    On 01118/20231 received a phone call and a completed incident report form from Program Director, Ann Robb. Ms. Robb informed me that an allegation of inappropriate contact between Child Care Staff Member (CCSM) A and Child A was made. She stated it occurred in the Great Start Readiness Program (GSRP) classroom. A specific date and time were not available. Ms. Robb said she was made aware of the allegation on 01/18/2023 when CCSM B informed her that she received a call from Child A's Mother the evening before. 3 (Co-lead, GSRP staff) in the classroom. Child A's Mother asked Child A if CCSM A and Child A replied, "Yes." Child A's Mother stated that Child A said n CCSM B was out of the classroom and while she played under a table or near the couch. No other information was provided. On 0111812023, Ms. Robb met with CCSM A briefly. He was placed on administrative leave pending an investigation. Child A is enrolled in the GSRP program Monday through Friday. CCSM A, CCSM B, and CCSM C all work in the classroom on a daily basis. On 01/18/2023 l interviewed Child A's Mother. She stated, on Friday, 01/13/2023, while they waited for Child A's sister to be dismissed from the Middle School, Child A told her that she was playing with her friends, and CCSM A "kept messing with me." Child A's Mother stated this meant bothering her. Child A told her mother that CCSM A and demonstrated the at least twice. Child A's Mother asked if CCSM A hid A responded yes and i s Mother said Child A said, "Mom, I am telling you the truth." Child A's Mother is unsure when it occurred but said Child A stated that CCSM B was out of the classroom at the time of the alleged incident. Child A's Mother said that she always asks both of her children how their day (at school) was and asks them if anyone was "messing with them," but she did not ask Child A on 01/13/2023 because it was not a school day. Child A's Mother was concerned with the allegation and reached out to CCSM B to inform her of what Child A said. Child A's Mother said that CCSM B was made of aware of the incident on 01117/2023. CCSM B told Child A's Mother that she was very surprised about the allegation. CCSM B spoke to Child A on the phone. Child A repeated her statement regarding to CCSM B. Child A's Mother asked for a meeting with CCSM A, however, Ms. Robb stated that she needed to contact the human resources department to determine how to proceed. On 01;23/3023, I completed an unannounced, onsite inspection at OES Child Care Programs in Oxford. I interviewed CCSM B, CCSM C, and Ms. Robb. CCSM B has worked with CCSM A for the last nine years. CCSM C works in the GSRP classroom as a third staff member. She covers lunch breaks, time off, and provides support during lunch time. CCSM C has worked at OES for the last 6 months. CCSM B is listed as Child A's primary care provider. CCSM B stated that she did not observe CCSM A~ Child A in an andthat Child A did not tell her that CCSM A 'messed with her," or that prior to the phone call on 01/17/2023. CCSM B said she received a phone call from Child A's Mother on 01117/2023. During all, Child A's Mother told her that Child A said that CCSM A Child A's Mother put Child A on the phone. Child A RM CCSM A Child A was not able to recall the date or tim day, however. CCSM B concluded that the alleged incident must have CI happened at lunch because Child A told her that she was not in the classroom at the time of the incident. CCSM B said the only time that she is out of the room is during lunch prep. Child A stated she told CCSM B that CCSM A when it happened; however CCSM B indicated that did not happen. i id not tell her that CCSM A~ CCSM B said that when she is out of the room to get the lunch cart, CCSM C is in the classroom with CCSM A. There is always at least two staff members in the classroom. CCSM B stated that she has never observed CCSM AM children in She said CCSM A is not very physical with children. CCSM B said Child A will give high-fives or fist

    On 09/29/2022 1 contacted Program Director, Ann Robb at Oxford Early Learning Center on an unrelated issue. At this time, Ms. Robb informed me that incident occurred earlier in the day that she needed to report. She stated Child A was found unattended outside of the child care facility. On 09/29/2022 I received a written incident report detailing the following: On 09/29/2022, Child Care Staff Member, Pat Brauer observed Child A standing on a sidewalk, near the parking lot outside. She did not recognize the child and asked, "Where is your mom?" He pointed to the building. Ms. Brauer brought him inside and asked another staff member if she recognized the child. The child was identified as a student in the GSRP classroom. He was returned to his classroom. Ms. Brauer questioned staff members, Zachary Comerford and Melanie Ganz. Both staff stated the door of the classroom was left open while Ms. Ganz cleaned up lunch. Both staff were unaware that Child A was missing from the classroom until he was returned