    On 3/30/23, I received a complaint stating that between 11:45 am and noon on 3/30/23, Child A was slapped, hit and pulled by her hair by other children in the room. This went on for about 15 minutes. The staff members in the room did not intervene and resolve the situation with the children. 2 On 3/31/23, I interviewed Child A's mother who said that she saw on the live feed camera from home that Child A was bullied by other children in the classroom. She took pictures of the same. Child A's mother said that she would send the pictures to me for review. For about 15 minutes between 11:45 and noon, the other children in the classroom were slapping, hitting and pulling Child A's hair, bothering Child A. Child A was crying and lying on the rug through the situation. Child A's mother said that she understands that children are playful and do not know better, but she was bothered that the staff members did not intervene and make sure that Child A was okay. Child A's mother stated that there were no scratches or any marks on Child A's body due to this incident and she did not have to take Child A for any medical evaluation. Child A's mother drove from her workplace to pick up Child A from the center. She wanted to remove Child A from the situation. She said that she was not happy with the way Child A was handled and felt that this happened because "Child A was discriminated against since was the only black child in the classroom." Child A's mother said that there were three staff members in the classroom, and she was not sure how many children were in the room. Child A's mother did not know the names of the staff members in the room. Child A's mother said that Child A was disenrolled by the center staff, who said that she was not a good fit for their program. When Child A's mother went into the center, she explained the incident to the staff member in the front office (she did not know the name) and instead of apologizing for what happened, the staff member said that she should not have taken pictures off the camera feed, and she was going to call the owner about it. Child A's mother went into the classroom to pick up Child A and told one of the staff members there, but none of them apologized for what happened. Child A's mother indicated that a couple of weeks ago, (did not know the date of the incident) Child A fell off a wagon and she received information regarding the same. She was not sure why her child fell off the wagon if there was appropriate supervision. Child A had a busted lip because of this incident but it did not require any medical attention. Child A's mother said that she got information from the center about Child A's fall and how it happened. On 4/3/23, I reviewed the pictures taken from the live camera feed by Child A's mother. In the thirteen pictures that were sent to me, Child A was lying on the floor in at least ten of the pictures. There were two or three children surrounding her and holding toys in their hands, looking at Child A and standing around her, dangling toys while she was lying on the floor, touching her hair while she was sitting on the rug, standing around while she had a blue basket on her face. The pictures did not confirm that children were hitting, kicking, hitting with toys or pulling Child A's hair. On 4/3/23, I conducted an unannounced onsite inspection at the center. I reviewed the attendance records for 3/30/23. There were ten toddlers in the classroom with 3 three staff members at the time of the incident The staff members working in the classroom were CCSM 2, CCSM 3 and CCSM 4. On 4/3/23, I interviewed CCSM 1 who stated that she was working in the office on 3/30/23 since the program director, Ms. Barlow was out sick for the week. At around 11:45 am, Child A's mother walked into the office and was very upset. Child A's mother stated that she was very upset that a child had slapped Child A and nobody had intervened to make sure that Child A was okay. She said that she was going to pick u

    On 02/08/2023 the complainant emailed me a picture of an electric outlet missing a safety cover. According to the complainant, the picture is of an outlet near the cubbies in the PreK classroom and the picture was taken the afternoon of 02/07/2023. On 02/10/2023 the complainant emailed me stating that the outlet near the cubbies in the PreK classroom remained uncovered on 02/08/2023, even though the director was aware of the concern on 02/06/2023. On 02/10/2023 I spoke with the complainant. The complainant believed all the outlets in the PreK classroom were now covered. On 02/10/2023 I completed an on-site inspection. I interviewed licensee designee Candice Sproat and program director Taylor McArthur regarding the allegation. Ms. Sproat stated the entire center is being