On 03/23/2023 licensee designee Candice Sproat left a voicemail message about the incident. On 03/27/2023 I completed an on-site inspection to the center. I interviewed program director Jenna Brackett. She stated on 03/22/203 the PreK classroom was getting ready to go outside in the morning. Staff 1, who works daily in the PreK classroom, and Staff 2, who is a floater and has worked a few times in the PreK classroom, were working in the classroom at the time. Staff 2 was covering for Staff 3 who was on break. Staff 2 took a group of children outside while Staff 1 was finishing getting the rest of the children ready in the hallway to go outside. One of these children began to scream, and Staff 1 was trying to calm the child down. Staff 4, who works in the office and also as a substitute staff, heard the child screaming 2 and went to help Staff 1. Staff 4 saw Child E looking out the window from inside the PreK classroom. I interviewed Staff 1. She stated she has been working at the center since December 2022 and is an assistant staff member in the PreK classroom. On 03/22/2023 Staff 3 was on lunch break, so Staff 2 was working with her in the classroom. Staff 1 does not remember exactly how many children were present but thinks there were about twenty PreK children ages 4 and 5 years old. Staff 1 stated they were getting ready to go outside. Staff 1 was taking children out to the hallway to put on their coats. Staff 2 was in the classroom setting up cots with the children for nap time. One of the children in the hallway started screaming, and Staff 1 was trying to calm this child down. Staff 2 came out of the classroom with the children. Staff 2 turned the lights out in the classroom and closed the classroom door. Staff 2 took a group of the children outside. When Staff 2 got to the playground and did a name to face count, Staff 2 realized she had thirteen children, so she sent one child back to Staff 1 in order to stay in ratio. Staff 2 was still trying to calm the screaming child down and get the rest of the children ready to go outside. Staff 4 came from down the hall to help with the screaming child. Staff 1 went into the PreK classroom to get her coat and came back out to the hallway. Staff 1 did not see any children in the classroom, but a minute or so later, Staff 4 saw Child E looking out through the PreK classroom window. Staff 1 stated Staff 2 did not know Child E had gone in to use the bathroom in the PreK classroom while the class was getting ready. Staff 1 stated Child E was probably in the bathroom and classroom for about 5 minutes after Staff 2 had left the classroom. Staff 1 stated staff do a name to face count with the children when they go outside, and she was just about to do that on her tablet with her group of children when Staff 4 saw Child E in the classroom. Staff 1 stated she would have seen on the electronic attendance record that Child E was not outside with Staff 2. Staff 1 stated when she is the last staff to leave the classroom, she looks around the classroom, and in the bathroom, to make sure there are no children hiding before she turns off the lights and closes the door. Staff 1 thought Staff 2 had done that, but Staff 2 had not looked in the bathroom where Child E was located. Staff 2 stated since the incident they have changed their procedure and are now having all the children line up in the classroom and complete the name to face attendance and then go outside as one group. I interviewed Staff 2. She stated she has worked at the center for a month and works as a floater in the preschool classrooms. On 03/22/2023 she was working in the PreK classroom when Staff 3 took a break. The class was getting ready to go outside. Staff 1 was in the hallway helping children get their bedding and coats, and Staff 2 was in the classroom helping children set up their cots. On 02/06/2023 program director Jenna Brackett left a voicemail message regarding the incident involving Child D. On 02/08/2023 Ms. Brackett emailed Licensing the incident report which documents on 02/06/2023 in the Young Preschool classroom, apple cinnamon bars were served for morning snack. The item was not listed on Child D's safe or not safe list and staff thought the breakfast bar was the same as a Nutri-grain bar. Staff 1 changed Child D's diaper after lunch and noticed Child D was itchy and there was a rash all over Child D's torso. Staff 1 contacted Jenna Brackett in the office, and Ms. Brackett was determined Child D was having an allergic reaction. Child D's parents were immediately contacted by Ms. Brackett, and they came and picked Child D up and took Child D to the emergency room where Child D was administered an epinephrine pen. On 02/10/2023 I spoke with licensee designee Candice Sproat regarding the incident. Ms. Sproat stated Child D has allergies to peanuts and eggs, and this information is listed on Child D's information card and on a sign posted in the classroom. When staff went and purchased food for the center, the store was out of Nutri-grain bars, so BeneFit bars were bought instead. Child D can eat Nutri-grain bars because they do not contain peanuts or eggs; however, it was discovered after this incident that BeneFit bars contain eggs. Ms. Sproat stated Nutri-grain bars are listed as a "safe" food on the sign posted in the classroom for Child D. Staff 2 assumed the breakfast bars were the same and did not check the label of the BeneFit bars. When Staff 1 changed Child D's diaper at lunch time, Staff 1 saw the rash on Child D's body and called to the office and informed program director Jenna Brackett. Ms. Brackett knew the first sign of an allergic reaction is a rash, so she called Child D's parents and they came and picked up Child D right away. Ms. Sproat stated all the staff at the center were retrained about allergies and the staff is now labeling each day what Child D can eat and not eat. Ms. Sproat sent