On 01/14/2022 I completed an onsite inspection and interviewed center director Meghan Jackson. Ms. Jackson reported that child care staff member (CCSM) Kira VanWagner, called her over to the Adabelle classroom and told her that the Terance classroom was outside, and she found Child F (female, 4 years old) in the bathroom. Ms. Jackson then went into the classroom and saw Child F in the bathroom with her snow clothing all over the floor. Child F told her that she had to use the bathroom. Ms. Jackson asked her if she told any of the CCSMs and Child F told her that she told CCSM Savannah Kelsey and the other one. Ms. Jackson said that she then helped Child F get her snow clothes on and she brought her outside to join the rest of the classroom. When Ms. Jackson went outside, she asked the CCSMs how many children they had, they looked and counted, and she told them that they were missing one. Ms. Jackson said that CCSM Kenda Kelley then told them that they were missing Child F. Ms. Jackson explained that the Terance Room has children ages 2 years 10 months to 3 years 10 months, and they follow a 1 caregiver to 10 children ratio; Savannah Kelsey and Rebekah Peet are the CCSMs that were working when the incident occurred. Ms. Kelsey and Ms. Peet were responsible for the 18 Terance classroom children plus 4 Pratt classroom children, for a total of 22 children, the youngest being 2 years 10 months. The Terance classroom has a capacity of 20 children. I interviewed CCSM Savannah Kelsey, the lead caregiver in the Terance classroom, who reported that the Pratt classroom was going to be splitting up the group so CCSMs could take breaks. The younger children were coming into her classroom and the older children were going into the Otis classroom. She said that they were then told the plan changed and the Pratt children would stay in her classroom until an Otis classroom CCSM arrived at 9:00 AM. After 9:00 AM, the Pratt children were still with her, so she decided to go outside. As they were getting ready to go outside, Ms. Kelley came to get the Pratt children and said that she was going to get the rest of the Pratt children from the Otis classroom. She thinks she had 17 children at the time. She explained that Ms. Kelley then came back to the Terance classroom with the rest of the Pratt kids which she thinks was 3 more children. Some children from each classroom were already dressed to go outdoors and Ms. Kelley took 10 of them outside, leaving 14 inside with her and Ms. Peet. Child F told her that she had to go to the bathroom, so she told Ms. Peet to take 10 more children outside. Ms. Kelsey stated when she finished getting the last child ready, she grabbed the name to face board and went outside. She said that she did not know the exact number of children they were responsible for because of the Pratt classroom joining them and she did not double check the bathroom. She said that she had just walked outside, put her stuff down and was putting her hat on when Ms. Jackson came outside and told them that Child F had been left inside. She had not had a chance to complete the name to face process yet. She believes that Child F was inside by herself for 3 less than 5 minutes. Ms. Kelsey said that the room capacity is 20 and thinks that they had 24 children outside. I interviewed Kenda Kelley, the lead caregiver in the Pratt classroom, who reported that she started her day in the Terance Classroom and then moved to the Otis classroom. She explained that she took two children to the Otis classroom and then the Terance classroom sent a third Pratt child to Otis because they were over the required staff member to child ratio. At 9:00 AM, she took her three children back to the Pratt classroom to get their snow clothing on and then she went to the Terance classroom to help the other Pratt child that was in there get ready to go outside. She said that she then took 10 children outside. She thinks there were 24 children inside the Terance classroom b

The Terance classroom had a child in the group that was 34 months old which would require a maximum group size of 16 children. There were 22 children in the classroom.

Ms. VanRyn, program director, did not appropriately administer the day-to-day operations of the center. When she discovered a child's file was missing documentation, she falsified the documentation and submitted it to child care licensing.

