On 05/16/2023 I conducted an onsite inspection at the center. The owner, Marquita Walker, offered a tour of the buildings including all approved areas. She said the second floor was approved for child use a few years ago. The second floor is not in use due to low enrollment and staffing. She said no children go to the second floor as it is not set up for use. The four upper rooms were viewed and photographed. The rooms were not fully set up and most were filled with storage and not set up with equipment. The rest of the center that was in use was viewed as appropriate for child use. While at the center I interviewed her CCSM1. He stated the center is not in ill repair and denied they are using space not approved by the department. He added they are planning to clean up the 2nd floor in the upcoming months to prepare it for use. On 06/10/2023, I reviewed prior renewal inspection reports authored by the licensing consultant, Erica Hogan. The renewal inspection report dated 01/06/2022 2 documented that the first and second floor are approved for child use adding that the second floor is not in use at this time. On 06/10/2023, I held an exit conference with Mrs. Walker over the phone. I told her I verified that the second floor was previously approved. There were additional allegations that were previously investigated in report 2022D0911019. Prior allegations include that CCSM 1 is a felon and is working in the building, corporal punishment is used on the children and that child care staff members are smoking marijuana in the facility. It was also alleged that the gymnasium smells of sewage and that the blue room is flooded, There was no change in the status of the license following this investigation. On 06/13/2023, a checked of the child care background check system showed all staff working at the center, including CCSM 1 have been determined to be eligible to care for children. The facility was observed to be clean and in good repair.

On 01/17/2023, I completed a telephone interview with the complainant. The complainant was informed that Child A had bruising on his arm by Child A's Mother. Child A's Mother informed the complainant that the bruising occurred while Child A was in child care. The complainant was not able to disclose any further information. On 01/17/2023, I completed a telephone interview with Child A's Mother. She said on 01/05/2023 she received a call from Witness 1 informing her that Child A had bruising on his arm. Witness 1 picked Child A up from Rainbow Village Childcare on 01/05/2023 at 1:30 p.m. to trans ort him to where he receive Witness as een working with Child or the past year and ic s him up from school or child care for services. Child A had been attending Rainbow Village Childcare while he was out for winter break from school. Child A started attending Rainbow Village Childcare on 01/02/2023 and stopped on 01/05/2023. When Witness 1 arrived at with Child A and took his jacket off he noticed bruising on Child A's arm. When Witness 1 called Child A's Mother and informed her of the bruising, she said she assumed it was something that Child A 3 had inflicted on himself. Witness I sent her pictures and that is when she realized this could not have been self-inflicted. Witness 1 informed her that during pick up Child A had a and CCSM I Oasscreaming in her son's face and pointing at him. Child is and, he is not fully able to tell her if someone has hurt him. When S Mother asked Child A what happened to him and he told her, "The man hurt me.." Child A's Mother stated that she informed the center that Child A i A's Child A's Mother learned through Witness 1 that the center had given him flag hat day and when they tried to take it away as he was leaving this led to a Child A's Mother informed the center that he liked flags. C i d A's Mother stated that she picked Child A up and took him to urgent care and to file a police report after being direcftreod "toso by Witness 3. Child A's Mother has another child who was still in attendance at Rainbow Village Childcare. Child A's Mother said she called over to the center to inform them that someone else would be picking up her other child. The center did not mention anything about the incident or inform her of the incident. While at urgent care on 01/05/2023, the urgent care physician instructed Child A's Mother to pictures of the bruising. Child A's Mother then went to the o make a police report where they also took pictures on W. 113/2023,Child A's Mother had a visit from the Child A's Mother was told to a e Child A to the hospitaL Therefore, Child A's Mother took Child A to and the hospital w"ae to get much more information from Child A regarding the incident. She said Child A informed the hospital staff that he was hit in the back of the head in the classroom and dragged out by one arm by a man. Child A's Mother stated that this lines up with why he would have had so much bruising on his arm. I reviewed pictures sent to Child A's Mother from Witness 1, the pictures were taken on 01/05/2023. 1 also reviewed pictures taken by Child A's Mother, these pictures were taken while at on 0110512023. Additionally, I received and reviewed pictures from the taken on 0110512023, and taken on 113/2023. The pictures taken on 0110512023 show significant bruising and scratching under Child A's armpit and above the elbow on his arm. The scratches and bruises were bright red and starting to scab. There are three short scratches along m and bruising directly in the arm pit area. The pictures from taken on 01/13/2023, show healing of all bruising and fading scratches. The scratches are gone or fading away and the bruises are dull. PFR dated 01/05/2023 and 4/2023 both state that Child A had Cl abrasions on the upper right and left arm. The do not indicate any concerns for physical abuse. The medical records from . indicate that Child A was examined for concerns of physical child abuse after being picked up from

