through the door in the back of the building. Mr. DeBelko was present with two or three children in care when she arrived. There children were not alone. Ms. Ntounta denied that children are ever left alone in the child care center. On May 12, 2022, Janell Macklin, child care staff member, said she was not present on April 14, 2022. She has never known children to be left unattended at the child care center. She is aware of Ms. Ntounta coming to the facility to volunteer but does not know if she was there on the date in question. On June 30, 2022, Child B's Mother stated her only concern is the high turnover rate of child care staff members. Although there have been three or four child care staff members since her child enrolled, the care of her child has been good. She does not have any further concerns. 3

This special investigation was initiated with an unannounced on site inspection on March 1, 2022. El Marty De Belko, Licensee Designee and Janell Macklin, childcare staff member were present. Mr. Del Belko reported that there is currently no program director employed. The program on record, Lisa Elliot quit unexpectedly. They are currently interviewing for a new program director. On April 14, 2022, Lisa Elliot, former program director was interviewed via telephone. Ms. Elliot said that she was employed as Spreading Childcare's program director. She quit working in that capacity on February 4, 2022. On April 14, 2022, Caitlyn Carson was interviewed via telephone. Ms. Carson said that she is the program director. She said that she was hired on April 1, 2022. Ms. Carson is an approved PD. Her educational credentials were approved by the department. On April 20, 2022, during the exit conference with Ms. De Belko, he reported that Ms. Carson is no longer employed as the program director and he was again, interviewing to hire a new director. Meanwhile, he is going to substitute as the program director until a one is hired. On April 20, 2022, Ms. Carson confirmed that she is no longer employed as the program director. Her last day was April 15, 2022.

On March 1, 2022, during the on-site inspection, I observed wires exposed at the front of the child care facility. The wires were high above the front door and not within reach of children. Mr. De Belko disclosed that they are getting a new front door and security system installed. The children are not cared for in this area of the childcare and only go through this door when they arrive and depart from the facility. On March 1, 2022, Janell Macklin, childcare staff member, confirmed that there are repairs being done on the front door. She said the children do not go in the front of the center. On April 14, 2022, Ms. Carson reported that when she began working at the child care, the repairs on the front door was completed. The current door and security system was already installed when she began working on April 1, 2022.
