On 03/23/2023, I interviewed Child A's Mother by telephone. Child A's Mother stated she was told by Witness 1 that she overheard Child care staff member 1 tell the children to "stop doing that or I'm going to spray you with the water bottle." Child A's Mother decided to ask Child A about the use of the spray bottle in the classroom. Child A told her that when the kids are "bad" Child care staff member 1 sprays the kids. Child A's Mother was not really sure Child A is always accurate with information, but Child A stayed consistent with her story. Child A initially told her that she was not sprayed but then later stated she was by Child care staff member 1. She has never had any issues with Child care staff member 1 as Child A been in attendance in the program since 2022. Child A's Mother gave verbal permission for me to interview Child A at the center. On 03/29/2023, I completed an onsite investigation and interviewed Mrs. Ashley Wybrecht-Borkowski, program director, Child care staff member 1 and Child care staff member 2. Mrs. Wybrecht-Borkowski stated she has worked with both Child care staff member 1 and Child care staff member 2 and has not had any concerns with how Child care staff member 1 and Child care staff member 2 interact with the children in the classroom. She has not witnessed any of the staff use a water spray bottle to discipline children. None of the children have reported to her this was done 3 to them especially Child A. The only water bottles are used for the 3 steps cleaning process for tables and equipment. I interviewed Child care staff member 1 on 03/29/2023. Child care staff member 1 stated Child A was recently absent from the center for several days before returning. She has observed changes in Child A's behavior due to some changes that have occurred at home. She has not had problems previously with Child A and did not know where this allegation was coming from. Child A is usually a happy child in the classroom. She has never used a water bottle to discipline any of the children in the classroom. Child care staff member 1 has never threatened to use a spray bottle on any of the children. On 03/29/2023, I interviewed Child care staff member 2. Child care staff member 2 stated she has never used a spray bottle to harm any children and has not observed any of the staff use a spray bottle to discipline. The only time spray bottles are used when they are cleaning and sanitizing the tables before/after meals. There have not been concerns brought to her about this issue until now. I attempted to interview Child A on 03/29/203, but Child A would not talk to me or answer any questions. On 04/05/2023, I interviewed Witness 1 by telephone. Witness 1 stated they happened to be in the classroom next door to the head start program. The desk was situated close to the door and Witness 1 could hear voices in the head start room. The date given for the incident was March 20, 2023. Witness 1 heard Child care staff member 1 state, "if you kids don't cut it out, I'm going to spray you with the spray bottle." Witness 1 is well aware of Child care staff member 1 voice. Witness 1 was able to speak with Child A about this matter. Child A told Witness 1 that her "friend" had been sprayed when they are bad by Child care staff member 1. On 04/12/2023, I interviewed Child care staff member 1 by telephone. Child care staff member 1 as a follow-up. Child care staff member 1 stated she has never made that statement to any of the children in the classroom. The only time she would use water on children is at the end of the school year when they have water day. There is no one in the classroom using a spray bottle on the children. She does not know how someone would have heard her because she did not say anything. On 04/19/2023, I interviewed Child B and Child C's Mother by telephone. Child B and Child C's Mother stated she currently have two children in the classroom. Child B and Child C would have told her if something was wrong of s

On 03/01/2023, I spoke with Complainant by telephone. Complainant stated Child A was able to get out of the room without child care staff members being aware. Child A was out of the room for approximately 5 minutes before being found on the playground. On 03/02/2023, I completed an unannounced onsite at the center. I interviewed Ms. Leslie Merrit and Ms. Ann Khoury, child care staff members. Ms. Merrit stated on 03/01/2023, there were 11 children in the classroom as they headed to playground and two child care staff members (Ms. Merrit and Ms. Khoury). Their playground ground time is from 11:00 a.m.-11:19 a.m.; they line-up as they return to class, complete name to face, count before entering the school, complete once again as they enter the classroom, with a child care staff member located at the front of the line and back of the line as children are walking. All children were accounted for when they entered, Child A was in the middle of the line. It was preparation time for lunch, children were putting their outerwear away in their cubicles. Children were directed to the carpet area and music was turned on for dance and movement. She took one of the children with her to get lunch and left the room at approximately 11:22 a.m., leaving Ms. Khoury and 10 children in the classroom. Once she returned about four-five minutes later, as she entered the classroom, she noticed Child A was not in the classroom, looked at Child A's cubicle and noticed Child A's coat was not in the cubicle. She headed back out the door towards the playground which is where she located Child A outside on the playground, by the door. Child A told her she wanted to find "more friends" to play with. She brought Child A back into the room, contacted Ms. Spalteholz and Child A's Mother initially by telephone and then through the center's Remind application for contact with Child A's Mother. Child A recently returned to school after being gone for about two weeks and due to a scheduled home visit meeting with Child A's Mother was being held on the same day; she would further discuss the incident with Child A's Mother at the meeting. Child A was unsupervised for about five minutes. I interviewed Ms. Khoury. Ms. Khoury stated she worked in the head start program for about eight years. There were 11 children in the classroom on 03/01/2023. There were no problems while they were on the playground, they returned to the classroom completing a headcount, name to face, and there was a child care staff member at the front and back of the line of children to walk the children into the classroom. She and Ms. Merrit had the children to place their outerwear into their cubicles for movement and music. Ms. Merrit left with one of the children to pick-up lunch. There was another child who tripped on a cot and hurt herself. She was consoling the hurt 3 child and did not observe when Child A left the room. It was only when Ms. Merrit returned and realized Child A was not in the room. She located Child A outside on the playground where the kindergarten children were playing. Child A was brought back in, she did not appear to be upset. She has never lost a child she was responsible for in the 40 years she been working in child care. There are changes that will made immediately, she will now be responsible for getting the lunch for the children while Ms. Merrit remains in the room, a different alarm (louder) will be placed on the door and Child A will always hold a child care staff member's hand while transitioning from the classroom. On 03/02/2023, I observed Child A in the classroom with the other children. On 03/02/2023, I received an email from Ms. Spalteholz, with a copy of the incident report. The incident report dated 03/02/2023, stated, "When the class returned to the classroom from outside, all of the children were accounted for.