On 06/09/2022, I spoke to the complainant regarding the allegations. She stated these allegations were observed five months ago. She was unsure of the exact date of when these incidents occurred. The complainant stated she observed CCSMs, Ebony Jones, Shakira Percy and Miles Brown, smoking marijuana in the child care center kitchen, while they were taking care of the children. The children were playing in the gym while the CCSMs were smoking in the kitchen. According to the complainant the incident occurred two times and Marquita Walker, program director, was aware of the CCSMs smoking at the child care center. On 06/09/2022, I completed an unannounced onsite inspection at Rainbow Village Childcare. I spoke to Ms. Walker, Clea Brown, cook, Ms. Percy and Myles Brown, CCSMs. The child care center was observed during naptime. There was no marijuana odor smelled at the center. The kitchen refrigerator, freezer and closets were stocked with food. In the toddler room, there was 10 children, ages 12 months to 2 years, with two CCSMs. In the 3-year-old room, there was four children with one CCSM. In the 2 year old room, there was three children with one CCSM. In 1/2 the 4-year-old room, there was 14 children with one CCSM. Child information forms, discipline policy, substance abuse policy, CCSM contact information and menu was provided for review. I spoke to Ms. Walker regarding the allegations. She was asked if Ms. Jones, Ms. Percy and Miles Brown smoked marijuana at the child care center. She stated that the child care center is a non-smoking facility. She does not allow anyone to smoke anything (i.e., marijuana, cigarettes, etc.) at the child care center. Ms. Walker stated that she has not seen any of the CCSMs smoke at the child care center. The child care center has a substance abuse policy and the CCSM are prohibited from using controlled substances and alcohol while at the child care center. There are no smoking/ vaping signs posted at the front and back door of the child care center. I interviewed Myles Brown and Ms. Percy regarding the allegation. Myles Brown is a CCSM in the 2-year-old room. Ms. Percy is the lead caregiver in the toddler room. They stated that they have never smoke marijuana at the child care center. They know that the center has a policy against smoking at the center. They have not seen any other CCSM with marijuana while at the child care center. On 08/03/2022, the center's employee handbook was reviewed. According to their substance abuse policy, employees are prohibited from reporting to work while under the influence (i.e., controlled substance, illegal substance, or alcohol). They are not able to use or possess illegal substances while at the center. Any violation of the policy may result in disciplinary action. On 08/03/2022, I spoke to CCSMs, Ms. Jones and Treasure Glover regarding the allegations. Ms. Jones is a CCSM in the 4-year-old room. Ms. Glover is a CCSM in the infant room. Ms. Jones and Ms. Glover stated there is no marijuana usage at the child care center. They have not seen any CCSMs smoke or have marijuana in 3

On 06/09/2022, 1 spoke to the complainant regarding the allegations. She stated that the children are served junk food (i.e., homemade lunchables, pizza, etc. They are never provided with fruit and vegetables with their meals. Ms. Walker stated that the children are fed well at the child care center, and they are not fed junk food. They follow the food program guidelines, and they order and have food delivered weekly from Gordon Foods or Kroger. Clea Brown is the cook at the child care center and he prepares the food at the center. At times, the center does provide the children with lunchables and pizza. The lunchables are usually provided to the children as an alternative when some of the children do not like the meal. According to Ms. Walker, pizza was provided to the children today with salad, applesauce and milk. They offer the children seconds on the main food groups. Mr. Clea Brown stated they do not feed the children junk food at the child care center. The children are provided with four items out of the five food groups at each meal. He stated that he always cooks extra food. He provides the children with good meals (i.e., spaghetti, fruit, bread, hamburgers, etc.) Myles Brown, Ms. Percy, Ms. Jones and Ms. Glover stated that the children are fed plenty of food. The center is very stuck and they make sure the children are not fed junk food. On 08/03/2022, I observed the center's menu for the week of 06/06/2022 through 06/10/2022. The meals provided were nutritional. On 08/03/2022, Child A, B and C's Mother stated that she has no concerns with the food they provide the children. Child A, B and C is never hungry when they leave the child care center. At times they send the children home with their snack if they are picked up early. Child D and E's Mother stated her children are fed at the child care center. When her children arrive after breakfast has been served, the center still offers them something to eat when they arrive at the center. Child F's Mother stated that Child F is a picky eater, and the center gets him to eat things that he does not eat at home. She has no issue with the food being provided to the children. Child G and H's Mother stated they are provided with enough food while at the child care center.