ON 11/17/2021 a complaint was received by the Child Care On 11/17/2021, 1 spoke with Child A's Mother via telephone. She said that she had concerns that child care staff member (CCSM) Kristin Rasmussen was being aggressive with children. She explained that her came home from child care with bruises on legs that she thought looked like thumb prints and she showed the pictures to he center director, Meghan Jackson, who told her that they would take care of it. Child A's Mother said that the director told her that there were multiple people backing up her claims that Ms. Rasmussen was aggressive with the children. Child A's Mother said that Child B's Mother was upset because Child B had a bruise on her face and no report of what happened was made to her. Child A's Mother had no first-hand knowledge of any children being mistreated, her concern is based on Child A having unexplained marks and bruises and on what CCSM Taylor Rozenboom has told her. Child A's Mother said that Ms. Rozenboom told her that she has seen Ms. Rasmussen being rough while changing diapers and has seen her pulling children by the arm. Child A's Mother has not addressed any concerns with Ms. Rasmussen but did exchange messages with her about marks Child A had in September 2021. Child A's Mother sent me a photo of Child A's legs that showed four faint bruises, two on the shin of each leg; the photo was taken on 11/10/2021, at 9:11 PM. She also sent me two screenshots of messages she exchanged with CCSMs Kristin Rasmussen and Casey Leonhardt dated 09/29/2021. The messages Child A's Mother sent to Ms. Rasmussen read, "Question, I've been noticing [Child N A] coming home with marks and bruises on face this week. Did something hap en?" Ms. Rasmussen's response was "Not that I noticed... .but Lucy normally has .. Casey had■ today..." Child A's Mother's message to Casey Leonhardt rea , ' ey friend, I have a question. [Child A] has been coming home with marks C] and bruises on face recently, have there been any accidents that has had at school that no one told me about?" Ms. Leonhardt's response read, ` s ar as I know l R hasn't got hurt or anything!! I noticed had a small bruise on forehead pis morning but I didn't see an thing happe.; yesterday or today!" C A's Mother's response read "Okay cool! could have done it at home, I just feel like I would remember if something happened to cause a bruise..." On 11/18/21. I comp e e an announce on-sl e inspec ion. e spo e wi center RrecotoReghan Jackson who explained that the allegations pertain to the Faris classroom which was co-led by Casey Leonhardt and Kristin Rasmussen until yesterday when she moved Ms. Rasmussen to another classroom. CCSM Lucy Byrne is the assistant staff member in the classroom and other CCSMs fill in as necessary. Ms. Jackson said that she moved Ms. Rasmussen to another classroom due to performance issues. Ms. Jackson explained that last Thursday, November 11, 2021, Child A's Mother told her and CCSM Alison VanRyn that she saw finger sized bruises on Child A's leg and showed them pictures she took of them. Ms. Jackson said that she explained to Child A's Mother that they were already planning to move Ms. Rasmussen to another classroom due to her performance. Child A's Mother did not say what caused them but told her that she thinks "they" ignore her child because she is a staff member's child and that Ms. Rasmussen had come into her classroom to update her about how Child A would not stop crying and wanted to be held all the time and she felt like that was putting extra pressure on her. Child A's Mother claimed that the marks on Child A's legs were not there when she dropped off in the morning. Ms. Jackson reported that she did a coaching with the CCBM's in the Faris classroom regarding supervision and documenting when children fall and get hurt. Ms. Jackson went on to explain that Ms. Rasmussen was not the primary caregiver for Child A. so she did not understand why Ms. Rasmussen was being accused

On 07/15/2021, I spoke with Child A and B's Mother regarding her son getting injured while in child care. She stated that she received a call immediately after the incident. She was told that her son fell on the fence, his tooth was bent forward and that she needed to pick him up. She picked him up from the center and took him to the dentist. The dentist was concerned that his jaw may be broken. His primary dentist told them that they needed to see a pediatric dentist specialist. The pediatric dentist took x-rays and found that his upper jaw was broken which is called a "displace fracture." They completed an emergency procedure right then which was putting in a splint. He can only have liquid foods. They followed up the week later. She was told that the jaw was looking pretty good, but his baby tooth would die and fall out. They are not sure if this injury will affect his adult tooth. Child A and B's Mother stated they pulled both boys out of the center the same day of the incident. They might use the center for care again, but they are not sure. She stated her children had been attending the center since last summer. 