On 08/18/2022, an unknown female lead caregiver and another female child care staff member in the toddler classroom were walking down the hall with the toddler class. The lead caregiver was making the children walk behind her. When one female toddler walked in front of the lead caregiver, the lead caregiver grabbed the toddler's arm and jerked her back. The child fell and had to be picked up. She started crying. They continued to walk, and the lead caregiver grabbed a second child by the arm and jerked her back causing her to cry too. The children did not know the verbal command that they were given due to their age and level of development. On 08/18/2022 between 9:30 a.m. and 11:00 a.m., a male child in the preschool classroom was screaming and emotionally upset because the lead caregiver grabbed him by the arm and dragged him to the bathroom while saying "you're going in here to urinate, you're going to urinate." The child was screaming, "stop, owie" repeatedly. This went on in the bathroom for at least 5 minutes. About 30 minutes later, another child care staff member came busting out of the preschool classroom while the same preschooler was sobbing, crying, and screaming. The child care staff member went into the child's cubbie to grab clothes and threw them at the child in the room. It is suspected that he soiled himself and needed to be changed.

On November 21, 2022, licensee designee and program director, Ms. Mary Jo Pouillon, called and self-reported an incident that occurred earlier that day to the department. She completed an incident repoorrtt on November 23, 2022. According to the report, child care staff member , was sitting at the sensory table playing with a (child), turned her head to the right while scanning the room and witnessed 4 'f2 years old) and Child B 4 years old on top of the stairs of the loft. Child B's 1/T and Child A The action was stopped immediately. Upon discussion with the boys, Child A stated, "Child B Child A agreed that he did. I interviewed Ms. Pouillon, and child care staff members, _ ■ separately. U Ms. Pouillon said she was working in the kitchen when the incident occurred. came to the kitchen and told her that Child A and Child B were playing on "Opp e loft. was sittin at the bottom of the loft when she saw Child A Child s stopped the children and spoke to them about the incident. According to Ms. Pouillon, both Child A and Child B told ■ that they have never done this before. Ms. Pouillon said she asked to contact and inform Child A and Child B's families about the incident witnessed it. Ms. Pouillon said after 2:00 P.M., after she was done cooking in the kitchen, she messaged both families in ProCare and apologized for the incident. She informed both families that she was available to speak to them regarding the incident. The child care center uses the ProCare app which tracks supervision, attendance, and daily records. Ms. Pouillon said she saw Child A's Father during pick up time around 4:00 P.M. She spoke with Child A's Father briefly but he did not appear like he wanted to talk about the incident. Child A's Father confirmed that he received the phone message and left. Ms. Pouillon said she met with Child B's Father the next day on Tuesday, November 22, 2022. According to Ms. Pouillon, Child B's Father said he felt like a bad parent. Child B has two older siblings and they were very diligent about teaching therm 3 Child B's Father feels like he dropped the ball with Child B because they were not as diligent with Child B. Ms. Pouillon said Child B's Father requested that Ms. Pouillon call and speak with Child B's Mother. Child B's Father said Child B's Mother is having a hard time with the whole situation. Ms. Pouillon said she called and spoke with Child B's Mother on Wednesday, November 23, 2022. According to Ms. Pouillon, her conversation with Child B's Mother was similar to Child B's Father. Child B's Mother said Child B goes to child care and comes home: Child B does not go anywhere else. Child B's Mother does not know where he would have learned that type of behavior. Ms. Pouillon said she was concerned regarding and was worried that someone had done something to either Child A or Child B. I interviewed who said she was in the classroom when the incident occurred. After the interviews were completed with the child care staff members, Ms. Puillon stated has received discipline in the past for similar allegations and has received training regarding appropriate behavior with children. It is possible that employment with the center will be terminated due to continued issues with inappropriate behaviors with the children. On 08/1912022, 1, along with Ms. Brown, interviewed at the center. She said she is a lead caregiver in the Bouncing Bees toddler classroom. She corrects the children's