On 11/10/2022, Child A's Mother reported Child A had told her that she had to walk laps because she had lifted her head up at naptime. She also reported that Child B (4-year-old, female), Child C (4-year-old, male), Child D (4- year-old, female), Child E (4-year-old, female) and Child F (4-year-old, male) have had to walk laps as punishment for behaviors that have been deemed problematic. 3 Child A's Mother clarified that "laps" are when the children have to walk around the playground area. Child A's Mother stated that she was never informed that Child A had walked laps and she was never informed that this was part of the discipline policy for the program. On 11/15/2022, Child D's Mother reported Child D has not mentioned that she has had to walk any laps this year. "I know if they [children] aren't listening at recess, they have to go a couple times [walk laps] to calm down." She stated that she has volunteered before at recess time and has witnessed children walking laps. The laps are for "cooling off.. .to get away from the situation." Child D's Mother further reported, "I personally love it [the preschool program]. It's an amazing program. Ms. Anne Bawek is phenomenal." On 11/16/2022, Child B's Father reported that approximately one to two weeks after Child B began attending the program, he had heard that children were having to walk laps. "They walk laps at naptime if they don't nap." He was unsure of how many laps the children had to walk but said two or three kids had to walk laps in the gymnasium. On 11/16/2022, licensee designee, Ms. Anne Bawek reported that rest time is after lunch and depending on the day, the children may rest anywhere between 15 to 30 minutes. Child who fall asleep, stay asleep and other children just lay there and rest. In regard to Child A having to walk laps because she lifted her head at rest time, Ms. Bawek reported that this happened on just one occasion. The general rule for all children is to lay still with their head down. Ms. Bawek stated she believes this to be an age-appropriate expectation and that she expects the children to "squirm." She had asked Child A probably 3-5 times to put her head down, "She would do it and then she would lift her head and squirm around." Ms. Bawek said she told Child A, "I guess we are going to do some laps at recess." She believes Child A did four laps outside on the playground at recess time that day. Ms. Bawek could not recall Child B or Child D having to walk laps this year, Child C, Child E and Child F have all had to walk laps one or more times. Children have a choice at recess time that they can either stand and pout or walk laps. The children walk the laps around the perimeter of the playground while other children are outside playing. Walking laps is used for children who were not listening and sometimes the parents are informed their child has had to walk laps. Ms. Bawek does not believe walking laps is part of the program's discipline policy and thought it was age-appropriate for preschool children. She did not think it hurt the children to walk laps. She informed me that having the children walk laps as a form of discipline has stopped. Ms. Bawek further reported that it was her understanding that child care children had to be provided a rest time and that they had to rest. I provided clarification for R400.8188(12) Sleeping, resting, and supervision. Naptime or quiet time must be provided when children under school-age are in attendance 5 or more continuous hours per day and (13) For children under school-age who do not sleep at rest time, quiet activities must be provided such as reading books or putting puzzles together. 4 On 11/16/2022, licensee designee Ms. Michelle Johnson reported that she did not know much about rest time. She stated that she knew Ms. Bawek could not make the children rest and if they fell asleep, then they could stay asleep. On 09/15/2022, licensee designee Ms. Michelle Johnson submitted an incident report stating the following: "On 09/15/2022, Child A was screaming that she wanted her daddy after drop-if and went into a corner. Myself, lead teacher and aid were working with other child when suddenly Child A got up and ran out the exterior door. I ran across the room but door shut before I could reach it, and she was out of our sight for less than 5 seconds. When I went outside, Child A was standing there screaming. When she saw me, she ran away heading towards M-55. I caught her about 20 ft. away from building, so she didn't get far. Child A went back in classroom and stopped crying for the day after 5 minutes." On 09/21/2022, I made an unannounced on-site visit. I interviewed licensee designee Ms. Michelle Johnson. She stated that Child A had arrived at school on 09/15/2022 around 8:00 a.m. When she entered the classroom she went over to a corner of the room. Ms. Johnson, lead caregiver Ms. Anne Bawek and child care staff member Ms. Brigitte Doehring were all in the classroom and were working with and interacting with the other children in the room. Suddenly, Child A got up and ran out the exterior door that is located at the back of the classroom. Ms. Johnson said she ran across the room after Child A, but the exterior door closed before she could reach her. She estimated that Child A was out of her sight for less than five seconds. She immediately went outside. Child A was observed standing outside the door, next to the building. When she saw Ms. Johnson, she ran toward M-55 and stopped approximately 20 ft. away from the building. Ms. Johnson placed herself between Child A and M-55, and together they walked back into the classroom. Ms. Johnson placed her in line with the other children, who were lined up at the classroom door that leads out into the hallway of the school building. Child A stopped crying after 3 approximately five minutes. Ms. Johnson reported that she made a phone call to Child A's Mother following the incident. On 09/21/2022, I interviewed child care staff member Ms. Brigitte Doehring. She stated that on 09/15/2022, Child A started the day off crying and screaming. Ms. Johnson, Ms. Bawek and herself were in the classroom interacting with the other children, when Child A took off for the exterior door. She hit the door with her hands, opened it and ran outside. Ms. Johnson ran out the door after her. She estimated that Ms. Johnson was outside with Child A for a couple of minutes. Child A was crying and screaming when she came back inside. Ms. Doehring was unsure if Ms. Johnson carried Child A back inside or if she walked in on her own. Child A joined back in with the other children. A table and chairs had been placed in front of the door for the rest of the day on 09/15/2022, all day on 09/16/2022 and in the morning on 09/21/2022, to prevent Child A from exiting the room again. Ms. Doehring further reported that the staff members have been watching Child A very carefully and that it appears to be the morning time, right after she arrives, that she is most upset. When she is upset, the staff members will close the door to the classroom to prevent her from leaving, they will try and distract her with giving her jobs and different assignments to do. Ms. Johnson has taken Child A down to her office and a couple of times a teacher from the school system, Ms. Ruth Cruz, whose classroom is near the preschool room has taken Child A into her classroom before school to help calm her down. On 09/21/2022, I interviewed program director/lead caregiver Ms. Anne Bawek. Ms. Bawek stated that Child A has had a difficult time when arriving to school in the morning. The general routine is for the children to sit at the tables and visit with one another as they arrive. On 09/15/2022, Child A was upset, she was crying and screaming. She refused to sit at the tables and instead ran over and sat behind the bookshelves. As she was sitting on the floo
