R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On September 15, 2023, I interviewed Melissa Maggard, Licensee Designee and Program Director. Melissa Maggard reported that on September 14, 2023, Child A (male, age 3) was left unattended in the Preschool Classroom for approximately ten minutes. Child Care Staff Member (CCSM 1) took a group of children outside and Child A was accidently left sleeping in the classroom. When CCSM 1 alerted Melissa Maggard that Child A was in the Preschool Classroom, she immediately went to the classroom and observed Child A asleep on his cot. Child A was woken up by Melissa Maggard, taken to the bathroom and given a snack. Child A was not injured and remains enrolled at the facility. On September 18, 2023, I completed an unannounced onsite inspection at the facility. I interviewed Melissa Maggard. On September 15, 2023, CCSM 1 knocked on the window of the Infant Classroom and indicated she made a "big mistake," she left Child A asleep in the Preschool Classroom by himself. CCSM 1 was working in the Preschool Classroom with CCSM 2. CCSM 2 had taken the school-aged children outside to another area to play. CCSM 2 left the classroom prior to CCSM 1 taking her group of children outside. CCSM 1 has not previously left a child care child unattended in the facility. When child care staff leave the classroom, they should be counting children before leaving and again when they get outside. CCSM 1 had approximately seven preschool age children and CCSM 2 had approximately eight school aged children. On September 18, 2023, I provided technical assistance to Melissa Maggard regarding implementing a name to face check during transitions. The facility uses an application- based program which includes a built-in attendance sheet, which can be used for name to face. I also advised to consider placing a white board on or near the door with the head count for the classroom as a visual reminder. On September 18, 2023, I interviewed CCSM 2. CCSM 2 was present at the facility on September 15, 2023, and was working with CCSM 1. CCSM 2 had taken the school- aged children outside to another play area before CCSM 1 left the classroom. CCSM 2 observed Child A asleep on his cot prior to leaving the classroom. His cot was located behind a shelf with different colored bins that was approximately 3-4 feet in height. On September 18, 2023, I observed that if you were standing near the classroom door Child A would not have been visible. CCSM 2 did not observe Child A unattended in the facility. CCSM 1 is great with the child care children, CCSM 2 does not have any concerns with the care and supervision she provides to child care children. On September 18, 2023, I interviewed Child A's Mother. Child A was asleep in the classroom on September 14, 2023, when he was left unattended while asleep. Child A was not injured and remains enrolled at the facility. The incident was promptly reported to Child A's Mother. She does not have any concerns with the care and supervision provided to Child A. 3 On September 19, 2023, I interviewed CCSM 1. CCSM 1 was working in the Preschool Classroom on September 15, 2023. She observed Child A asleep and knew he was in the classroom. The school-aged children returned from school and the classroom was a little chaotic. CCSM 2 told the children to line up to go outside. She only took the school aged children, leaving the younger children upset and crying. CCSM 1 had the remaining children line up to go outside. CCSM 1 thought she had accurately counted the children before going outside. After transitioning outside she realized Child A was left in the classroom and alerted Melissa Maggard. CCSM 1 indicated the incident was her fault and has never happened before. Child A was alone in the classroom for approximately 10 minutes.
On September 14, 2023, Child A (male, age 3) was left unattended for 10 minutes in the classroom by CCSM 1.

Ilk lit - 1179R it On April 28, 2022, Melissa Maggard, Program Director/Licensee Designee contacted the department to self-disclose an incident reported by a child care child. I) Ms. Maggard self-reported that Child A (female, age told Child A and B's Mother that Ms. Maggard hurt her at the child care. Child B (male, age ) is scared to return to day care, I advised Ms. Maggard to make a complaint o the Michigan Department of Health and Human Services (MDHHS). On May 2. 2022, I corn feted an unannounced onsite inspection at the facility. I interviewed Melissa Maggard Ms. Maggara s being accused of forcefully grabbing Child A by the arm on April 27, 2022 and sitting her on the wall. Ms. Maggard was in the classroom with Child Care Staff Member (CC M) 1. Ms. Maggard moved Child A from Child B when Child A took a book that Child B wanted back. Child A was given an alternate book by Ms. Maggard and Child A threw the book to the ground. Ms. Maggard moved Child A away and sat her on the wall, Child A was free to get up at any time and move. Ms. Maggard was trying to ensure safety of all child care children. She denied placing Child A in time out. Child A never said that her arm hurt and was playing normally. The facility provides discipline in a loving manner. Guidance is used to teach. Ms. Maggard stated that there was another allegation that Child A was hurt during nap time by Ms. Maggard. Ms. Maggard is generally not present during naptime. A date this occurred was not provided. Ms. Maggard has not received any previous parental concerns regarding discipline at the child care facility. On May 2, 2022, I interviewed CCSM 1 . CCSM 1 was present in the classroom with Ms. Maggard on April 1 did not see what happened, she was looking at an important text message on her phone from a family member. CCSM 1 heard Ms. Maggard tell Child A "We don't smack books." CCSM 1 heard Child A screaming. Child A screams when she is upset. CCSM 1 observed Child A sitting down crying on