    R 400.8170 · R 400.8170 Outdoor play area. (13) All pieces of playground equipment that have an elevated playing or climbing surface, regardless of the height of the playing or climbing surface, must be surrounded by a shock absorbing surface and meet the guidelines defined by the Consumer Product Safety Commission (CPSC) Handbook for Public Playground Safety, which is available at no cost at www.cpsc.gov. This handbook is also available for inspection, and distribution at no cost, at the Michigan Department of Licensing and Regulatory Affairs, Bureau of Community and Health Systems, Child Care Division, 611 West Ottawa Street, Lansing, MI 48933. The shock absorbing surface material may be either unitary or the loose-fill type. An exception to this subrule is provided for natural playgrounds.

    On 08/03/2023, Ms. Hollis called me to report the allegation that Child A fell off the playground equipment and broke her collar bone. On 08/04/2023, Ms. Hollis emailed me the incident report and a picture of the playground equipment surrounded by wood chips. The picture showed that the elevated playground equipment that Child A fell from was not surrounded by a shock absorbing surface that meets the minimum depth defined by the CPSC Handbook for Public Playground Safety. The picture showed sections of the playground area with exposed dirt. The minimum depths of the shock absorbing surface are shown below in the table: On 08/08/2023, I attempted to complete an unannounced on-site inspection at the center. No child care staff members or children were present at the center. I could not gain access to observe the playground equipment due to the outdoor play area being fenced and a lock on the gate. On 08/08/2023, I interviewed Ms. Hollis via telephone. She stated the summer camp for the school-agers ended on 08/04/2023. She was not aware if the playground equipment had the minimum depth of shock absorbing surface defined by the CPCS Handbook for Public Playground Safety. On 08/08/2023, 08/25/2023, and 09/12/2023, I left voicemail messages for Child A’s Mother requesting a returned telephone call. She did not return my telephone calls. On 08/08/2023, I interviewed Child Care Staff Member. She stated while the children were outside playing, she was walking round the playground. When she walked towards the playground equipment that Child A was climbing, she saw Child A fall to the ground from the third or fourth step. Child A was the only child on the playground equipment, 3 and she does not know how she fell. Child A cried when she moved her arm. She applied ice to her arm and Child A’s Mother was called. Child A’s Mother took her to the hospital, and she was diagnosed with a broken collar bone.