painted, and last weekend the painters started in the PreK classroom. The painters took off all the outlet covers and did not put them back on after they finished painting. Ms. Sproat stated neither she nor Ms. McArthur knew this on Monday 02/06/2023 in the morning. Ms. Sproat stated that day was extremely busy; fourteen new families were starting and three staff called in for the day. She and Ms. McArthur were helping the new families and working in the classrooms filling in for the missing staff. Ms. McArthur stated she and Ms. Sproat were busy that morning with the new families and working in the classrooms. She did not know the covers were missing until later that day, and when she found out she had the covers put back on the outlets. Ms. McArthur stated she did not realize there was an outlet uncovered in the cubby area because a pair of child's snow pants were hanging in front of it. On 02/08/2023 a parent came into the office and told her the outlet in the cubby area was missing the cover and the cover was put back on immediately. I asked Ms. McArthur if there were any other covers missing in the other five classrooms. Ms. McArthur stated she had checked all the classrooms and the outlets were all covered. During my on-site inspection, I went through the six classrooms at the center. All the electric outlets had covers, including the outlet in the cubby area of the PreK classroom. I interviewed Staff 1, the lead caregiver for the PreK classroom. Staff 1 stated on Monday 02/06/2023 when she arrived in the morning the PreK children were 3 combined with the Preschool children in the Preschool classroom. Staff 1 stated before she brought the PreK children into the PreK classroom, she had to move things the painters had left in the PreK classroom. After moving the things out of the classroom, Staff 1 brought the PreK children into the classroom. Staff 1 saw that the outlets were not covered, and before lunch she put the covers back on the outlets. Staff 1 stated she did not notice the outlet in the cubby area because a child's coat was hanging over it. On 02/08/2023 Staff 1 was moving things in the cubby area and saw the outlet was missing its cover. Staff 1 asked Ms. Sproat for a screwdriver so she could put the cover back on the outlet. Ms. Sproat did not bring the screwdriver and Staff 1 got busy and forgot about it. On 02/08/2023 at pick up time a parent came into the room and pointed out the missing cover in the cubby area and the cover was put back on the outlet.

    On 10/07/2022 1 spoke with the complainant who stated staff in the infant room are not following the infants' daily schedules that parents provide related to times to feed infants and put infants down for naps. On 10/11/2022 I interviewed staff Brooke King. Ms. King stated she is the assistant director at the center and has been handling the director responsibilities while program director Taylor McArthur is on a temporary leave. Ms. King stated the staff that work in the infant room are lead caregiver Amy Irwin, assistant staff members Kaylee Weldon, Kimberly Achten, and Miranda Fuentes-Martinez, and floater Anna Alla. Ms. King stated the staff follow the infants' schedules as much as possible while also following the requirement to allow infants to eat and sleep on demand. Ms. King stated an infant's feeding may be a few minutes delayed if staff are busy caring for other children or if the infant is asleep. I interviewed staff Miranda Fuentes-Martinez. She stated she works Monday through Friday from 7:30am to between 3:00 to 6:00pm depending on staffing needs. She stated she has worked at the center since January 2022. Ms. Fuentes-Martinez stated she works primarily in the infant room and occasionally in a toddler room. She and the other infant staff feed the children "on time" based on the schedule the parents provide. Ms. Fuentes-Martinez stated she has never missed or skipped feeding an infant a bottle or food. Ms. Fuentes-Martinez stated staff allow infants to nap on demand, but they try to keep to an infant's schedule. Staff may be a few minutes late in trying to get an infant to nap if they are busy feeding or diapering another infant. I interviewed staff Anna Alla. She stated she started working at the center in July 2022. She works Monday through Friday and usually covers staff breaks in the infant room for two or three hours during the middle of the day. Ms. Alla stated she feeds infants according to their schedules. She has not skipped or delayed feeding an infant a bottle or food. Ms. Alla stated she always tries to keep an infant's nap schedule and has not forgotten to try to get an infant to nap if it is the time an infant typically naps. I interviewed staff Kimberly Achten. She stated she started working at the