    R 400.8140 · R 400.8140 Discipline. (2) All of the following means of punishment are prohibited: 4 (a) Hitting, spanking, shaking, biting, pinching, or inflicting other forms of corporal punishment.

    On 3/17/2021, I conducted an onsite investigation. I interviewed licensee, Wanda White. Ms. White stated that on 3/12/2021, child care staff member, Kayla Davis contacted her from the daycare. Ms. Davis informed her that Child A's (three-year-old male) Father was being rude to her when he arrived at the center. Child A diarrhea and had, had multiple bowel movements and was out of clothes. Ms. White informed Ms. Davis that Child A's Father has never been rude to 2 her and wanted to talk with Child A's Mother to find out what happened. Ms. Davis informed Ms. White that Child A's Father was cursing and there were other people who witnessed. Ms. Davis informed Ms. White that she quit because of Child A's Father and his behavior towards her. Ms. White stated that she spoke with Child A's Mother. Child A's Mother informed Ms. White that Child A's Father was on the phone while picking up and did not say anything rude to Ms. Davis. Ms. White informed me that she spoke with Child A's Mother again and informed her that she needed to figure the schedule out before Child A could return on Monday. She stated that she did not disenroll Child A, but she was short staffed due to Ms. Davis quitting. Another staff threatened to quit if Child A continued to attend. She stated that Child A's Mother was made aware of his behavior daily about scratching, biting, and hitting. Child A's Mother asked Ms. White about scratches on Child A and a bite mark that no one informed her of. She sent pictures of Child A's arm scratched up. Ms. White informed me that she was not aware of where the bruises come from. Ms. White stated that this was the first she heard of scratches and bite marks on Child A. Ms. Davis informed me that Child A can say if something hurts. She stated that she spoke with Ms. Davis and was informed that Child B (one-year-old female) caused the injuries after Child A tried taking a toy away from her. Child A's Parents informed Ms. White they were aware that a child must have caused the scratches and not an employee. On 3/17/2021, I interviewed child care staff member, Genevive Benguche. Ms. Benguche informed me that in the three weeks of being employed at the center, Child A has hit her daily. She informed Ms. White that Child A hits her. On the day in question, Child A had to bowel movements and Ms. Davis changed him. The third time he had an accident, Child A stuck his hand in his pants and tried to rub it on Ms. Benguche. Child A's Mother was notified that Child A had diarrhea and needed to be picked up because he was out of clothes. Child A's Mother stated that Child A's Father would pick him up. Child A's Father arrived and was cursing at Ms. Davis. Ms. Davis did not say anything. She changed Child A into a Pull up and he was taken home. On 3/24/2021, I interviewed Ms. Davis. Ms. Davis stated that Child A's Mother recently had a baby and Child A wanted more attention. Child A hit a baby while Ms. Davis was holding and feeding a baby in her arms. She informed Child A's Mother and she stated that he tried to hurt their new baby at home. The day of the incident with the diarrhea, Child A was on his third change of clothes. Child A was potty trained, but he never had a bowel movement at the center. When Child A's Father arrived, Child A tried to leave. She stated that Child A's Father arrived at the center and was screaming at her. Ms. Davis stated that she asked Child A's Father for the Pull up in his hand so she could change him before getting in the car. This is not the first time he has screamed at her. Child A's Father was yelling that Ms. Davis let Child A walk around like that. After Child A's Father left, Ms. Davis contacted Ms. White to let her know. Ms. Davis stated that Ms. White was made aware of Child A's behavior all the time. Ms. Davis stated that Child A was attached to her. He did not like when she assisted other children. He acted out more towards the other children 3 and staff. Ms. Davis stated that she has never hurt