3 On 07/15/2021, I received a message from the complainant source stating that she thinks that this incident has starting to be taken care of. She stated that she does feel like she may have acted in haste in contact us as she didn't realize that the director had actually started looking into this and was giving out reprimands. On 08/11/2021, I spoke with new Program Director Megan Jackson regarding the complaint. She stated that she was not employed with AppleTree when the incident happened. However, while she was completing her training at the center to become the new director, she noticed that the child care staff members were doing something that she refers to as "Parking" meaning staff in the classroom doing nothing, not interacting with the children, which made her ask Ms. Mueller, the interim director at the time, what she was walking into as the new director. Ms. Mueller told her that the center was on a provisional license because a child in the lyric classroom was climbing a fence, slipped on his way down and broke his jaw in the process of falling down. Ms. Mueller told her that there were no tears but they still called the parents immediately. The parents decided to take him to the urgent care, where they learned that he dislocated his jaw. Ms. Jackson said she asked Ms. Mueller "where were the teachers"? "Are the teachers still employed here"? and she asked her "what was the result from the incident"? Ms. Mueller told her they were placed on a provisional license. She told Ms. Mueller that she would be watching the lyric classroom and she would be terminating staff if she had to. NOTE: The center was issued a 1St provisional license for repeated violations of inappropriate care and supervision, not reporting an incident involving an allegation inappropriate contact, and disclosing confidential information. This was found during investigation 2021D 0607006. The 1St provisional license was not issued due to the allegation of this investigation. I interviewed Operations Manager, Emily Vandergalien who stated that her role is to oversees all of the operation specialists for Appletree Christian Learning Centers. She explained that there is an Operation Specialist assigned to each Appletree facility and their role is to support the programs directors of those facilities. Ms. Vandergalien stated that because she is the Operations Manager, she is aware of the incident involving Child A, but she does not know specific details of the incident. However, she was able to confirm that the child care staff members working in the Lyric room at the time of Child A's injury as Aimee Waterman, Kierstyn Moeggenborg, Jessica Cazier, however she was on break at the time of the incident, Sarah DiPiazza and Katie Mueller who was the interim program director at the time. Ms. Waterman denies that the child care staff members huddle up under the awning talking to each other and not supervise the children. I asked Ms. Moeggenborg her about the allegation that the staff members are huddling around under the awning talking to each other and not supervising the children. She stated they have staff members spread out all over the L-shape playground. Some of the staff members go under the awning but children are under there too. The staff talk but they don't all huddle in a group and not supervise the children. I asked if the Lyric and Pedal classroom go out together. She said it makes it easier to have more staff members. She said they each have their 12-15 children when they go out together. Ms. DiPiazza stated she felt like she was the only active staff member who played and engaged with the children. The other staff members liked to sit together under the awning supervising the children but not engaging or playing with them. Even in the classroom staff members would sit against the wall supervising the children but not actively engaging or playing with them. She said she would not say that they didn't supervise the children, but she would say that they could do better at supervising and more specifically engaging with the children. She stated that when she was first hired the Pedal and Lyric classrooms used to go outside together. When Ms. Mueller became the new director, she told them that they couldn't do that, so they stop doing it. Ms. Mueller stated that while she was employed at the center, she was diligent about improving staff member's supervision of children. She said she completed three walk throughs a day and if she noticed any issues, she would correct the staff right away. She stated that she never saw eight staff members huddled under an awning together not supervising children. She stated that when she first started, she told all the staff about her expectations regarding supervision. She immediately told the Lyric and Pedal classroom that they were not allowed to go outside together. On 08/24/21, I interviewed Child C's Mother about the allegations. She stated that she has never seen staff members huddled up under an awning not supervising children. She stated whenever she sees staff members, they are standing in the middle of the playground supervising or playing with their children. I also interviewed Child D's Mother regarding the complaint. She stated she has witnessed staff members sitting under the awning not playing with but supervising the children. She has not had any issues with supervision or discipline. On 08/26/21, I spoke with Child E and F's Mother regarding the complaint. She stated that she has not had any issues with discipline or supervision. On 08/27/2021, I completed a follow up phone call with Child A and B's Mother. She stated that before the incident the only concern she had with the center was that Child A was getting bitten a lot. Her older son kept getting reports that he was being bad. She stated he never received reports about his behavior from the Kentwood location and she just thinks it's because of their lack of supervision.

According to staff interviews, the lyric and pedal classrooms which both provide care for children from 12 months to 30 month of age, would combine on the playground. The two classrooms combined resulted in more than the maximum group size of 12.

Ms. Campbell admitted to pushing Child C off of her which resulted in Child C receiving a red mark on her shoulder. Pushing a child is a form of corporal punishment and is prohibited.

