On 03/22/2023 program director Raana Aminlari left a voice mail message for Licensing and sent an incident report regarding the allegation. Ms. Aminlari also sent written statements from Staff 5, Staff 6, Staff 7, Staff 8, and Staff 9 who worked in the preschool classroom on 03/21/2023. On 03/27/2023 I completed an on-site inspection and interviewed Ms. Aminlari. She stated she spoke with Child F's Mother and Child F's Father. They confirmed Child F had made the statement about Child G and Child H. Ms. Aminlari spoke with Child G's and Child H's Mother, Child G's and Child H's Father regarding the allegation. Child G's and Child H's Mother was not aware of Child G or Child H ever doing that type of behavior. She informed Ms. Aminlari that Child G's Father and Child H's Father had a conversation with Child G and Child H about acceptable and unacceptable behaviors with classmates, mentioning unacceptable behaviors including hitting, kicking, pushing, pulling pants down. Child G then said to Child G's and Child H's Father that Child F had pulled Child G's and Child I (4 years old)'s pants down when they were playing doctor. 3 Ms. Aminlari spoke with Staff 5, Staff 6, Staff 7, Staff 8, and Staff 9 regarding the allegation. None of the staff observed Child F, Child G, and Child H behaving in this way. None of the staff had ever seen any of the children in the class behave this way. Staff 6 told Ms. Aminlari on 03/21/2023 right before nap time she walked over to where Child F's cot was, and Child F and Child G were near the cot, but both children were standing up, had their clothes on, and there was no indication of anything like that happening. Ms. Aminlari stated since this allegation was made, all staff that work in the classroom are aware of the allegation, and staff are making sure to position themselves in the classroom so they can directly observe the children all the time. Ms. Aminlari stated on 03/24/2023 after nap time, while children were reading books on the carpet, Child J (4 years old) lay down on his stomach, and Staff 7 observed Child G put his hand on Child J's back and try to pull on Child J's pants. Staff 7 immediately told Child G to stop and told Child J to sit up. I interviewed Staff 5, lead caregiver in the preschool classroom. She stated that, prior to this allegation being made, she had no concerns about this type of behavior with any of the children in the class. On 03/21/2023 she opened the classroom at 6:30am and was in the classroom all morning. Staff 7 arrived around 7:30am, Staff 9 arrived around 9:00am, and Staff 6 arrived late that day around 11:30am. There were 18 children (ages 4 and 5 years old) on 03/21/2023, which included Child F, Child G, and Child H. At 11:00am the children went outside with Staff 7 and Staff 9. Staff 5 remained in the classroom for prep time. Around 11:45am the children came back inside with Staff 7 and Staff 9. Staff 6 came into the classroom and gave Staff 9 a break. Staff 5 also left the classroom until 12:15pm. When Staff 5 returned to the classroom, Staff 6 and Staff 7 were in the classroom and the children were sitting down eating lunch. After lunch the children used the bathroom, brushed their teeth, and went to their cots preparing for nap time. Staff 5 did not see anything happen with Child F, Child G, or Child H during this time. At 1:00pm Staff 8 and Staff 9 came into the classroom and at 1:15pm Staff 5, Staff 6, and Staff 7 left the classroom for a meeting. Before Staff 5 left the classroom, she remembered seeing Child F asleep on a cot. Staff 5 had been patting Child H's back and Staff 9 came over to replace Staff 5 doing this. Staff 6 had been patting Child G's back before Staff 6 left the classroom. At 2:10pm Staff 5 returned to the classroom for a few minutes to get her things and then left for the day. On 03/15/2023 appropriate care and supervision were not provided to Child E in the Toddler 1 classroom at lunch time when staff did not prevent Child E, who is allergic to pineapple, from picking up and eating a piece of pineapple that had fallen on the floor.

