    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    On 11/10/2022, I interviewed licensee designee, Micah Hobdy. On 10/31/2022, Child A was sitting at the table when he was bitten by Child B. There were three child care staff members present with six children ages 2 to 2 years '/2 old. Child A's Mother was contacted immediately regarding the incident. Child A's Father arrived at the center to pick him up. An accident report was provided regarding the accident. On 11/3/2022, Child A was scratched by Child C. Ms. Hobdy held a meeting with Child A's Mother at pick-up. She was informed that Child A was scratched on his face. An accident report was provided. There were three (CCSM's) present with six children. Child A's Mother left all his belongings at the center. She never stated that Child A would not be returning. On 11/10/2022, I interviewed (CCSM), Mariah Hobdy. On 10/31/2022, Ms. Hobdy was changing a diaper in the restroom. She returned to the classroom and noticed (CCSM), Jameishia Kendrick tending to Child A. Ms. Kendrick informed her that she was taking Child A out of the highchair after breakfast and he was bit by Child B. On 11/3/2022, the children were getting cleaned up after lunch. Child A was trying to play with Child C and he was scratched. Child A never cried after either incident. Child A's wound was clean up by Ms. Kendrick. On 11/10/2022, I interviewed Ms. Kendrick. On 10/31/2022, she arrived in the toddler classroom and the children were getting cleaned up after breakfast. She did not observe Child A get bit but saw the tears on his face. She attended to Child A. There were two other (CCSM's) in the classroom when she arrived. She was not present for the second incident. On 11/10/2022, I interviewed (CCSM), Jayla Cotton. On 10/31/2022, Ms. Cotton stated the children were sitting at the table eating breakfast. Child B bit him on his face unprovoked. She was not present for the second incident. On 11/10/2022, I interviewed (CCSM), Andrea Lawton. On 10/31/2022, Ms. Lawton stated that Child A was in Child B's face, and she asked him to stop. Child A is larger than the other toddlers. Child B bit him out of fear from being intimidated by his size. On 11/17/2022, I interviewed CCSM, Sharon Ware. On 10/31/2022, she was not present during the time Child A was bitten. She was contacted while she was out by Ms. Hobdy regarding an irate parent at the center. She arrived back to the center and approached Child A's Father as he was putting Child A in the car. She asked what happened and he referred to the staff as disrespectful workers. He stated if this was him five years ago, he would have "sprayed up this building". On 11/3/2022, the second incident occurred. The children finished eating and she was cleaning their faces as she removed them from their highchairs. Child A was close to her because she had just washed his face. Child C walked over to him and scratched his face. She immediately took him to the kitchen to apply first aid. Child C's Mother was contacted to come pick him up because this was his second time scratching. Child A's Mother was not notified regarding the scratch until her arrival for pick up. She was asked to come in the center for a meeting with her and Ms. Hobdy. Child A's 3 Mother was informed about the scratch and was upset. It was explained that she was not notified when it happened because of safety concerns regarding Child A's Father. Staff was in fear of him hurting someone if he came back to the center and 911 would have been called. Child A's Mother stated that Child A's Father has the right to know when Child A is injured. Ms. Ware felt it was in the best interest of everyone to notify her at pick up to avoid confrontation. On 11/17/2022, I interviewed Child A's Mother. On 10/31/2022, she was notified right away Child A was bitten. Child A's Father went to pick him up after the incident. On 11/3/2022, Child A was scratched in the face. Child A's Mother was not made aware of the incident until she arrived. Ms. Ware asked her into the buildin

