    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

    On 03/11/2022 I received a complaint that Child C had disclosed that she used to attend Ms. Brown's child care from infancy to fourth grade. During that time Ms. Brown's son inappropriately touched her, made her touch him inappropriately, and physically abused her. Given the timeframes/ages of people involved in the complaint, this would have occurred at least five years ago or more. Both Ms. Brown's son and Child C were minor children and five years apart in age. It should be noted that due to the way the complaint came in, I could not contact Child C's Mother or Child C for interviewing. On 03/14/2022 I conducted an unannounced onsite inspection to the child care group home of Tracy Brown. There were two child care children and Minor Household Member (MHM) present in the home. MHM is the only other person living in the home and has been the only household member present in the home the past six years that I have had this facility on my caseload. Ms. Brown was with the child care children in her child use area and MHM was watching television in her bedroom on the opposite side of the home, a non-child use area. I observed one child care child napping in a pack-n-play and the other child care child eating a snack. I interviewed Ms. Brown and obtained child information cards of the two enrolled children. Ms. Brown did not believe the allegations of the complaint could be true as she is always directly supervising the child care children and her son has not lived in her home since he was 9 or 10 years old and he is now 19. Her son lived with his father and was not present in her home during child care hours and visited her on the weekends when she did not have child care children. Prior to him moving out of the home, he went to school during the day, and then came home and would not interact with the child care children. He went to his room and played video games, did homework, or went outside to play. Ms. Brown usually keeps her own children separate from the child care use areas of the home during child care hours as MHM is immune-compromised and Ms. Brown tries to minimize MHM's exposure to outside germs. Ms. Brown reported she is always present, supervising and caring for the child care children, and that the children are always only in her approved child care rooms. She denied ever allowing the children to be cared for by her own children or another adult and reported that she just closes her child care for the day if she needs to be off, unless she has an employed child care staff member that meets all the child care licensing requirements. On 03/15/2022 I spoke with Ms. Brown's son. Ms. Brown's son is now an adult but at the time this incident would have occurred, he was a minor child. He denied ever inappropriately touching another child or making another child touch him. He also denied ever being physically abusive toward another child.