center in August 2022. She works in the infant room Monday through Friday from 8:00am to 5:00 or 6:00pm. She is not aware of any time a staff have missed or delayed feeding an infant. Ms. Achten stated sometimes Child D falls asleep before finishing a feeding, but as soon as Child D wakes up, staff will give Child D food or a new 3 bottle. Staff also try to follow the schedule the parents provide for a child's nap time, but sometimes an infant will not nap or wants to nap at a different time. I interviewed staff Kaylee Weldon. She started working at the center in September 2020 and works in the infant room Monday through Friday usually from 8:00am to 6:00pm. Ms. Weldon stated she and the other staff feed the infants on demand and try to follow the parent's requests. Ms. Weldon stated she has never missed a scheduled feeding for an infant. Ms. Weldon stated she always tries to follow the infant's nap schedule, but sometimes an infant does not fall asleep at the scheduled time or falls asleep at a different time. During the on-site inspection I observed staff Ms. Fuentes-Martinez, Ms. Alla, Ms. Achten, and Ms. Weldon caring for the children in the infant room. I observed several infants sleeping in cribs, several infants playing on the carpet with staff interacting with them, and a staff feeding a bottle to an infant. All the staff were interacting in a positive manner with the children. On 10/13/2022 I interviewed lead caregiver Amy Irwin. She stated she has worked at the center since 2019 and works Monday through Friday from 7:30am to around 5:00pm.     The complainant stated on either 09/27/2022 or 09/29/2022 before 8:00am there was 1 staff to 6 or 7 infants; on 10/04/2022 there were 2 staff to 9 infants in the afternoon; and on 10/06/2022 around 2:00pm there were 2 staff to 9 or 10 infants. On 10/11/2022 during my on-site inspection, the infant room was in ratio with 3 staff Kimberly Achten, Miranda Fuentes-Martinez, and Anna Alla to 11 infants. Ms. King stated the infant room and all the rooms at the center maintain the required ratios. She is not aware of any issues with this. Ms. King stated in the mornings as children arrive staff call the office if another staff is needed in the room to maintain ratio and another staff is sent to the room. Ms. King stated sometimes a parent will drop a child off earlier than scheduled and she or a floater staff will go into the room until the scheduled staff arrive. Ms. King stated there is always staff working in the office or other areas of the center that are available to maintain ratio in all the rooms. Ms. Fuentes-Martinez stated the infant room has always been in ratio. She stated in the mornings if she is the only staff in the infant room and a fifth child arrives, she calls the office, and a second staff comes in to maintain ratio. Ms. Fuentes-Martinez stated there has never been a time when there is 1 staff to 6 or 7 infants. Ms. Alla stated the infant room is always in ratio of 1 staff to 4 children. Ms. Achten stated the infant staff always keep the ratio consistent for safety reasons. If another staff is needed to keep the ratio of 1 to 4 staff will call the office and another staff comes in the room. Ms. Achten stated there has never been a time where the infant room is not in ratio. Ms. Weldon stated ratio is maintained in the infant room . If she is the first staff working in the infant room in the mornings and a fifth child arrives, she will call to the office and a second staff is sent to the room. Ms. Weldon stated the center has cameras in the rooms, so if someone is looking through the camera, they might not be able to see the second staff if the staff is not in the camera view. Ms. Irwin stated the infant room is always in ratio. Ms. Irwin stated in the mornings at drop off time when a fifth child arrives, a second staff member comes into the room. Ms. Irwin stated a few weeks ago there was one morning, she could not recall the exact date, when a fifth child arrived and a child who was transitioning to the toddler room got moved over to the toddler room, so a 1 to 4 ratio was maintained in the A infant room. Ms. Irwin stated on 09/22/2022 they had a donut breakfast with the parents and there were 7 or 8 infants present. She was caring for 3 infants and there were 4 or 5 infants with their parents. Once the parents left, there were 2 staff in the room to maintain the 1 to 4 ratio. She stated perhaps that morning someone thought they were not maintaining the required ratio, but parents were present caring for their infants. Ms. Sproat stated she is not aware of any time the infant room or any room in the center has not maintained the required ratio. Staff know to call the office staff if another staff is needed in the room and there has always been