(4) A licensee, licensee designee, or program director shall submit a written report to the department of the occurrences outlined in subrules (1), (2), and (3) of this rule, in a format provided by the department, within 72 hours of the verbal report to the department.
On May 20, 2022, I received a complaint stating that Child A was left outside by child care staff member Alexandria Rochon on May 19, 2022, when his classmates went inside from afternoon recess. Child A was not discovered until an unnamed staff member was leaving at 4:30 pm and noticed him on the playground by himself. It is unknown how long Child A was outside unattended. The playground area is fenced but has gates that people come and go from Laker Elementary. On May 23, 2022, I interviewed the complaint source. Program Director Janet Rooney was gone during the day on May 19, 2022, and Child A was left outside. Ms. Rochon was the child care staff member who was watching Child A's classroom. The school building has cameras, and the complaint source believes that Child A may have been outside alone from 3:30 pm-4:30 pm. The complaint source is not sure which other child care staff members were present. The afternoon was very busy at the school with lots of activities and traffic in the parking lot. The playground is only fenced on three sides and a child could leave the area. The complaint source is not aware of any injuries to Child A. On May 23, 2033, I completed an unannounced onsite inspection at the facility. I interviewed Janey Rooney. Ms. Rooney was not present on May 19, 2022, when Child A was left outside. Ms. Rooney was also not present on May 20, 2022. Ms. Rooney did not report the incident to the department because she was out of town. Child A was taken outside by Kaitlin Brown, child care staff member after snack which was around 4:00 pm. Between 4:20 pm and 4:30 pm. Ms. Rochon came outside for Ms. Brown to go home for the day. Shortly after this time Ms. Rochon brought the preschool classroom inside the building. Ms. Rooney believes less than 10 preschool aged children were present and Child A was outside less than five minutes alone. Child A was not injured during the incident. Ms. Rooney denies that Child A was left outside for an hour. The classroom does not go outside until after snack is completed which is around 4:00 pm. Ms. Rooney did not speak to Child A's Mother regarding the incident on May 19, 2022, until May 23, 2022. Ms. Rochon left for the day before Child A was picked up on May 19, 2022. Child A was picked up on May 19, 2022, by Child A's Grandparent. Child A's Grandparent was not informed of the incident at pick up. On May 23, 2022, I interviewed Kaitlin Brown. On May 19, 2022, Ms. Brown was working in the preschool classroom and Ms. Rooney was out of town. Ms. Brown took the preschool children outside following snack around 4:00 pm. When the classroom initially went outside 9 children were present, and quickly dropped to 7 preschool aged children. Ms. Rochon came outside around 4:15 pm, after cleaning the preschool classroom. Child A was sitting next to Ms. Brown on the bench when Ms. Rochon came outside. Ms. Brown is not sure how Ms. Rochon did not see Child 3 A. Ms. Brown went inside to gather her items to leave for the day. During this time, she went into the Infant and Toddler classrooms and eventually went to leave the building. While Ms. Brown was gathering her things and preparing to leave Ms. Rochon brought the preschool classroom inside. Which was around 4:20 pm to 4:25 pm. When Ms. Brown went to leave a group of known children were at the door to the building with Child A, saying he was outside. Child A was not crying and did not have any visible injuries. Ms. Brown took Child A into the preschool classroom and told Ms. Rochon that she had left Child A outside. Ms. Rochon was not aware that Child A was left outside. Following this Ms. Brown left for the day. Ms. Brown has only briefly worked with Ms. Rochon, and it was during naptime. Ms. Brown has not worked with Ms. Rochon on an extended basis. Ms. Brown is glad there was a group of non-child care children outside who brought Child A to the door. Part of the playground is unfenced, and Child A could have left the area. On May 23, 2022

On February 2, 2021, the center self-reported to licensing that a child had been left outside on the toddler playground for a short period of time. On February 5, 2021, I received a message from Child A's Mother she had no concerns about supervision at the center. She stated that she was not overly concerned as the courtyard is fully enclosed and did not think Child A was ever in danger. On February 8, 2021, I made an unannounced onsite inspection to the child care center. I spoke with the program director, Janet Rooney. Ms. Rooney was in the Preschool room at the time of the incident and did not observe it. The incident occurred in the Toddler Room, which serves children ages 1 to 3 years of age. The Toddler Room 1/2 has their own playground in the school courtyard and a door in this classroom leads directly to the enclosed courtyard. Child A's mother was notified of this and Child A continues to attend the child care program. While at the center, I interviewed Toddler Room lead caregiver Missy Guster. Ms. Guster stated that on February 2, 2021, she was working with child care staff member, Tara Prill. There were 8 toddlers present in the classroom. Between 10:30am and 11:00am on February 2, 2021, the classroom was coming in from the courtyard. She and Ms. Prill were helping children remove their winter clothing. She remembered seeing Child A right by the door when they were in the classroom. A few children were crying so they were tending to these children as well. They were just going to circle time after removing all the children's winter clothing, when a