On 04/2712021 I spoke with the complainant. On 04127,2021 and I spoke with Child A's Mother via zoom. She explained she did not like the wayRce"ainc care staff members conducted themselves, such as she has seen staff member Aimee Waterman kiss child care children and favored another as their parents gave her an expensive gift card. She stated she reported this to the program director, Jana Conley and Megan and they did give her a written warning on the matter. She explained Child A started in the Farris classroom and had a total of four incident reports in this classroom and she has no concerns with this classroom as she does trust the child care staff members working in the Farris room. She explained Child A is currently in the Lyric classroom and has been for roughly a month. Child A has received eight incident reports within roughly a month's time frame. She stated Kierstyn Moeggenborg and Ms. Waterman are staff members in the Lyric classroom. She explained the classroom is divided into two separate classrooms, each room can see and observe the other room. One half is the Lyric room and the other is the Pedal room. The staff members that can observe Child A's room include Jessica Cazier and Sarah DiPiazza. She stated the injury on Child A that occurred on 03/0112021 resulted in a swollen wrist due to Child A having his hand slammed into a bathroom door by another child care child. She stated the bathrooms are located in the classroom and she believes the doors are to remain closed to prevent these injuries. She stated in order for the bathroom door to be unlocked, a staff member has to be present in or around the bathroom. An incident report was written for this and showed the incident happened at 2:50pm. Child A's Mother believes diaper changes should have already occurred by that time so it was unclear why children were able to play in the doors. She explained she spoke with Ms. DiPiazza about this incident and asked if the door was locked or not, but Ms. DiPiazza could not provide a clear answer on this. She stated she spoke with Ms. Conley about this matter as well and she responded that Child A was "clumsy" and "just having a bad day." She stated she was not comfortable with this answer because Ms. Conley has a child in that classroom as well and she should be more concerned with the incidents that are occurring in the Lyric classroom, but she feels Ms_ Conley is `blowing it off." She explained she is very concerned with the number of incidents and the severity of injuries Child A is having. She stated last Tuesday, 412012021 she dropped Child A off at the center and he had no bruises or marks on him and she spoke with a few staff members in the morning and they also observed no marks or bruises. However, when she picked Child A up that day, he had a' "on his head. She explained she asked Ms. Moeggenborg what had happened, and 4 she responded, "I have no clue what happened and there is no report." She then went to Ms. Beduhn and Ms. Conley, showed them the bruise on Child A and shared the response she received from Ms. Moeggenborg. She stated Ms. Conley did go into the classroom for a moment. She stated she is trying to figure out what happened and received mixed stories. She stated Ms. Conley told her Child A was being clumsy and is having a bad week. Ms. Cazier explained when she came back from break, Child A had the bruise on his head already. Child A's Mother reported she does not believe Ms. Cazier is hurting Child A, but believes she has difficulties with supervising the child care children. She stated Ms. DiPiazza told Ms. Beduhn when she arrived at the center at 8:45am that day, the bruise was already on Child A's forehead. The next day, Ms. DiPiazza "changed her story" and said the mark on his forehead was from a fall he encountered on Monday, however there was no incident report for this. Child A's Mother was concerned with this statement because she did not understand how a bruise of that size would not show

On March 3, 2021 I spoke with Child A's Mother on the telephone. She stated that on January 20, 2021 she received a phone call from program director, Jana Johnson-Dust, letting her know that Child A was involved in an incident where two children were found in the bathroom. She said she was told that Child A had told two other children to go into the bathroom to "show each other their " Child A's Mother spoke to Child Ai , age!) about the incident, o her that did not tell the other children o go in o the bathroom. told her ild B , a e ) and Child C age,) were talkin about and asked if wanted to go into the bathroom with them. let her now that wanted to go, bu knew it would be wrong. told her did not go into the bathroom with Child B and Child C. She spoke wit hiid A about inappropriate and appropriate behaviors and body safety. During this discussion Child A disclosed that Wi s Child B asked Child A if could put Child A's told i her this happened during a summer on one o e water days other stated that she did not ask if there was contact, nor did Child A disclose if there was contact. Child A's Mother stated she sent an email concerning the disclosure concerning the incident in August 2020 and her concerns to Ms. Johnson-Dust, that same night, January 20, 2021. She and Ms. Johnson-Dust spoke face to face about the disclosure on January 21, 2021 at the center. Child A's Mother stated that during the 3 face to face conversation Ms. Johnson-Dust disclosed that Child B- On February 2, 2021 Child A's Mother spoke again with Ms. Johnson-Dust to follow up on the incident. Child A's Mother stated that when she mentioned that Child B had been , Ms. Johnson-Dust was surprised that she knew this information. Child A's Mother explained she reminded her that she had given her that information in January. I requested a copy of the incident report and