On 02/24/2022, 1 left a voicemail for the complainant requesting a return call. On 0212512022, 1 spoke with the complainant. The complainant explained MHM1 disclosed being sexual abused by Mr. Falsetta, involving penetration in 2019, which was an isolated incident. The complainant does not know what kind of penetration was involved. The complainant explained the day MHM1 disclosed the sexual abuse, MHM1 was at an event and was trigged seeing alcohol. By her body language and her eyes, she appeared "distant." MHM1 appeared uncomfortable, so she was asked if she was okay, MHM1 disclosed to the complainant that there was an incident when AHMI was drunk and he penetrated her, and this is why she is uncomfortable being around alcohol. MHMI said the next day, she went to school and her friends noticed she wasn't acting like herself, and they advised her to go to the school counselor. MHM1 went to the school counselor. The complainant saidJ Tafter spoke with rs, Falsetta, she to d MHM1 that she wishes MHM1 did not go to the school counselor and told MHM1 they could lose their home, the child care license and not to tell what happened. The complainant believes MHM1 told M in 2019 that "groped her" but she did not disclose penetration at that ime e complainant does not know how long the abuse occurred, how it started or how it ended. The complainant stated MHM1 also stated "I froze, then it was over, and I went to my room and cried." MHM1 told the complainant the details regarding the incident and that she lied to about the whole incident as she knew she needed to `downplay" this as much as possible or else Mrs. Falsetta would be in trouble. The complainant stated MHM1 made the disclosure again over the summer of 2€ 21, and MHMI's Father was made aware of the sexual abuse. MHM1 was moved to live with her paternal grandparents, The complainant stated MHM1 SS Father spoke with Mrs. Falsetta, and she said MHM1 is lying about the sexual abuse and she could leave the home if she wanted. On 02/25/2022, The complainant called to provide further details. The complainant said Mrs. Falsetta told MHM1 this was a one-time incident due to the alcohol use, but AHMI continued to drink around MHM1, and "they" never put MHM1 in counseling, but "they shrugged it off." The complainant confirmed this information was received from MHMI. MHM1 is not residing with her father as he has a small apartment and MHM1 would have to sleep on the couch if she resided with him. The AA complainant feels strongly that Mrs. Falsetta and AHM1 neglected MHM1 needs and safety. On 02/25/2022, 1 spoke with she was advised that AHM1 has access to child care children as he resides the ild care home. No allegations were made regarding the child care children. On 03/02/2022, 1 called MHM1's Father as he left a voicemail for me to return his call on 02/25/2022. 1 left a voicemail requesting a return call. On 03/02/2022, 1 emailed Licensing and Regulatory Affairs departmental specialist, Jennifer Kerr the licensing complaint. On 03/03/2022 Jennifer Kerr provided me with the 6 Mrs. Falsetta said she participated in the previous investigation and met with the Eaton County Prosecutor's regarding the allegations, charges were not issued against herself or AHM1. Mrs. Falsetta said she does not know why she stayed with AHM1 and AHM1's drinking has been bad recently. AHM1 was obtaining help with his drinking but has been drinking a lot lately. Mrs. Falsetta said she plans to move out of the home at the end of the school year, but she did not leave after the incident because her "life is here, and her job is here." Mrs. Falsetta was informed that an interview for MHMI will be scheduled at the and she would be contacted about the interview. MCL 722.115q Child care center, group child care home, or family child care home; contact with child by licensee, child care staff member, or household adult member prohibited; conditions. (1) Except as provided in section 5n(8), a licensee, child care staff member, or adult member of the household may not have contact with a child who is in the care of a child care center, group child care home, or family child care home, until the department obtains documentation from the department of health and human services that he or she has not been named in a central registry case as the perpetrator of child abuse or child neglect. Upon request by the department, the licensee, child care staff member, or adult member of the household shall provide the department with an updated authorization for a central registry clearance.
