    R 400.1908 · R 400.1908 Capacity. (1) The licensee shall ensure that the actual number of unrelated children in care at any 1 time does not exceed the number of children for which the child care home is licensed, not more than 6 children for a family child care home and not more than 12 children for a group child care home.

    On February 16, 2023, I initiated the investigation via telephone with the complainant who stated that the number of children Channel Brawner had been billing for each day, is over her licensed capacity of 12. The dates in question are between September 25, 2022, through October 8, 2022. The complainant submitted a spreadsheet showing that Mrs. Brawner had 27-29 children in care on the aforementioned dates during the hours of 3:00pm — 5:30pm. On February 21 2023 during an unannounced on-site inspection, Channel Brawner and her were present. The allegations were explained to them. Mrs. Brawner stated that she has never had 29 children in her home at one time. She reported that she does latchkey transportation to and from school. She admitted that she was billing for the children who are in her care starting at 3:30pm, once they were in the car with However, they are not yet at the daycare home. She notated the time of pick up on the billing documentation, so it appears that they were all in the home at one time. Mrs. Brawner reports that during the dates in question was her first-time billing for children through MDHHS and she was a little confused. She stated that she has spoken with Trina Coolman at MDHHS who has explained the correct way to submit. Mrs. Brawner explained that she has children that arrive early in the morning that are picked up before the school-aged children arrive. During my inspection at 4:15pm, there were 4 children present with Mrs. Brawner. The attendance log showed that there were 7 in care today, 3 children left at 3:00pm, leaving the 4 who were there during my visit. The attendance log for the day before, February 20, 2023, showed 12 children present. On February 21, 2023, Walter Brawner denied having 29 children present at one time. He stated that he does school-age transportation picking up and dropping off children at school and at home. Ms. Brawner is aware that the child care license capacity is only 12. On February 23, 2023, the complainant reported that "red flags" were raised because Mrs. Brawner and the school's after school program submitted billing request for the same children. The school program was not getting paid because of this. After it was explained to Mrs. Brawner, who admitted to her that "she has to do better", documents were submitted properly. Mrs. Brawner was not required to repay the funds that she received. On June 23, 2023, Mrs. Brawner reported that there has not been anymore "hiccups" with the MDHHS billing. She stated that it was a learning experience and that she has submitted documents properly. On June 27, 2023, during separate telephone interviews, Child A's, and Child B's Mother each reported that they love the Brawner's. They each reported that they have not seen more than 12 children at the childcare home at one time. Neither 3 Child A's Mother nor Child B's Mother reported any issues or concerns with the care/services provided.