the email she sent to Ms. Johnson-Dust. She sent the requested items to me via email and text. They are on file with the report. On March 3, 2021 I received a forwarded email that Child A's Mother sent to Ms. Johnson-Dust and a text with the incident report received in August 2020. The email is dated January 20, 2021 and was sent at approximately 6:00pm to Ms. Johnson- Dust's email. The email states Child A disclosed that durina an incident that took place 5, 2020, Child B "attempted to or did put " The incident report reads Child A "and a friend were in centers and every time a teacher would look over, would be friend or trying to touch them in inappropriate places." T ere is a note written on the back stating the staff member spoke to Child A about body safety. Child A was reminded to let an adult know if a child is trying to touch inappropriately. The incident report was signed by Sarah Waucaush and Rache oreau. The line for the program director and parent signatures are blank. On March 8, 2021 I made an unannounced on-site inspection at the center. I spoke with program director, Jana Johnson-Dust and discussed the allegation. Ms. Johnson-Dust informed me that the and there are new child care staff members assigned to that room. I spoke e current staff members Adam Ritz and Devin Rood. Ms. Johnson-Dust stated that she was not aware of an incident concerning allegations of inappropriate contact between Child A and Child B. She stated she is only aware of an incident that occurred on January 20, 2021 where Child B and Child C were found in a bathroom together but there were no allegations of inappropriate contact involved. She said she did not inform the department about this incident. Ms. Johnson-Dust said she spoke with Child B's Mother, Child C's Mother, and Child A's Mother on January 20, 2021 about this incident. Child B and Child C told her that Child A had told them to go into the bathroom. Even though• wasn't found in the bathroom, was still involved in the incident. On March 3, 2021 1 spoke with Child A's Mother on the telephone. She stated there were also concerns about bullying and a child saying inappropriate "political" things to Child A; these concerns began in October 2020. She said that Child A had told her that Child G was saying inappropriate things to Two examples were "If you're not going to be my best friend I'll you" and rump is the ruler of the world." She spoke with the and the program director about her concerns. They agreed to keep the children separate. Then issues with Child B became a concern and staff attempted to keep Child A and Child B apart. Child A's Mother stated that in November during parent- teacher conferences, informed her other parents had concerns about political comments being said y a child to other children. She provided me with the name of Child l's Mother, stating she also had concerns. On March 8, 2021 I made an unannounced on-site inspection at the center. I spoke with program director, Jana Johnson-Dust and child care staff members Adam Ritz and Devin Rood. Ms. Johnson-Dust stated she was aware of comments being said by Child G. She is only aware of Child A's Mother having concerns regarding this. She has spoken with staff about this issue. Ms. Johnson-Dust stated she had received emails from Child A's Mother with concerns about Child G and things. was saying to Child A. During my on-site inspection, I spoke with lead caregiver of the Otis room, Adam Ritz. He has been in this current room since the end of . He said that other children have approached him to tell him that Child S has said, would'____ ." and them." But he has not heard Child G directly say these things. When he speaks with Child G about the statements, Child G says `, did say' the statements. He stated that he has spoken with Child O about why these are inappropriate comments. He stated these incidents happened "a couple of times a month'. Within the last two weeks he is not aware of Child G saying anything to children. He is not aware of any parents expressing concerns about this. I spoke child care staff member Devin food. She said she has been an assistant staff member in the Otis room since late . She is aware of Child D, Child O, and Child H "talking inappropria e y such as "The incidents have not been written down. She is not aware of any parents having concerns about this. She did overhear one parent say to Child K, If your friend is mean, find a new friend." She stated that she knows the ``friend" is Child O. On March 10, 2021 1 spoke with of the Otis room, She stated that she was a staff er at the center C sr age was exhibiting aggressive behavior and language. She is aware that Child I was for these behaviors. Child C and Child F picked up on this behavior and mimic e it. She stated Child I is at the center. She mentioned that parents shared their concerns about be avrors observed and things said to their children. The parents of Child C, Child E, Child F, Child C, and Child H expressed concerns. There was a behavior plan in place for Child I. On March 10, 20211 spoke with current child care staff member, Sarah Waucaush on the telephone. She stated that there was a "big problem" with violent behaviors and language. The children that exhibit those behaviors are Child F and Child G. She stated there are multiple parents that have expressed concerns about these behaviors. She did not remember which parents. On March 15, 2021 1 spoke with Child I's Mother on the telephone. She stated Child I made a comment to her in Se ite mper 202€ saying that `everyone from should ." When she asked where heard this, Child I told her that Child C has sai~iat to . She spoke wi th t~ s.ohnson-Dust about what Child I stated and where heard it. This conversation occurred during mid-September 2020. Ms. Johnson-Dust told her she would "address" the concern. lbs.
