Based on our findings, investigation, and review - which includes considering the investigation and findings of MDHHS - CCLB determines LT and Teacher 1 are conducive to the welfare of children and eligible to be associated with a child care organization.

While LT responded to Child A immediately after his fall, she did not provide appropriate care and supervision when she did not fully assess him for injuries, nor did she take into account that he had recently recovered from a fractured femur of the same leg that he was unable to put full weight on after the fall in the classroom. Additionally, LT did not inform the teacher working in the classroom in the afternoon about Child A's fall.

R 400.8263(1)(b) · R 400.8263(1)(b) Child accidents and incidents; child and staff illness (1) A center shall develop and implement a written plan for how and when a parent is notified if program staff or volunteers observe any of the following: (b) A child experiences an accident, injury, or incident.

The center's incident reporting policy states "if an injury produces any type of swelling or needs medical attention, [parents] will be contacted immediately". Child A's parents were not informed of his injury until two hours and forty-five minutes after the fall had occurred.
