I conducted an on-site inspection on 03/13/2023. During the inspection, I interviewed Child Care Staff Member (CCSM) 1, CCSM 2, and Program Director Tammy Karmon-Hoffman. CCSM 1 said that she and CCSM 2 were present on 03/02/2023 with 16 children. They were getting ready to go outside and Child A was struggling with her snow pants and boots. At the time, a 17th child was being dropped off, so CCSM 1 2 headed outside with 15 children while CCSM 2 stayed with Child A and the child that was being dropped off. The time was about 11:22 am. CCSM 2 and the two children were to head outside once the two children were ready. As CCSM 1 was walking down the hall with the 15 children, two of the children said that they had to use the bathroom. Program Director Tammy Karmon-Hoffman was in the hall at the time, so Ms. Karmon-Hoffman stayed behind with the two children that had to use the bathroom. They used the hallway bathroom near the exit to the playground. CCSM 1 did roll call at the exit door and then headed outside with 13 children. Once the two children were done in the bathroom, Ms. Karmon-Hoffman brought them outside. CCSM 1 estimated that CCSM 2 came outside about 11:30 am. CCSM 1 did not see her come outside but noticed her after she was already outside. At about 11:38 am, Child B came to CCSM 1 and asked where Child A was. CCSM 1 and CCSM 2 looked and could not find Child A outside so CCSM 2 went inside to look for her. At the same time, CCSM 1 went inside with the rest of the children. CCSM 2 found Child A sleeping on the floor in the classroom. CCSM 1 explained that Child A and Child B are identical twins. She said they can usually be told apart by their shoes or by their hats (when outside wearing hats). CCSM 1 said that she can tell them apart when looking directly at their faces, but outside moving around it is hard to tell. CCSM 1 stated that she thought Child A was outside because she kept seeing the purple hat that Child A normally wears. Child B was wearing the purple hat that day, so it was Child B she kept seeing. CCSM 2 explained that they were getting ready to go outside and Child A was struggling because her pants were bunched up in her boots and she does not like it when they do that. CCSM 1 was lining the other children up at the time and starting roll call. CCSM 1 then started to head outside and told CCSM 2 to finish getting Child A ready to go outside. At this point another child was arriving. That child started getting ready to go outside and CCSM 1 told CCSM 2 to bring Child A and the other child out together. At some point, CCSM 2 heard Child A say, "I did it... I didn't need help with my boots this time". CCSM 2 turned to look for Child A at that time and she was not where she had been standing so CCSM 2 thought she had walked out with CCSM 1 and the rest of the class. CCSM 2 waited for the other child to put on his outdoor clothes, which she estimated took about ten minutes, and then she went outside with him. She said they went outside between 11:30 and 11:35 am. After she was outside, CCSM 1 asked her where Child A was. When neither of them could see Child A outside, CCSM 2 went inside to look for her. She found her in the classroom, where she had been standing, laying on the ground sleeping. CCSM 2 helped her finish getting ready to go outside and then went to take her outside. At that time, CCSM 1 was heading back inside with the rest of the children. It was about 11:40 am at that time. Ms. Karmon-Hoffman said it was reported to her that CCSM 1 and CCSM 2 had already done a head count and roll call before CCSM 1 left the room. She said the two child care staff members are good at doing roll calls and head counts and knowing where the children are, but the identical twin thing confused the situation. It 3 was her understanding that Child B had been in the front of the line and then moved to the back of the line and that Child B was wearing Child A's hat. The class was out of ratio for between 8 and 13 minutes on 03/13/2023 when CCSM 1 took 15 children outside while CCSM 2 stayed in the classroom with 2 children.

I made an unannounced on-site inspection on 12/20/2022 at approximately 11:02 AM. I interviewed Program Director, Tammy Karmon-Hoffman, 2 Child Care Staff Members, Kanchan Singh, Oina Akande and Anna Boyle and Center Custodian, Jody DeVries. Program Director, Ms. Karmon-Hoffman explained that she was aware of the allegations although she did not personally witness the incident. She stated that Child A was outside with several other classrooms during outdoor play time. Child A became confused during the transition time to come back inside of the building and came inside with a different classroom. Child A's is in Room 114 where Anna Boyle is the lead caregiver and Kanchan Singh is the assistant caregiver. Child A came into the building with Mr. Oina Akande's classroom. Ms. Karmon-Hoffman stated that the center's custodian, Jody DeVries, noticed that Child A was in the wrong line and returned him to child care staff member, Anna Boyle. Child Care Staff Member, Kanchan Singh, explained that she was in the doorway waiting for a few children assigned to her classroom to come out of the bathroom. She saw Child A get into line with Mr. Akande's classroom. The center's custodian, Jody DeVries, asked Child A why he was in the wrong line and directed him back to Ms. Boyle. At no point was Child A without supervision. Child Care Staff Member, Oina Akande, stated that he was gathering the children in his classroom to come inside. Mr. Akande saw Child A get into his line around the same time that the center's custodian, Jody DeVries, saw Child A. Mr. Akande stated that he and Ms. DeVries directed Child A back to his teacher, Anna Boyle, who had also noticed that Child A had gotten into the wrong line and was coming to get Child A. The center's custodian, Jody DeVries stated that she was picking up trash in a classroom close to where the children were lining up to come back inside of the building. Ms. DeVries saw Child A in the hallway and together with Mr. Akande, directed Child A to his teacher, Ms. Boyle, who was standing right outside of the door. Child Care Staff Member, Anna Boyle, explained that her classroom was outside on the playground. Ms. Boyle was attending to another child that had hurt themselves. Ms. Boyle was bending down, helping the other child and Child A didn't see her. When Child A couldn't see Ms. Boyle, he got in line with another class. Ms. Boyle stated that Mr. Akande and Ms. DeVries directed Child A to her right after Child A got into the wrong line. She spoke with Child A later and told him that she would never leave him outside. I interviewed Child B's Mother, Child C's Mother and Child F's Father on 01/26/2023. Neither had any concerns regarding the care and supervision of their children at the child care center. 3 I sent Child A's Mother an e-mail on 01/26/2023. I left a telephone message for Child E's Mother but have not heard from them to date. Child D's Mother did not have a working telephone number.
