Except as otherwise provided in subsection (13), when a person, partnership, firm, corporation, association, governmental organization, or nongovernmental organization applies for or applies to renew a license to operate a child care center, group child care home, or family child care home under section 5m and before a group child care home or family child care home allows an individual to be a member of the household, or a child care center, group child care home, or family child care home allows an individual to become a child care staff member, the department shall do all of the following:

Each individual listed in subsection (1) shall give written consent at the time of the license application and before a group child care home or family child care home allows an individual to be a member of the household, or before becoming a child care staff member to allow the department of state police to conduct the criminal history check required under subsection (1). The department shall require the individual to submit his or her fingerprints to the department of state police and the Federal Bureau of Investigation for the criminal history check as required in subsection (1).
Children are not properly supervised by staff. On 7/21/2022, Child A injured his back while doing a cartwheel on the playground. Staff had no knowledge of this incident. Child A has been injured on three other occasions. Staff do not always notice or notify parents. Child A and Child B were placed on a ferris wheel without adult supervision. Staff forgot to apply sunscreen to Child A and Child B for the first few weeks of summer child care and have been inconsistent since.

I received a telephone call and incident report from licensee designee/multi-site program director Katie Nyberg regarding Child A. I spoke on the telephone with Child A and Child B's Mother on 7/26/2022. Child A and Child B have been attending the Gilkey SAFE program since June 2022. According to Child A and Child B's Mother, child care staff loosely supervise children and do not take actions to prevent injury. On 7/21/2022, Child A injured his back after doing a cartwheel while on the playground. After injuring himself, Child A hid behind a tree and cried. Child A told his mother what had happened when she came to pick him up. Staff did not witness the accident. Child A was seen by a doctor on 7/25/2022. The doctor will reassess his injury in a week to allow some time to heal. Child A has been injured in care three other times. These injuries include tripping on a shoelace, hitting his head on the gym floor and a bruised groin from riding a bike. Child A and Child B's Mother stated that she was never informed of the bike injury. Child A and Child B's Mother also expressed concern that during a field trip, Child A and Child B rode a ferris wheel without adult supervision. I made an unscheduled onsite inspection at Gilkey SAFE on 7/29/2022 and spoke with licensee designee/multi-site program director Katie Nyberg and site supervisor Jordan Areaux. During the inspection, I observed three staff supervising and interacting with 27 school age children. Ms. Nyberg informed me that she does not have any concerns about the care and supervision staff provide children. According to Ms. Nyberg, staff did not witness Child A fall or crying that day. In fact, Ms. 3 Areaux overheard Child A tell his mother when she came to pick him up that he hurt his back while at his grandfather's house. Ms. Nyberg informed me that children trip and fall frequently. Staff write up incident reports when there is an injury. Ms. Nyberg is not aware of Child A having any visible injuries this summer. Ms. Nyberg stated that the children took a field trip to a small amusement park at Dutch Village in Holland this summer. Each ride had a height requirement and Child A and Child B only went on rides where they met that requirement. There was one student that did not meet the height requirement, therefore, a staff member rode with that child. Ms. Areaux stated that she overheard Child A telling his mother that he hurt his back while at his grandfather's house the night prior. Staff did not witness Child A fall while doing a cartwheel at the child care center. Ms. Areaux provided me written incident reports involving Child A. Child A fell and hit his head on the floor on 6/24/2022 and fell off his bike on 6/28/2022. Both incident reports were signed by a parent. Ms. Areaux recalled calling Child A's Mother about the 6/24/2022 incident as well. Ms. Areaux concurred that Child A and Child B met height requirements to ride the ferris wheel without an adult chaperone. I received a copy of the SAFE Parent Handbook from Katie Nyberg via email on 8/1/2022. The handbook stated that in case of injury, parents will be notified. Based on the severity of the injury, first aid will be given and a written accident report will be completed. Parents will be notified by phone immediately after any head injury or injury that SAFE staff believes requires additional or professional care. Parents will be notified of more minor injuries upon pick-up. I spoke on the telephone with Child C's Mother, Child D's Mother and Child E's Mother on 8/9/2022. None of the parents expressed any concerns regarding the care and supervision provided at the child care center. All injuries were reported to them by the child care staff.

Child A and Child B's Mother informed me that she provides the child care center sunscreen for her children. Although she reminded staff daily, sunscreen was not applied to her children for the first two weeks of summer care and have been inconsistent ever since. At one point staff lost the sunscreen she provided them. Child A and Child B did not have any significant sunburns while attending the program. Katie Nyberg and Jordan Areaux informed me that parents provide sunscreen for their children. Children are reminded to grab their sunscreen and to bring it with them when they go outside to play. If children need help applying the sunscreen, they are told to meet staff at the picnic table for assistance. Ms. Nyberg said that staff are not responsible for the sunscreen as it is stored in children's backpacks. Child A and Child B did lose their sunscreen and their mother brought in a new bottle 5 a few days later. Neither of them have ever observed Child A or Child B with a sunburn. Child C's Mother, Child D's Mother and Child E's Mother informed me that they provide sunscreen for their children. None of their children have been sunburned while in care.