me copies of Child D's information card, Child D's daily record from 02/06/2023, and email correspondence with Child D's Mother on 02/06/2023 and 02/07/2023. Child D's information card lists allergies to eggs and peanuts. Child D's daily record from 02/06/2023 documents Child D had a diaper change at 9:45am. Child D then ate a morning snack, which was an apple cinnamon bar and tropical fruit mix cup. Child D ate lunch at 11:59am, which consisted of hummus and turkey wrap, mango, and corn. On 02/15/2023 I spoke with Child D's Mother regarding the incident. She stated Child D has attended the program since July 2022. She stated Child D has allergies to eggs and peanuts. She provides some food for Child D to eat when the center is serving food with eggs in them. The center usually provides Child D the morning snack, and up until the incident on 02/06/2023 there had not been an issue. Child D's Mother stated she was told by Ms. Sproat that the center had recently switched snacks, and the staff did not realize the new breakfast bar contained egg. Child D's Mother stated she was contacted around noon on 02/06/2023 by the staff and told 4 Child D had hives. Child D's Father immediately went to the center and picked up Child D and brought Child D home. At home they gave Child D Benadryl; however, Child D's allergic reaction was progressing, so they took Child D to the emergency room where an epinephrine pen was given. Child D's Mother stated since the incident, she has spoken with Ms. Sproat who assured her that staff have been retrained and additional signs have been posted in the classroom to alert all staff to Child D's allergies. On 02/15/2023 I completed an on-site inspection to the center. I interviewed program director Jenna Brackett regarding the incident. She stated the morning of 02/06/2023 the staff that usually works in the Young Preschool room were not working, and two floaters, Staff 1 and S

On 07/13/2022 Ms. Amare stated that she did not receive a phone call within 24 hours or an incident report within 72 hours from the center when Child A was left alone in the infant classroom during the fire drill. 2 On 07/13/2022 Ms. Brackett and Ms. Scarchilli stated that Ms. Sproat was informed via email that the fire system was going to be tested in the strip mall on Monday 07/11/2022 where the center is located. Ms. Keydel, the HR director, informed them about the fire drill but not the exact time. I asked to review the video of the incident and Ms. Brackett stated that she was not sure if the video was storing the recording; she only knew how to review the video for the current day. She would check into this, and if she was able to retreive the video she would send it, and I did not receive the video. They did not inform the department within 24 hours or submit the written report within 72 hours after Child A was left alone. Ms. Brackett was not present at the center at the time the fire drill was completed. She was not informed that Child A was left in the classroom until Child A's Mother informed her at 2:00 pm when Child A's Mother was leaving work. Ms. Brackett was not sure why no one at the center informed her when she arrived to work at 9:00 am. Ms. Brackett was upset that Child A was left in the classroom during the fire drill. Child A's Mother was upset because she did not think that the incident was being taken seriously by anyone at the center. Ms. Brackett watched the video with Child A's Mother, and the fire drill was conducted at 8:12 am or 8:13 am and she spoke with Ms. Keydel and Ms. Scarchilli. Ms. Scarchilli stated that Child A was left in the classroom and when Ms. Brandon informed her about Child A being in the classroom, she retrieved Child A from the infant classroom, took him outside, and gave him to Ms. Brandon. Ms. Keydel stated that she asked Ms. Brandon how many children were present, and she said five during the fire drill which was why she thought all of the children were in the two emergency cribs during the fire drill. Ms. Brandon was removed from the classroom because she was not aware of the number of children that were present in the classroom when she told Ms. Keydel that there were five children when there were six children in the classroom. She does not train the staff on the primary caregiver roles. Ms. Scarchilli stated that when the fire alarm went off, she was in the kitchen, and she went into the infant classroom to help transport the children outside. When she went into the infant classroom, she put the children in the emergency cribs. She was not sure the number of children that she placed in the cribs. Before the children and staff went outside, she returned to the office to get the emergency binder that they use during fire drills. Then she began her required sweep of the classrooms. As she was completing the sweep and exiting the center, Ms. Brandon informed her that Child A was still in the infant classroom. She returned to the center and retrieved Child A from the infant classroom. Child A was on his back playing with a toy in the play yard. The play yard is located in the middle of the classroom against the wall. It was maybe 3-4 minutes before she retrieved Child A from the classroom. 3 Ms. Scarchilli stated that Ms. Keydel and Ms. Brackett spoke to the infant lead caregiver Ms. Schmiel, and she was written up. They had not spoken with Ms. Brandon because she did not work on Tuesdays, and they had not had an opportunity to speak with her before she left work on 07/13/2022. Ms. Scarchilli stated that the lead caregivers are responsible for the full-time children and the child care staff members are responsible for the part-time children. The primary caregivers are assigned on the paper that is posted in the classroom, but all of the staff help to take care of the children. Child A's Mother stated that Monday morning the center was informed that there would be a fire drill.