    On 10/22/2021, I completed an unannounced onsite inspection. interviewed /Micah Hobdy, licensee and Sharon Sharpe, manager. They both stated that children are never left unsupervised. The child care staff members always supervise the children. Ms. Hobdy and Ms. Sharpe both explained that children are never left strapped in a car seat. There are two children, Child A (four-year-old, male) and Child B (four- year-old, female) who have car seats at the child care center. The car seats are left when the children are dropped off so that the parent/grandparent who picks the child up at dismissal can utilize the car seat. I observed the car seats near the front entrance. There were no children in the car seats. Ms. Hobdy and Ms. Sharpe stated that children are never allowed to stand up in the highchairs and the children are always properly strapped in the highchair. I observed children in the high chair during the inspection. The children were strapped in the highchair and the child care staff members were supervising the children. Children do not peel paint off the walls and there is no peeling paint on any of the walls in the center. During the inspection, I did not observe any peeled paint on the walls. During the onsite inspection, I interviewed Child C's (3-year-old, female) Father. He stated that he does not have any concerns with the care that Child C receives at the child care center. He does not have any concerns with supervision of his child. On 10/25/2021, I spoke with Donna Brown via telephone, program director. She stated that children are never left strapped in a car seat. She explained that there are two children, Child A and Child B who have car seats at the child care center. If 3 Child A or Child B's parent bring a child in the child care center in their car seat, the staff immediately takes the child out of the car seat. Ms. Brown stated that the child care center does not have peeling or chipped paint. She has never observed a child peeling paint off the wall, and this has never been reported to her. Maintenance is done by Mr. Sharpe, if there is a building issue it is reported to Mr. Sharpe. If the issue is a hazard to the children, the parents will be notified, and the child care center will close for repairs to be completed. The children are never allowed to stand up in the highchairs and the children are always properly strapped in the highchair. On 10/29/2021, I spoke with CCSMs, Andrea Lawton and Micah Hobdy via telephone. Both CCSMs said children are never left unsupervised. Ms. Lawton and Ms. Micah Hobdy stated that children are never left strapped in a car seat. They explained that there are two children, Child A and Child B who have car seats at the child care center. When Child A or Child B's parent bring them in the center in their car seat, the staff will immediately take the children out. Ms. Lawton and Ms. Micah Hobdy explained that they have not observed children peeling paint off the wall and there has not been any chipped or peeling paint on the wall and children are always monitored. On 12/13/2021, I spoke with Child A's Mother. She did not have any concerns with the child care center. She stated that she had never observed children unsupervised, and she has never witnessed any children in a car seat. She said Child A had a car seat that was left at the child care center. She was not aware and does not think that Child A was ever left strapped in the car seat.

    On 10/22/2021, Ms. Micah Hobdy and Ms. Sharpe stated that they have not had any problems with staff yelling at children. The child care center 4 utilizes positive methods of discipline as indicated on their discipline policy. Child A's Mother and Child C's Father has not observed staff yelling at children to sit down and shut up when they are at the child care center. On 10/25/2021, Ms. Brown stated that she has not observed staff yelling at children to sit down and shut up. She explained that child care center utilizes positive methods of discipline. On 10/29/2021, Ms. Lawton and Ms. Micah Hobdy stated that they have never yelled at children to sit down and shut up and they have not observed staff yelling at children to sit down and shut up. She explained that child care center utilizes positive methods of discipline.

    On 10/22/2021, 1 spoke with Ms. Hobdy and Ms. Sharpe. They stated that they have not had 20 children in attendance. The child care center has 20 children enrolled. During the onsite inspection there were nine children of various ages, in attendance with three child care staff members. I reviewed the attendance records for the week of 10/18/2021-10/22/2021. The CCSM-to-child ratios were maintained. On 10/25/2021, I spoke Ms. Brown. She stated that CCSM-to-child ratios are maintained. The youngest child's age is used to determine CCSM-to-child ratio that is utilized. On 10/29/2021, I spoke Ms. Lawton and Ms. Micah Hobdy. Both child care staff members stated that CCSM-to- child ratios are maintained. The youngest child's age is used to determine CCSM-to-child ratio that is utilized. 5

    On 10/22/2021, Ms. Hobdy, Ms. Sharpe, and Child C's Father stated that there had not been a bad smell in the building, there has not been a sewage back up, and there has not been an overflow of trash inside or outside of the building. Ms. Hobdy and Ms. Sharpe stated that the garbage is removed from inside the building throughout the day and the garbage is not overflowing outside of the child care center. I observed the inside and outside of the child care center there was not a bad smell, and the garbage was not overflowing. On 10/25/2021, Ms. Brown stated that there has not been a bad smell in the child care center, there has not been a sewage back and there is not garbage overflowing inside or outside of the child care center. She stated the child care center is always clean and maintenance is kept throughout the day. On 10/29/2021, Ms. Lawton and Ms. Mariah Hobdy stated that there has not been a bad smell in the building, there has not been a sewage back up, and there has not been an overflow of trash inside or outside of the child care center. Andrea Lawton and Mariah Hobdy stated that the garbage is removed from inside the child care center throughout the day and the garbage is not overflowing outside of the child care center. On 12/13/2021, I spoke with Child A's Mother she stated that she has never smelled a bad odor or witnessed trash overflowing at the child care center. She stated that the child care center is clean.