to the room. Surveillance shows that Child was outside of the building from 12:59 pm to 1:01 pm. On 10/05/2022 I completed an unannounced onsite inspection. I interviewed Ann Robb and Child Care Staff Members Zachary Comerford and Melanie Ganz and observed video footage of the incident. Ms. Robb confirmed that Child A is enrolled in the 4-year-old, Great Start Readiness Program (GSRP) and that Mr. Comerford and Ms. Ganz work daily in that classroom. Ms. Ganz and Mr. Comerford are co-lead staff members. Ms. Robb reiterated that Child A was located outside of the child care building on 09/29/2022. She was informed of the incident immediately after it occurred. Within an hour of the incident, Ms. Robb met with 3 Ms. Brauer, Ms. Ganz, and Mr. Comerford to discuss the incident and strategize next steps. Ms. Ganz and Mr. Comerford told her that Child A rested on a small couch in the classroom while all other children sat in the book area. She said the small couch is across the room from the book area and faced away from the book area. Mr. Comerford read books to 13 children while Ms. Ganz cleaned lunch. She took the garbage out to an area just outside the classroom door and emptied a milk bucket into a sink located approximately six feet from the classroom door. Neither staff person observed Child A walk out of the classroom and were surprised when Ms. Brauer returned him to the classroom. Together, Ms. Robb, Ms. Brauer, Ms. Ganz, and Mr. Comerford contacted Child A's Mother by phone. Ms. Ganz and Mr. Comerford informed Child A's Mother that Child was found unattended, outside of the building by Ms. Brauer. Child A's Mother was grateful he was found unharmed. She stated that Child A has attempted to leave the house too, when he is home, and asked for strategies that may help prevent him from leaving. On 09/30/2022 Ms. Robb met with Ms. Ganz and Mr. Comerford for a second time. During this meeting Ms. Robb informed Ms. Ganz and Mr. Comerford that this was a very serious incident, and a disciplinary action was placed in their staff file. The disciplinary action indicated that both staff failed to provide appropriate care and supervision. At the meeting, Ms. Robb, Ms. Ganz, and Mr. Comerford collectively determined the following strategies would help prevent Child A from leaving the classroom and were implemented immediately. • Doors will remain closed • Stop sign on the door will provide a visual aid for Child A • Discuss classroom rules at Morning Meeting with all children • Bring cots and food into the classroom rather than leaving the classroom for those items • Turn the couch around so it faces the rest of the group • New bathroom policy added (children will go as a group/one staff will remain in the room the other will take the group to the bathroom/the bathroom is located outside of the classroom) • Bells will be added to door as an audio aid to alert staff if someone is entering or exiting the room One strategy included child safe

    On April 18, 2022, program director Ann Robb called me to report the incident. She sent an incident report that contained the below information which is paraphrased below. After lining up to go indoors, Ms. Kim asked children to go clean up the balls. The children left the line to do so and [Child A] hid under the play structure. After lining up again, the class went inside. While putting the coats away, Ms. Kim noticed that [Child A] was not with the class. Ms. Kelly went outside with Ms. Laura and found [Child A] standing under the play structure. Ms. Kelly hugged [Child A] and they returned to the building. Child A said he did not want to go in but was told that it was time to go inside and was returned to the building by staff. 2 I interviewed Kimberly Detloff on April 21, 2022. Her account of the incident was consistent with the contents of the incident report. She explained that she had done a head count when she first had the children lineup, but not again after they had lined up a second time after they went to retrieve the balls. She expressed regret about the error and said it was the first time that had happened. She estimated Child A was located within a couple of minutes. She promptly notified Child A's mother of the incident. The playground is fully fenced. I interviewed Kelly Jones on April 27, 2022. Her account of the incident was substantially similar to what Ms. Detloff reported. She also stated that the error was due to the lack of a second head count after children had left the line. As soon as they had returned to the classroom, they realized Child A was missing. She and another staff member, Ms. Laura, ran outside and found Child A standing on the playground. He was not crying. It was the first time anything like it had ever happened. She estimated he was unattended by staff for two to three minutes. I interviewed Child A's mother on May 4, 2022. She received prompt notice of the incident. Staff handled it fine and promptly called her. Child A remains enrolled at the center.

