On 04/10/2025 CCSM1 and CCSM2 provided appropriate supervision of Child A. They were unable to prevent a child from pushing Child A causing a broken clavicle.

I first attempted an onsite on 12/10/2021. Nobody was present at the center. I called Child A's Mother and left a message asking for a return phone call. I conducted an unannounced inspection on 12/15/2021. I spoke with program director, April Sawyer. She stated that on 12/7/2021, there were two CCSMs, Mercedes Motley and Rima Halwani, and six children in the gym. One of the CCSMs noticed a mark underneath the strap to Child A's face mask. Child A had not cried or yelled out and did not seem in distress when they noticed the mark. When asked what happened, Child A replied "car". Ms. Sawyer stated that Child 2 A's Mother was notified of the mark at pick up that day. She left the center and returned, upset, because none of the CCSMs knew how it happened. When she returned home and spoke to Child A, he told her another child hit him with a car. Ms. Sawyer stated that the incident report was completed and presented to Child A's Mother on 12/8/2021, but she did not want to sign it. Child A is still enrolled in the center and there has been no more conversations about it. I observed the gym. The gym is the hall, or overflow room, of the church. I saw riding tricycles and two cozy coup cars. I observed Child A inside of Room 4. He was not wearing a face mask and I did not see any marks on his face. I spoke with CCSM, Mercedes Motley. She stated that on 12/7/2021, she and CCSM,Rima Halwani had six children in the gym. At the end of gym time, she became aware of a scratch on Child A's face. She stated it was hard to see because the scratch was located under Child A's mask. Ms. Motley stated she was near all six children at all times and did not see Child A fall or get hurt, but noted he is one to ram his car or bike into things, so it is possible that he scratched himself at that time. Ms. Motley was going on break at that time and CCSM, Julie Hourigan, was just coming back from break so Ms. Hourigan gave Child A an ice pack and asked him what happened. Child A said "car". Ms. Motley stated that throughout the day the scratch became darker and looked more like a bruise. Child A's Mother was notified at pick up and took Child A home. She came back that same day and said the bruise went up behind Child A's ear, but she did not think it was from his mask. Child A's Mother called the scratch a "gash" at that time. Ms. Motley stated it was not a "gash" and there was no blood. I spoke with CCSM, Julie Hourigan. She stated that when she returned from her lunch break on 12/7/2021, the other two CCSMs were just leaving the gym and told her Child A got a scratch, but they were unsure how it happened. The scratch was directly under Child A's mask strap. Child A was not crying and did not appear to be in any pain. Ms. Hourigan offered Child A an ice pack, but he said "no". Ms. Hourigan asked what happened and Child A said "car". Ms. Hourigan explained that Child A is not very verbal so she could not get more information from him. Ms. Hourigan is aware there are cars and bikes in the gym where he was playing. Ms. Hourigan stated the scratched did get a little raised throughout the day and they notified Child A's Mother at the time of pick up. Child A's Mother was upset because she felt lied to about how Child A got the scratch, but really everyone was just trying to come up with their best guess as to how it happened since they did not see it and Child A could not tell them. I spoke with CCSM, Rima Halwani. Ms. Halwani stated that while in the gym on 12/7/2021, Child A was on the scooter and rammed into another child. Neither child acted hurt or cried and they did not fall. Ms. Halwani was near all six children during gym time, and nobody appeared to get hurt during that time. When gym was done, 3 the children went to the restroom and Child A took his mask down. This is when Ms. Halwani raw a red mark on his cheek. She stated she would not have seen it if Child A had kept his mask up. Ms. Halwani told Ms. Hourigan, who was just coming back from lun
