    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 09/16/2021 I received an email from licensee designee Michael Cardimen about the incident and on 09/17/2021 Mr. Cardimen emailed the written incident report BCAL 4605 to me. The incident report documents that on 09/15/2021 at 5:20pm, staff member Mahuya Muzumdar Das and Yucheng Shi were outside with 22 children when a "bathroom break was called". Ms. Shi took 7 children inside, and while inside Ms. Shi became preoccupied with a child who had hurt his knee. Ms. 2 Shi and the children returned outside without Child A (5 years old) who was still in the bathroom. Child A's Father arrived to pick up Child A and Ms. Shi and Ms. Das realized Child A was not back outside. Child A was found alone in the bathroom. Child A was left inside for "approximately 5 minutes". On 09/21/2021 I spoke with Child A's Father. He stated on 09//15/2021 around 5:00pm he went to the cafeteria to pick up Child A. At that time a female staff and several children were in the cafeteria. This staff told Child A's Father that Child A was outside. Child A's Father proceeded to walk outside to the playground where there was another female staff with some children. Child A's Father told the staff he was there to pick up Child A. The staff that was outside and Child A's Father looked around the playground for Child A, but neither could find Child A. The staff then asked some of the children if they knew where Child A was and several of the children began to call out Child A's name and look around the playground for Child A. Next the staff and children that had been inside in the cafeteria came out to the playground. One of the two staff, Child A's Father did not remember which one, went back inside. Child A's Father began walking back to the building and the staff that had gone back inside came to the cafeteria door and said she had found Child A still using the bathroom. Child A's Father stated Child A was not upset and probably didn't even know the group had gone back outside without him. Child A's Father stated it took between 7 to 10 minutes after he arrived before Child A was located. Child A's Father was also concerned how long Child A was "missing" before he had arrived at the school. On 09/22/2021 I completed an on-site inspection to the school and interviewed program director Michael Cardimen. Mr. Cardimen stated he was at the after-school program that day but had left before the incident happened with Child A. Mr. Cardimen stated staff Mahuya Das and Yucheng Shi were working that afternoon and there were about 25 children in attendance. Mr. Cardimen stated there were no previous concerns regarding the staff or Child A. I interviewed staff Yucheng Shi. She stated Child A is in kindergarten and this is his first year coming to the after-school program. Ms. Shi stated at the time of the incident, which was around 5:00pm, she and Ms. Das were outside with all the children, including Child A. Child A came up to her and stated he needed to use the bathroom. Several other children wanted to either get a drink of water or use the bathroom and came with her inside. Ms. Shi recalled taking a group of 8 children inside. Ms. Shi stated when they got inside, a few of the children, including Child A, went to use the bathrooms and the other children got a drink of water. Ms. Shi stated while inside 2 or 3 parents, including Child A's Father, arrived to pick up children. One child inside was having a "problem", so she was "occupied" by this. Ms. Shi stated when Child A's Father arrived, she "forgot" Child A had come inside to use the bathroom and she told Child A's Father that Child A was outside. Ms. Shi stated she, her group of children, and Child A's Father went outside. When they got outside, Ms. Das said that Child A was still inside. Ms. Das and Child A's Father went back inside and found Child A in the bathroom. Ms. Shi stated since this 3 incident happened, she only takes 1 or 2 children at a time inside for a "bathroom break".