On 10/13/2021, I contacted licensing consultant, Erica Hogan. Mrs. Hogan is the consultant assigned to the center. She last inspected the center on 4/29/2021. During that time, Mrs. Walker's husband was working at the facility. Mrs. Hogan could not recall his name. On 10/13/2021, I checked the Child Care Background Check system (CCBC) and found that a male by the name of Clea Brown is listed as a child care staff member (CCSM). On 10/13/2021 and 11/17/2021, I conducted an unannounced inspection at the facility. I interviewed program director, Marketa Walker, CCSMs Clea Brown, Myles Brown, Shakria Percy and Ebony Jones Mrs. Walker said three child care staff members quit on 10/11/2021 and she believes this complaint was made for retaliation. She said CCSM, Clea Brown is her husband. She denied that he is working under her son's name. Ms. Walker's son also works at the center, his name is Miles Brown. Ms. Walker admitted that three child care staff members do not have background checks. The child care staff members were previously employed with the center; however, they have been disconnected for over a year. Mrs. Walker believed she could reconnect the staff without them being fingerprinted second time. Mrs. Walker immediately scheduled the staff for fingerprints. The staff are Ebony Jones, Miles Brown, and Shakira Percy. Clea Brown denied he is working under his son's name. He is the chef and maintenance man for the center. Clea Brown has his background check completed in CCBC. I viewed his Michigan driver's license and verified his identity. Ebony Jones, Myles Brown, and Shakira Percy said they do not have background checks. They thought they could work for the center without being fingerprinted because they were previously employed. Ms. Jones and Ms. Percy has been working for the center for over a month. Myles Brown has been employed at the center for approximately 10 months. Each of the CCSM has had unsupervised contact with the children. On 11/1/2021, I attempted to contact the complainant. There was no answer, and a voice message was left. 3 ............... .....................................

Ms. Walker said the child care staff members received updated CPR and first aid training on 11/09/2021. Ms. Walker provided me with a copy of the training certificates for nine CCSMs.

Ms. Walker denied a staff member was diagnosed with COVID- 19 and allowed to remain in the center. In April of 2021, a CCSM was diagnosed with COVID-19, however, she was quarantined as required. Several children at the center tested positive for HFM during the week of 09/27/2021. Ms. Walker provided notification to parents by positing a notice on the parent board. The notice included the name of the disease, the symptoms and prevention measures. She also told parents as they picked up their children. CCSMs, Ebony Jones, Shakira Percy, Clea Brown and Myles Brown said sick children and staff are not allowed to remain in the center. They denied that anyone at the center has been diagnosed with COVID-19. Shakira Percy said there have not been any cases of HFM since she has been employed. Ebony Jones said there was a case of HFM at the center and parents were notified. On 11/15/2021, I conducted a telephone interview with Child B's Mother. Child B (1- year-old female) was diagnosed with HFM, she informed Ms. Walker and a notice was posted on the parent board. During the onsite inspection, I obtained copies of the sick/illness policy. The policy says that sick children and staff are not allowed to remain in the center.

Ms. Walker denied the facility is in bad conditions. The building is old and is in the basement of the church. There are some repairs that have been made due to normal wear and tear. Clea Brown makes all the repairs and cleans and disinfects the building daily. The facility has a dish washer, all toys and high touched items are clean and sanitized in the dish washer. The storage room was leaking water due to the heavy rains that occurred during the summer months. However, those areas have been cleaned, sanitized and water was removed with a wet vacuum. Ms. Walker said the center does not have rats, mice, roaches, fruit gnats or broken glass on the floor. The center has hot water. Ebony Jones, Shakria Percy, Clea Brown and Myles Brown said the center does not have rats, mice, roaches, fruit gnats or broken glass on the floor. The CCSMs said the building is cleaned daily and the carpet does not smell. Toys are clean and sanitized daily. Clea Brown said he cleans the building daily. The storage room was leaking water when it rained. However, he repaired the wall and window by putting flex seal on it. He also painted the wall with a product called "Dry Lock" which prevents the water from leaking into the building. During the onsite inspection on 10/13/2021, I interviewed Child A's Mother. She said she loves the center. She did not have any concerns as it relates to the conditions of the building or the staff. Child B's Mother denied have any concerns for the condition of the building. She likes the center and feel the staff does a good job. During the onsite inspections on 10/13/2021 and 11/17/2021, I observed the building to be in a clean and safe condition. I walked through the entire facility and did not observe any broken glass, rats, mice, roaches, or gnats. The carpet appears to be old, but it was clean and free from foul smells. I observed the storage room and there was fresh paint on walls. The gym room was also freshly paint. The center uses a dehumidifier because the center is in the basement, and it reduces the moisture in the air. The center has hot water.