On 02/21/23 I spoke with the complainant via telephone. The complainant stated that sometime in December 2022, Staff Member A and Staff Member B were working in the Kprep 2 classroom. During lunchtime, one of the staff members (unknown) served Child A the wrong lunch. Child A has numerous allergies including dairy and peanuts. Child A was fed a lunch brought in by Child B. The complainant claims that neither Child A nor Child B's parents were called. On 02/21/2022 I conducted an unannounced on-site inspection. I interviewed Raana Aminlari (program director/licensee designee), Staff Member C (floater assistant staff member), Staff Member D (infant 3 lead caregiver), and Staff Member H (Kprep 2 assistant staff member). All interviews were conducted privately in a vacant room located in the main office. Ms. Aminlari stated that on 12/02/2022, Staff Member E (young preschool assistant staff member) told her that she believes Child A may have been given Child B's lunch. Ms. Aminlari indicated that she took this allegation seriously since Child A has numerous known food allergies and only eats food brought from home. Ms. Aminlari spoke with Staff Member E and Staff Member B and determined that this incident did not occur, and it was just miscommunication between staff members. Ms. Aminlari stated that she did not contact Child A's parents since the food Child A was fed was in fact the food that he brought to the center that day. Child A did not suffer any food allergy related symptoms while in care that day. Ms. Aminlari provided me with the attendance record for the Kprep 2 classroom on 12/02/2022, which shows that Staff Member H, Staff Member B, Staff Member A, Staff Member I, and Staff Member E worked in the classroom that day. Ms. Aminlari stated that there has been a lot of staff conflicts occurring over the past few months and numerous staff members have been terminated from their employment. Ms. Aminlari indicated that she was concerned as one of these former staff members has been making false claims and harassing her and other staff members. Ms. Aminlari said that the Oakland Country Sheriff has been notified and is monitoring the situation. 3 Staff Member H (Kprep 2 assistant staff member) worked in the Kprep 2 classroom on 12/02/2022 from 8:00am-12:00pm. Staff Member H stated that she left the classroom right around lunchtime, and she did not observe Child A being fed Child B's lunch. Staff Member H regularly works in the Kprep 2 classroom and said that she and all the other staff members are very careful about what food the children eat since many of them have numerous food allergies. On 04/06/2023, I interviewed Staff Member B (Kprep 2 assistant staff member) via telephone. Staff Member B worked in the KPrep 2 classroom on 12/02/2022 from 9:00am-1:00pm. Staff Member B stated that she was present during lunchtime that day and Child A was not given Child B's lunch. Staff Member B indicated that that she has never seen any children given the incorrect food while she has been present in the classroom. On 04/06/2023 I interviewed Staff Member A (Kprep 2 assistant staff member) via telephone. Staff Member A was in the Kprep2 classroom on 12/02/2022 from 6:30am-2:00pm. During lunchtime, Staff Member A observed Child A reaching over and trying to take Child B's lunch. Staff Member A told Child A to stop, and she made sure that Child A did not take any of Child B's food. Staff Member A indicated that Child A did not eat any of Child B's lunch. Staff Member A said that staff members are always walking around and observing the children eating to ensure that the children are only eating the food that was given to them. On 04/06/2023 I interviewed Staff Member I (former floater assistant staff member) via telephone. Staff Member I was working in the Kprep 2 classroom from 8:50am- 1:00pm. On 09/23/2021 program director Brittany Kunzelman emailed an incident report (BCAL 4605) to Licensing regarding the complaint allegation. On 09/24/2021 I interviewed director Brittany Kunzelman regarding th0alle ation. Ms. Kunzelman stated Child D was enrolled at the center Child D was in a PreK classroom with lea caregive 3. On WPWt ere were three staff members, Staff 1, Staff 2, and Staff 3 that provided care for Child D. On the morning of 09/22/2021 Child D's Father dropped Child D off to Staff 2's PreK classroom and Staff 2 provided care for Child D for a 4 few minutes until Staff 3 arrived at the center. Staff 3 went to Staff 2's classroom and took her children, which included Child D, to her PreK classroom. Staff 1 worked in Child D's PreK classroom when Staff 3 took a lunch break that day. Staff 1, Staff 2, and Staff 3 all stated they did not see any scratches or bruises on Child D, and they did not see anything happen to Child D that would have caused scratches or bruises. Staff 3 told Ms. Kunzelman that she did not grab Child D's arm, she would never mishandle a child, and she was upset that this would be alleged. On 09/128/2021 I completed an on-site inspection to the center with When I arrived at the center, was on-site, and he observed interviews with e staff. interviewed Ms. Kunzelman. Ms. Kunzelman stated the center has cameras in the allways, and on 09/22/2021 at 8:15am it shows Child D running down the hallway accompanied by Child D's Father. Child D was in Staff 2's PreK room for 10 to 15 minutes until Staff 3 arrived. Child D then went with Staff 3 to Staff 3's PreK classroom. That morning Staff 3 took the PreK children on a nature walk outside, and when they returned to the classroom Staff 3 took a break and Staff 1 provided care for the children for about an hour. When Staff 1 arrived in the PreK classroom the children were changing their clothes because they were wet and muddy as it had been raining outside. Staff 1 did not see any scratches or bruises on Child D's arm when Child D was changing his shirt. Child D's Mother picked Child D up around 4:00pm. Ms. Kunzelman stated Staff 3 started working at the center 6 months ago. and I interviewed Staff 1. She stated she began working at the center in June 2021. Staff 1 was aware of the complaint allegation. She stated Child D's Mother had sent a message to Ms. Kunzelman about Child D having a bruise on his arm and Child D's Mother was concerned about what may have happened to Child D. Staff 1 stated last Wednesday (0912212021) she gave Staff 3 an hour break at lunchtime. Staff 1 stated when she arrived to the PreK classroom the children were changing their clothes because they had gotten super wet from outside. Child D was taking off his t-shirt and was struggling a bit with changing his pants. Staff 1 stated she did not notice any marks or injuries on Child D's body when he was changing clothes. Staff 1 stated after the children changed their clothes, they sat down to eat lunch, and after lunch they got ready for nap time. Staff 3 returned to the classroom while the children were getting out their cots for nap time. When Staff 3 returned, Staff 1 left the classroom. Staff 1 stated while she was in the classroom Child D seemed to be in an okay mood, with the exception of when he was changing his clothes when he seemed a little frustrated. Staff 1 stated she has worked in child [1 care with Staff 3 for 3 or 4 years and has never had any concerns about Staff 3's care of children. and I interviewed Staff 2. She stated she has been working at the center since February 2019. Staff 2 was aware of the complaint allegation. She stated on Wednesday (09/22/2021) Child D arrived around 8:20am. Child D's Father dropped off Child D. Child D was a little upset and Child D's Father sat with Child D for a minute and then Child D's Father left.