the wall. CCSM 1 was informed by Child A and B's Mother that Child B said he did not feel safe at the child care and did not want to attend. On April 29, 2022, Child A and B's Mother came to the child care facility and handed all the child care staff members whistle blower laws printed out. CCSM 1 has not had concerns with Ms. Maggard being aggressive, but she does not know when to step back and let someone else take over. CCSM 1 is not aware of any incidents between Child A and Ms. Maggard at naptime. On May 2, 2022, I interviewed CCSM 2 . CCSM 2 was in another classroom and outside on April 27, 2022 and did"oserve the incident between Child A and Ms. Maggard. CCSM 2 was informed by another child care staff member about the incident the following day. CCSM 2 does not have any concerns with Ms. Maggard being aggressive with child care children. CCSM 2 is not in the classroom with Ms. Maggard on a daily basis. CCSM 2 has not received any child care or parental concerns regarding Ms. Maggard. The facilities discipline policy is to redirect children when needed. Time out is not allowed in the infant and toddler classrooms. CCSM 2 has not observed children under 3 years of age placed in time out. On May 2, 2022, I interviewed CCSM 3 . CCSM 3 is a substitute at the program and is not often present. CCSM 3 does not believe that Ms. Maggard would ever hurt a child. CCSM 3 has never observed Ms. Maggard be aggressive with child care children. CCSM 3 was not present at the center on April 27, 2022. CCSM 3 has not received any parent or child care staff member concerns regarding Ms. Maggard. On May 2, 2022, I interviewed Child A and B's Mother. Child A was taken for a medical evaluation on April 29, 2022. During the course of the investigation Child Care Staff Members 5, 6, and 8 indicated that Ms. Maggard's takes child care children into the office for discipline. The office is not an approved child use space. On May 24, 2022, Ms. Maggard indicated she has taken out of control child care children into the office for the safety of other children.

On October 20, 2020 Melissa Maggard, Program Director/Licensee Designee, self- reported that Child A and Child B indicated to their mother that child care staff members are hitting them at the facility. Child A and Child B did not indicate which child care staff members were hitting them. Ms. Maggard is not aware of child care staff members at the facility inappropriately discipling child care children. On October 21, 2020, I completed an unannounced onsite inspection at the facility. I interviewed Melissa Maggard. Ms. Maggard has not observed child care staff members inappropriately discipling Child A and Child B. The use of physical discipline is not allowed at the child care facility and Child A and Child B have not disclosed to Ms. Maggard that child care staff members are hitting them. Ms. Maggard has not received any concerns regarding discipline at the facility from child care children or parents of enrolled children. Ms. Maggard denied she has used physical discipline on child care children. On October 21, 2020, I interviewed Child Care Staff Member 1. Child Care Staff Member 1 has not observed child care staff members hit Child A and Child B. Child A and Child B have not disclosed to Child Care Staff Member 1 that they were hit at the facility. Infant and Toddler age children are redirected, and older children may have to sit down long enough to regain control. The facility does not use physical discipline or corporal punishment. Child A sometimes throws a temper tantrum and tends to kick her feet at people including infants. Child A has been helped by picking her up and moving her to another place in the room to calm down. Child A is not restrained and can walk out of the area at any time. Child Care Staff Member 1 denied she has used physical discipline with child care children. On October 21, 2020, I interviewed Child Care Staff Member 2. Child Care Staff Member 2 has not observed child care staff members use physical discipline with Child A and Child B. Child Care Staff Member 2 has not observed the use of physical discipline against any child care child. Child care children have not disclosed to Child Care Staff Member 2 that they were hit by a child care staff member. Child care staff members may use words to help children calm down, such 3 as "stop" or "don't do that" if needed to keep situations safe. Child Care Staff Member 2 has not used physical discipline at the child care facility. On October 21, 2020, I interviewed Child Care Staff Member 3. Child Care Staff Member 3 has not observed the use of physical discipline with Child A or Child B. The facility does not use physical discipline with child care children. Child J (female, age 4), told Child J's Mother she was grabbed on the arm by Child Care Staff Member 6 in April of 2020. Child J was trying to pull away. Child Care Staff Member 3 has not used physical discipline on child care children. On October 21, 2020, I interviewed Child Care Staff Member 4. Child Care Staff Member 4 has not observed Child A or Child B be physically disciplined at the facility. Child Care Staff Member 4 has not observed child care staff members physically discipline child care children. Children are spoken to regarding their behavior and removed from the situation to calm down if needed. Child Care Staff Member 4 has not used physical discipline on child care children. Child care children have not disclosed to Child Care Staff Member 4 that they were hit by a child care staff member. On October 21, 2020, I interviewed Child Care Staff Member 5. Child Care Staff Member 5 has not observed the use of physical discipline on Child A or Child B. Child care children have not disclosed to Child Care Staff Member 5 that they were hit by a child care staff member. Child Care Staff Member 5 has not used physical discipline on child care children.