On 08/02/2021 I initiated the investigation by calling Marquita Walker, program director, to assess her knowledge of the incident. Mrs. Walker was aware of the allegations. She told me that on 07/30/2021, while on the playground, Ravone Lawton, Child Care Staff Member, told Child A, (a three-year-old male), to sit down. She said it was following his observation of Child A kicking other children. Mrs. Walker continued to explain that she and the CCSM were discussing Child A's behavior and as they were talking, a man who was sitting in the parking lot across the street at the library, walked over in a "charging-like" manner and began to yell at the CCSM. The man told the CCSM he saw him strike the child in the back. The man continued to yell and use profanity. At that moment, Mrs. Walker said she intervened and asked the man to leave the premises of the center. Mrs. Walker assured the man that she was right there and did not see the CCSM strike Child A. The man threatened to call the state of Michigan and the Redford police. I asked Mrs. Walker to send me the center's discipline policy. I asked her if she oversaw and monitored that all staff were following the center's policy. Mrs. Walker said, "Mrs. Hogan we would never hurt these children. We love these children. We don't use any kind of abuse towards the children at any time." I told Mrs. Walker that I would be in touch with her regarding the incident. Mrs. Walker said she immediately called Child A's mother and informed her of the incident. Mrs. Walker said Child A's mother thanked her and said she would be there at her usual pickup time. On 08/02/2021, I contacted Ravone Lawton, CCSM. I asked him to tell me about the incident on 07/30/2021 involving him and Child A. The CCSM told me that while playing outside on the playground, he saw Child A kicking other children. He said he took Child A by the hand and walked him to the gate and told him he could not go near the other children until he stopped kicking. I asked him if he used any kind of force with Child A. He said, "No." He said, he took his hand to walk him away from the other children. He said out of nowhere, a man came running from the library's parking lot across the street yelling and screaming. He said the man told him that he saw him hit Child A. He and the man exchanged words and at that time, Mrs. Walker instructed the CCSM to go inside, and she continued to speak with the man. The CCSM said, on 07/30/2021, when Child A's mother arrived, he reiterated the incident of Child A kicking as well as the incident with the man. Child A's mother apologized for her son's behavior. On 08/02/2021 I attempted to contact the complainant. I could not leave a voicemail because the recording said the mailbox was full. I immediately sent a text message to the telephone number. I said, "Hello, my name is Erica Hogan, and I am with Child Care Licensing. I would like to speak with you regarding an incident involving you witnessing a child care staff member at Rainbow Village Childcare strike a child. If 3 you could please give me a call back, I would greatly appreciate it." I left my contact information in the text. I received a response back. The message said, "Hi, this is not the complainant's telephone number, but I hope you shut down Rainbow if they are hitting kids!" I replied, "I was hoping to contact the person who made the complaint so that I can understand what was witnessed. So, if you know who the witness is, please share my contact information. Thank you." I did not receive any additional response. On 08/03/2021, I called Child A's mother. After introducing myself and telling her the nature of my call, she immediately told me she was aware of the incident. I began asking her some identifying questions about her son. Then I asked her if she thought her child had been assaulted in the incident that occurred on 07/30/2021. She answered, "No." She told me her son "throws temper tantrums when he doesn't get his way and throws