    Licensee designee and program director Ann Robb sent an incident report to me on 02/15/2022 to report that a child care staff member (CCSM), Rebecca Sioma, spanked a child on 02/14/2022. Ms. Sioma told the other staff members who work in Room 8 what she had done, then reported it to office staff member, Pat Brauer in Ms. Robb's absence. Ms. Robb completed the incident report. The verbatim contents appear below. I asked Ms. Bauer to read the incident report during my visit. She said it accurately captured what Ms. Sioma had told her on the day it happened. Rebecca works as a breaker in Room 8; Blue multi-age classroom at the Oxford Early Learning Center. At clean up time, around 11:50 a.m. she noticed [Child A] in the Discovery Area in the classroom and observed him beginning to have trouble with another child. She approached him, took him by the hand and began to guide him to another area in the classroom. As they were walking, he tried to yank his hand out of hers and he dropped to the floor. She then used both hands 2 to support him getting up and walking. While she was attempting to get him up, he punched her in the stomach ([Child A] has shown aggressive behavior in the past; "teachers" are working with him and the parents to help him overcome some of the aggressiveness. Rebecca then took [Child A] by the hand again and during this time he used her hand to push his mask down and he attempted to bite her. At that moment Rebecca gave [Child A] a spank on the bottom. Rebecca told the "teachers" in the classroom at 12:00 and self- reported the incident to an OELC office staff member at 12:50 p.m. Rebecca told Kim Detloff, one of the "teachers" in the classroom at 12:00 and then Kelly Feld, the other "co-teacher" at 12:10. They told her that she needs to report it to an office staff member and at 12:50 Rebecca reported the incident to Pat Brauer. Pat contacted [Child A's mother] at 2:30. CCSM Kimberly Dettloff was in the classroom when the incident occurred. She said she did not see or hear anything that happened. Ms. Sioma immediately told her that she spanked Child A. Child A was not crying. Ms. Dettloff told her she needs to report the matter to management. She said Ms. Sioma is good with the children and has not witnessed her interact aggressively with them. She has made recommendations to her regarding verbiage with children. Rather than telling them what to do, help them make better choices. CCSM Kelly Feld said she was not in the classroom when the incident occurred. She said Ms. Sioma reported it to her when she returned from her break. She has never seen Ms. Sioma hit a child or act aggressively in any physical way. The news was unexpected. She enjoyed having Ms. Sioma in the room and said she was mostly good with the children and very involved. She did make suggestions to Ms. Sioma, who was new to working with younger children, regarding how to speak to them - "Use walking feet" versus "Don't run," and to be aware of the volume of her voice to keep the classroom calm. I interviewed Ms. Sioma by phone on 02/17/2022. Her account of the incident was substantially similar in content as what was provided in the incident report. She said Child A punched her in the stomach harder than usual that day when she stood him up during the incident. When he attempted to bite her, her "Mom brain" kicked in and she tapped him on the butt. She did it softly with an open hand. Child A froze for a second but essentially had no reaction. He did not cry and continued to play. She has resigned. She loved working with the children and learned a lot from the other staff members in the classroom. She self-reported what she had done to all relevant people and was apologetic about the incident. 3 I interviewed Ms. Bauer at the center. She mentioned often doing classroom observations to see staff interact with children. She had not had much opportunity to observe Ms. Sioma, in part due to schedule interruptions related to school closings. She did