behavior by talking to them and redirects them. She and Ms. Minor took the children to the gym to play around 10:30 a.m. None of the children were acting out, however, they were excited to get to the gym to play. Child A, Child S, and Child C tried to run to the gym. She grabbed Child B's hand and had him stop. He did not fall. She grabbed Child As hand, too, and she did not fall. She initially said she did not think she had to jerk the children but then said she did not remember if Child A fell, and she stated again that she did not think she jerked Child A. She believed it was possible that she had been a little rough with the children but did not realize it at the time. The children did not complain of injuries and they were not crying when they were walking. She denied jerking Child C. sometimes takes the children by the hand and slows them down when they are walking ahead of her. She denied ever dragging a child. She does not remember any training she has received about physically managing children. She admitted to receiving discipline years ago because someone reported that she yanked a child but denied yanking the child. The child was about to fall so she grabbed the child. On 0911912022, 1, , interviewed Ms. Minor at the center. She said she is a child care staff member in the Bouncing Bees toddler classroom. She did not recall a specific child having any issues on 08/18/2022, however, around 12:00 p.m. Child D had an accident and needed his pull up changed. Child D's mother was present when his pull up was being changed. Child D has difficulty speaking and he has . He does not like to use the toilet and screams when they tell him he has to use the toilet. He screamed on 08/18/2022 when he had the accident. She could not recall if she had to change Child D's clothes on 08/18/2022. She stated she has become frustrated with some of the children in the past, however, she will walk away or leave the room to take a break. She denied throwing clothing at Child D or throwing clothing at any other child. She did not see Ms. Woods, who was working with her in the classroom, throw clothing at Child D or at any other child. If a child needs to be changed in the bathroom, one staff is in the bathroom while the other staff stays in the classroom with the other children. Ms. Woods began her shift earlier than her and she did not report any issues with the children. She denied yelling at Child D or at any other child and denied hearing Ms. Woods yell at Child D or at any other child. She stated she has raised her voice to get the children's attention. She denied grabbing Child D's arm and said she only held his hand when they walked to the bathroom. She did not know if Ms. Woods grabbed Child D's arm because their room is very busy, and she does not watch Ms. Woods because she is watching the children. Child D went home early due to illness. On 08/19/2022, I, , interviewed Ms. Woods at the center. She said she is a lead caregiver in the Busy Bee preschool classroom. When disciplining the children, she uses redirection, and a child will sometimes have to be removed from the classroom if the child is hurting other children. Child D and Child E had a ®rouhn da on 08/18/2022. She has spoken to Child D's parents concerning because he does not function as a typical 3- or 4-year-old Fe screams Pen people get in his space. She will sometimes have to use a firm tone with Child D telling him to calm down or will use a firm voice with the children when the class gets too loud. She denied saying, "You're going in here to urinate, you're going to urinate." She also denied grabbing him by the arm and dragging him to the bathroom. She held him under his armpits because he was resisting to go into the bathroom. She continued to say, "Come on, we have 7 to keep walking." Child D will sometimes say, "Owie, you're hurting me" when he is sitting next to other children, and no one is touching him. Child D went home early due to illness. Child E will sometimes have explosive meltdowns when he does not get his way. He had a couple of meltdowns on 08/18/2022. On July 13, 2021, I called and spoke with Child A's Mother. Child A's Mother said she received a message from program director, Ms. Mary Jo Puillon on July 12, 2021. Ms. Puillon informed her that Child A (female, 11 years old) used words such as "suck" and "freaking" while at the child care center. If Child A's behavior and use of inappropriate language continues, Ms. Puillon wanted Child A to clean the bathrooms with the janitor, Mr. Fred Delcamp. Child A's Mother spoke with Child A and confirmed that Child A did not clean the bathroom today. Child A's Mother said she and Ms. Puillon exchanged text messages regarding the incident. On July 13, 2021, I received the text messages between Child A's Mother and