On 04/28/2021, I contacted the complainant regarding the allegations. The complaint expressed her concern that although Rainbow Village 2 Child Care Center had a COVID-19 exposure, they were still operating. The complainant was upset that the program director, Mrs. Marquita Walker chose to close for only two days and not for 14 days. On 04/29/2021, I made an unannounced visit to Rainbow Child Care Center. There were two Child Care Staff Members present. CCSM 1 answered the door. I told her I was there to complete an investigation due to a complaint. I asked her if the program director was present. She told me the program director, Mrs. Marquita Walker was not there because she was ill. I asked her if there had been a COVID-19 exposure in the center. She confirmed. I asked her if there was any information that was sent out to the parents regarding the exposure. She told me the parents were called and a letter was sent out to them. I asked her when they closed due to the exposure. She told me they closed Monday, 04/19/2021 and Tuesday, 04/20/2021 to sanitize and deep clean the center. I asked her who was in charge while Mrs. Walker was not present. She introduced me to CCSM 2, a lead teacher who was in charge while Mrs. Walker was not present. I restated to CCSM 2 why I was onsite and explained the allegations. He reiterated that the center was exposed to COVID-19 and as a result, the center closed on Monday, 04/19/2021 and Tuesday, 04/20/2021 and he added, "Mrs. Walker called the state and they told her she could reopen." I retrieved a copy of the letter that was sent out to the parents regarding the COVID-19 exposure. I asked for copies of the child information records. I randomly chose six records. On 04/30/2021, I called the parents of six enrolled children, Parent of Child A & B, (five-year-old male and four-year-old male). Parent of Child C, (five-year-old female). Parent of Child D, (six-year-old female). Parent of Child E, (four-year-old female). Parent of Child F, (four-year-old female). I asked each parent the following questions: 1. Are you aware that there was a COVID-19 exposure at Rainbow Child Care Center? 2. Did you receive notice that there was a COVID-19 exposure at the center? 3. How were you notified that there was a COVID-19 exposure? 4. Do you have any concerns regarding this COVID-19 exposure? Responses from each parent: aid she was aware that there was a COVID-19 exposure. She received a phone call from Mrs. Walker telling her about it. When she picked up her children, she got a letter telling her about the exposure. She had no concerns. Parent of Child C said yes, she was aware that there was a COVID-19 exposure in the center. She said she received a phone call from Mrs. Walker on Sunday, 04/18/2021, explaining the center had an exposure to COVID-19 and they needed to close for a couple of days to clean and sanitize. The parent said when 3 she picked up her daughter on Wednesday, 04/21/2021, she was given a letter about the exposure. She said her only concern is that they keep the center wiped down so that it does not spread again. Parent of Child D said his wife told him there was a COVID-19 spread at the center. He did not see the letter, but his wife told him she received one about COVID-19 being at the center. He said he was unsure if Mrs. Walker called his wife. His concern was that he was glad they closed. Parent of Child E said she was aware there had been a COVID-19 exposure because Mrs. Markita called her to let her know. She said she received the letter about the exposure on Wednesday, 04/21/2021. She said she did not have any concerns. Parent of Child F said she was aware there had been a COVID-19 exposure in the center. She said Mrs. Marquita called her to let her know about the center being exposed to COVID. She said on Wednesday, 04/21/2021 she received a letter explaining what happened. The mother said she is concerned for the staff and want them to feel better.

On 04/29/2021, I made an unannounced visit to Rainbow Village Child Care Center. I arrived at 8:45 am. I made both CCSM 1 and CCSM 2 aware of why I was onsite. CCSM 2 told me the center closed for two days to be deep cleaned and sanitized because of the COVID-19 exposure. I asked CCSM 2 if they hired a company to deep clean and sanitize. He said, "No, the staff worked all weekend to clean." CCSM 2 told me the center is deep cleaned and sanitized three times a week. On 05/04/2021 I made an unannounced visit to Rainbow Child Care Center at approximately 12:30 p.m. When I arrived, Mrs. Walker was not onsite. CCSM 2 called her to let her know I was on site. Mrs. Walker arrived approximately 20 minutes after I arrived. I asked her if she had a cleaning log of when the center was deep cleaned and sanitized. Mrs. Walker provided me with a log of when the center had been cleaned. On 05/14/2021 I received a telephone call from Dave Pearson, Wayne County Health Department. He told me he had received a complaint that "Rainbow Village was filthy." He told me he was going to complete an Environmental Health Inspection at the center. On the afternoon of 05/14/2021, an Environmental Health Inspection was conducted at Rainbow Village Child Care Center. On 05/19/2021 I received an email with an attached report from Mr. Pearson, Wayne County Health Department. In the report, it states that during his inspection, the bathrooms were clean to the sight and touch.
