On 04/25/2023, the email provided by the complainant did not work and I was not able to obtain any additional information. On 05/03/2023 Ms. Durkin stated that the preschool class has children ages 2 -3 1/2 and the CCSM to child ratio is 1 to 8 with the maximum group size of 16. There '/2 are not children under the age of 2 in the class and nothing out of the ordinary has 1/2 happened in the classroom. No children have been injured due to lack of supervision because the CCSM's provide proper supervision of the children. 2 CCSM A stated that the class is not out of ratio and children under 2 are not in the 1/2 preschool class. The children are not hurting each other, the CCSMs are always supervising the children and there have been no serious injuries. CCSM B stated that, depending on the day, she works in the preschool classroom. She has not observed children getting hurt. They are being supervised and the CCSMs do a good job of watching them. Children under the age of 2 are not in '/2 the preschool class, and the class is not out of ratio. Ms. Durkin makes sure that the classrooms are maintaining the correct CCSM to child ratio. CCSM C classroom is in the same space as the preschool classroom divided by low shelving. She stated that the class is not out of ratio and children under 2 are not 1/2 in the preschool class. The children are not hurting each other, the CCSMs are always supervising the children and there have been no serious injuries. On 05/03/2023, I observed ten children with two CCSMs in the preschool classroom. The preschool and pre-k classrooms share the same space divided by low equipment. There were ten children present in a space that measured 24.7 x 11.2, which equals 277 square ft. for a total 8 preschool children. The center did not maintain the required 35 square feet per child in the preschool classroom with ten children in a space allotted for eight children. Ms. Durkin stated that the preschool and the pre-k have been divided for years and she did not realize that the space was not large enough for more than eight children. I observed the preschool classroom from 10:00 am- 10:21 am, and I did not observe the children hurting each other in any way. I reviewed the daily attendance for 05/03/2023, and all of the children present, were over 2 There were eleven 1/2. children signed in at 10:00 am and ten were present in the class. One child was moved to another classroom at 8:30 am.

The preschool class did not maintain accurate daily attendance with eleven children signed in and ten children present. There were ten children present in the preschool classroom that has 277 square feet for a total of eight children. Ms. Durkin acknowledged that the preschool area was not large enough for the ten children that were present on 05/03/2023.

On 07/25/2022, 1 spoke with the complainant. The complainant was concerned that the child care center's air conditioning was not functioning and the temperature in the child care center had exceeded 90 degrees Fahrenheit on 2 Tuesday, 07/19/2022. On Wednesday, 07/20/2022 the child care center closed around 3:00 PM when the center normally closes at 6:30 PM; the center had reached 85 degrees Fahrenheit. The thermostat is in the pre-k room. The complainant shared that the infant room, which is in the front of the child care center, was the hottest room in the center due to the wall of windows. The complainant was concerned that the center continued to operate while children and staff were uncomfortable due to the excessive temperature and no way to circulate air. On 08/03/2022, I completed an unannounced inspection at the child care center. I spoke with program director and licensee designee, Anna Durkin. When I informed Ms. Durkin of the allegations, she confirmed that the air conditioning was not working properly, and that the child care center closed on 07/20/2022 due to the rising temperature in the center. There had been some issues with the air conditioning this summer, however, the child care center was typically comfortable. On 07/19/2022, the air conditioning was working in the morning but stopped working by the evening. The temperature in the building was comfortable at first but began to rise sometime after the air conditioning stopped working. Ms. Durkin could not recall the temperature in the building that day. A heating, ventilation, and air conditioning (HVAC) company was contacted by the owner of the building and the coils were cleaned, and the filters were replaced on the units. The air conditioning began working and then stopped. On 07/20/2022, the air conditioning was not working properly and the temperature in the child care center was 82 degrees Fahrenheit. Notification was sent to the parents, updating them on the status of the air conditioning, stating that it was becoming very warm and uncomfortable for the children in the center even with one functioning air conditioning unit. The notification stated that even though it was beginning to cool off slightly, they were closing the center early. They were working on getting one of the air conditioning units replaced and had one portable air conditioner in the center. Parents were asked if they had any bladeless fans or portable air conditioners they could donate; the center would be appreciative. Children were picked up and the center closed at 1:00 PM. Ms. Durkin provided me a copy of the notification that was sent to the families. On 07/21/2022, the center was open. Portable air conditioners and bladeless fans were brought in to cool the rooms by maintenance staff. On 07/21/2022, a second HVAC company sent by the maintenance staff at Beth's Imagination Station to assess the air conditioning was able to fix the issue with the unit that was not working, and the air conditioning was working. On 07/22/2022, the HVAC company resolved the final issues with the air conditioning units and the air conditioning has been working ever since. Ms. Durkin shared that some parents complained about the heat when they were notified about 3 the center's closing, while other parents thought it was no big deal. No parents have complained about the heat before the early closure on 7/20/2022. On 08/03/2022, I spoke with child care staff member, Leia Imlay. Ms. Imlay has been working at the center for four years and was helping in the infant room. She typically works in the young preschool room. Ms. Imlay shared that it is usually cold in the building, and she brings a sweatshirt to work because she gets cold. She stated there were 2 or 3 days when it was hot but couldn't recall the exact days or the actual temperature. Ms. Imlay was not working the day the child care center closed early. No parents have complained to her about the heat. The temperature in the room was 71 degrees