Ms. Puillon. "Ms. Puillon: Hello parents, I just wanted to let you know I had a talk with your children today about the way they are talking while at NACC. They are using inappropriate language such as referring to other people as trash, saying things suck, saying damn while losing at games among other things. I let your child know that their consequence for such potty language will be assisting Mr. Fred in cleaning bathrooms from now on. I have younger children in class with them going home and repeating words and some who are now afraid of coming to NACC because of the oldest kids. This is a non-negotiable consequence to this continued behavior. Further inappropriate behavior will result in formal write-ups and probationary periods." "Child A's Mother: So since she's going to be stuck cleaning bathrooms what about these field trips that she's supposed to be going on is she not allowed to do the field trip seether" "Ms. Puillon: I didn't say anything about field trips. Would you like that to be a consequence for her, as well?" "Child A's Mother: No but I don't think it's appropriate to have them clean toilets with the janitor. I don't want my daughter using chemicals." 3 "Ms. Puillon: Then all she needs to do is change how she talks while here. That's a much easier solution". "Child A's Mother: Okay well then I will be having a talk with her tonight about the way she talks so she is not having to clean toilets with a janitor then" "Ms. Puillon: That would be great. Thank you!" "Child A's Mother: Is your building up to date with your MSDS sheets" "Ms. Puillon: Also, I can have Mr. Fred get baking soda and vinegar for the children to work with, if needed." "Child A's Mother: Well if I have a talk with her tonight I am not going to let her clean bathrooms at all to me that is disgusting especially with COVID going on I don't even allow her to clean bathrooms at home" "Ms. Puillon: Then if the behavior continues it will result in an immediate expulsion from the program. These behavior/attitude issues have been going on for 2 years while I have been here and I no longer have the means to coddle it. Staff are quitting, other parents are thinking of pulling their children out of the program, and I have used every other tactic I have. I will no longer allow this behavior to continue." On 10/23/2020, 1 received a phone call from Program Director Mary Jo Pouillon and she stated that she was informed by Child A's mother that Child A is in and while there he disclosed that Child B had shown him his penis while at nap time in the GSRP classroom. The timeframe of when this could have happened was unknown. Child A did not state if this was something that happened recently or in the past. Child A will no longer be attending the center physically but will start a virtual classroom next week. Ms. Pouillon stated she will send over the incident report. A few minutes later, I received the incident report via email. On 10/27/2020, I made an unannounced onsite inspection at Noah's Ark Children's Center, and I interviewed both GSRP staff members Tami Williams and Lilly Townsend. My first interview was with Ms. Williams, and she stated that she does not believe that anything ever happened between Child A and Child B in the classroom. She stated that for the past month, the children no longer go to the bathroom without a staff member with them and are never unsupervised in the classroom or any rooms in the building. She stated Child A and Child B do play together and have known each other for a while since they both went to a previous child care center together prior to Noah's Ark. Ms. Williams stated she was informed that Child A and Child B may have had a previous incident happen while at that center but is unsure what the incident was. She was recently informed by Child A's mother that she was worried about Child A and Child B playing together again at this center. Ms. Williams stated she has never had any issues or incidents happen with Child A and Child B during nap time or throughout the day. She stated Child A lies on a mat right next to her desk at rest time and Child B is across the room. Child B falls right asleep at nap time and never has to be spoken to at this time. Ms. Williams stated that Child B has never acted out sexually or inappropriately touched any child or himself in class. She stated that due to Child A having a history of acting out inappropriately in the past, they keep an extra eye on him all day to make sure nothing happens with him. Next, I spoke to Ms. Townsend and she stated Child A naps next to Ms. Williams' desk and is at the completely opposite end of the classroom as Child B. She stated Child B has never pulled out any of his private areas in class or during nap time. On 11/07/2020, I spoke to Child A's mother via telephone.