another staff available to cover ratio. Ms. Sproat stated perhaps a parent thought the room was not in ratio during the donut breakfast with parents, when parents were there caring for their own infants. Ms. Sproat stated they have cameras in each of the rooms which allows parents to view live feed and there could be times that a staff is positioned in an area of the room not seen on the camera angle. Child B's Mother stated she thinks a few times in the past few months the infant room may not have maintained a ratio of 1 to 4 where there was 1 staff to 6 or 7 infants, or 2 staff to 9 or 10 infants. Child B's Mother did not have dates of when this may have occurred. Child C's Mother stated she has always seen the infant room in ratio. I requested Ms. Sproat send me copies

    On 09/28/2022 I received a phone call from licensee designee Candice Sproat regarding the complaint allegation. She stated she had reviewed video footage of the incident. Ms. Sproat stated during the afternoon of 09/27/2022 there were 3 staff; Heather Turner, Veranika Nicaj, and Oliva Bolin with 12 toddlers in the Toddler 2 classroom. The staff had the children line up near the door to get ready to go outside. Staff completed a name to face count of the children, and as this was taking place, one child spilled some sunscreen on herself, so Ms. Nicaj took this child over to the classroom sink to clean it up. Ms. Turner also realized that three children who are potty training had not gone to the bathroom, so Ms. Turner took the three children to the bathroom. Ms. Bolin was left standing with 8 toddlers who were waiting to go outside. While waiting Child A left the group. Child A wandered behind a shelf into the classroom. Ms. Turner and Ms. Nicaj returned to the group with their children. Staff did not do another name to face count of the children as required, and they did not realize Child A was no longer in line with the other children. The class went outside to the playground, and about a minute after the class left the classroom, a parent, who was looking at the live camera feed, saw Child A alone in the classroom and this parent called the center. Staff Morgan Button was in the office and answered the phone and immediately went and got Child A from the Toddler 2 classroom. Ms. Nicaj realized Child A was not outside as she had started taking pictures of the children and could not find Child A to take Child A's picture. All the Toddler 2 staff started searching the playground and then Ms. Turner came inside the building and discovered that Child A was with Ms. Button. Ms. Sproat stated Child A was alone in the Toddler 2 classroom for a minute. Ms. Sproat also emailed me a written incident report. On 10/05/2022 I completed an on-site inspection to the center and interviewed staff Heather Turner. Ms. Turner stated she has worked at the center for 2 years as the lead caregiver in the Toddler 2 classroom. Ms. Turner stated Child A has been enrolled with the center since he was an infant and Child A has been in the Toddler 2 class for a month. On 09/27/2022 Ms. Turner was working with Niki (Verankia Nicaj) and Olivia (Bolin). Ms. Turner stated Ms. Nicaj always works with her in the Toddler 2 classroom and Ms. Bolin usually works in the Toddler 1 classroom and works in the Toddler 2 classroom about once a week. Ms. Turner stated right before the incident happened with Child A, the children had got up from nap time and were getting ready to go outside. She, Ms. Nicaj and Ms. Bolin were cleaning up the tables and getting the children ready. Ms. Turner then remembered three of the children, who are potty training, had not used the bathroom, so she took them to the bathroom. When she and the three children returned to the group, Ms. Bolin was sitting on the floor with the children. Ms. Nicaj said a child had got hold of a bottle of sunscreen that was in the child's bag, so Ms. Nicaj took this child to a sink to clean up. Ms. Turner noticed 3 that the children were getting restless, so as soon as Ms. Nicaj came back from the sink, they ushered the children outside. Ms. Turner stated she failed to do another name to face count. Ms. Turner stated she had done a name to face count when they initially lined up and they are supposed to do three name to face counts when going outside; one when they line up, a second when they get out in the hallway, and third when they get outside. Ms. Turner stated neither she nor the other staff did a count in the hallway or outside. Ms. Turner did not know that Child A had wandered back into the classroom play area. When they got outside, Ms. Nicaj started taking pictures of the children and could not find Child A. She and all the staff started searching the playground for Child A. Ms. Turner called inside