teacher at the school, Michelle Ribling, came to the classroom door and said, 'you have one outside". When she opened the door to the courtyard playground, Child A was by the wall playing. She estimated that Child A was outside unattended for approximately two minutes. Ms. Guster stated that she could not believe that this happened as they are always counting children. She confirmed that Child A continues to attend the child care. While at the center, I observed the courtyard playground. The courtyard is walled by the school building on three sides. There is a fence on the side of the courtyard that is not enclosed. There were no hazards observed in the courtyard. On February 9, 2021, I interviewed child care staff member, Tara Prill,by telephone as she was not present at the time of the February 8, 2021 onsite inspection. She stated that on February 2, 2021, they had all 8 children by the door of the courtyard to come inside. She remembered seeing Child A "right there" but then was helping another child with their winter clothing. She stated that they had just gotten the children's coats off and were heading to the carpet for circle time when teacher Michelle Ribling came to their classroom door and let them know a child was still outside. She stated that Ms. Guster immediately went and brought Child A back in to the classroom. Child A appeared to be happy when she came back into the classroom. She estimated that 3 Child A may have been outside unattended for 3 to 4 minutes. She stated that this has never happened before. On February 12, 2021, I spoke to Michelle Ribling as part of the investigation. She stated that she was in the hallway and noticed Child A outside in the courtyard. She immediately went to the classroom and informed them. She said it looked like the class had just come inside from being outdoors. Child A was immediately brought back into the classroom. Ms. Ribling stated that Child A appeared to be fine and was never in danger on the playground.

On 11/12/2020 during an unannounced onsite inspection I spoke with Ms. Jill Verberg, principal of Laker Elementary. She stated that she did not witness the incident however, there is a video of the event. She stated that the camera is not located in an ideal area because the Head Start playground is in the foreground and the Pigeon Children's Discovery Center's playground is in the background. Ms. Verberg did allow me to view the video. The incident was approximately 30 seconds of Ms. Rooney talking to Child A. Ms. Rooney placed both of her hands on each facial cheek of Child A. She then pulled his head up so that he was face to face with her as she bent over. She then took Child A by the hand and pulled his hand over his head while the other children got into line to go back into the building. Unfortunately, there was no audio with the video. During the unannounced onsite inspection, I spoke with Ms. Janet Rooney regarding the allegation. She stated that while the children were outside on 11/9/2020, Child A continually threw the pebbles located on the playground at other children despite continuous redirection. She stated that she finally went over to Child A and in order to get his attention she did put her hands on his face so that he would look at her. She denied that anything she did during the incident was inappropriate. I told her that we would recommend that she get down to the child's level by squatting down so that you are face to face with the child in order to get their attention. She stated that she did get down to Child A's level. I then corrected her and stated that you really brought his attention up to your level by putting your hands on his face and lifting his head to look at you. Ms. Rooney stated that her assistant, Ms. Beth Krenz, is currently out on sick leave but did provide me with her contact information. Ms. Cindy Dietzel is currently taking over as her assistant with Ms. Krenz is out. On 11/12/2020 I spoke with Amanda Gorsegner, assistant staff member who stated that she was not out on the playground during the incident because she was inside the building getting lunch ready for the children. She stated that she has never witnessed Ms. Rooney being inappropriate with the children. On 11/12/2020 during the onsite inspection I spoke with Cindy Dietzel who has been an assistant for eight years and has worked with Ms. Rooney during the time of the incident. She stated that Ms. Rooney went up to Child A to get his attention because he was not listening and was continuing to throw stones on the playground. 3 She did not think that anything Ms. Rooney did during the incident was inappropriate and denied that she has ever witnessed Ms. Rooney engage in any inappropriate behavior when it comes to the children at the center. She stated that she has a relative who is in Ms. Rooney's classroom and that she would not for one minute allow her relative to be in the classroom if she thought that Ms. Rooney was inappropriate with the children. During the onsite inspection I did observe the children and Ms. Rooney interact in the classroom and did not witness any inappropriate behavior and the children appeared to be engaged and interacted well with Ms. Rooney. On 11/17/2020 I spoke with Child C's Mother who stated that she has no issues or concerns with the care and supervision that Child C (3-year-old, male) receives while he is at the center. On 11/23/2020 I spoke with Child A's Mother who stated that she and Ms. Rooney had spoken about the complaint and she stated that she has no issues or concerns with the care and supervision that Child A (4-year-old, male) receives while he is at the center. On 11/25/2020 I spoke with Child B's Mother who stated that she has no issues or concerns with the care and supervision that Child B (3-year-old, male) receives while he is at the center.
