    R 400.8330 · R 400.8330 Food services and nutrition generally. (10) Menus must be planned in advance, dated, and posted in a place visible to parents. Food substitutions must be noted on the menus the day the substitution occurs.

    On 12/21/2020 I spoke with Program Director, Jeanine Opyr. She informed me that Child A had an allergic reaction to a food he ingested at the center on 12/17/2020 and that child care staff members were unaware of the incident until a call was received from Child A's mother. Ms. Opyr stated Child A's mother called her around 5:00 pm on 12/17/2020 and asked her how Child A was feeling while he was at the center. Since Ms. Opyr does not work in Child A's classroom, she was unsure. Ms. Weisman is the primary child care staff member that works in Child A's classroom. She works Monday through Friday from 8:30 am to 4:30 pm. Ms. Weisman was the only staff member in the classroom at the time of the incident. She called Ms. Weisman to inquire about Child A. Ms. Weisman told her Child A seemed fine and explained what Child A ate for snack in the afternoon. She indicated that Child A ate Little Bites Brownies. Ms. Opry relayed the information to Child A's mother and read the ingredients listed in the Little Bites Brownies to Child A's mother. At this time Child A's mother said that Child A is allergic to eggs and hung up the phone. A little after 5:00 pm, Child A's father called and asked Ms. Opry when and how many Little Bites Brownies Child A ate. Ms. Opry told Child A's father Child A ate 3 or 4 Little Bites Brownies between 2:30 pm and 3:00 pm. At 5:40 pm Ms. Opry received a message that Child A was taken to the hospital by ambulance and was being monitored for an allergic reaction. Ms. Opyr informed me that the center was closed for the holidays and would reopen on 1/4/2021. Ms. Opyr called the department on 12/17/2020 to report the incident. She submitted a detailed email and a full incident report on 12/18/200. On 01/05/2020 I completed an onsite inspection at Somerset Child Care Center. I interviewed Program Director, Ms. Opyr and child care staff member, Debora Weisman. Both Ms. Opyr and Ms. Weisman confirmed that Child A was given a package of Little Bites Brownies to eat for afternoon snack on 12/17/2020. They confirmed that both eggs and traces of tree nuts were listed ingredients in Little Bite Brownies, they were aware that Child A was allergic to both ingredients, but they didn't realize the snack eaten contained the named allergens. Ms. Opry stated that Child A has medication at the center in case he has an allergic reaction. The medication is stored in Ms. Opry's office and in Child A's classroom. She stated the medication and allergy plan was given to the center during the child's enrollment. I observed the medication. There were two containers of the Epinephrine medication Auvi-Q and one container of Antihistamine, Meijer Allergy Medication. Both bottles of Auvi-Q did not have prescription labels indicating the physician's name, child's first and last name, instructions, or name and strength of the medication. Ms. Opyr stated the center provides morning and afternoon snacks daily and families provide lunch and beverages. I observed a weekly snack menu posted in the hallway outside of the classroom. Ms. Opyr informed me menus are sent electronically to 3 families via the See Saw App, as well as posted for families on parent boards located outside of each classroom. She stated substitutions are shared on the See Saw App and child care staff will note if they had a birthday treat. The substitution was not posted on the menu posted outside the classroom and it was not sent on the See Saw App. The menu posted listed that the children ate blueberries and drank milk. I received and reviewed the center's snack and "food from home" policies. Both policies indicate that Somerset is committed to providing healthy food for children and states that snacks and birthday treats should be nutritious. Both the snack and" food from home" policies offers possible suggestions for appropriate snacks to share with the class. The food policy states that all food from home must be peanut and ground nut free. I received and reviewed Child A's f
