  R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

  On 08/03/2023, and I made an onsite inspection at Child A’s Fathers home. Child A’s Father denied ever seeing or hearing Mrs. Fuller pick on, tease or talk down to a child. He stated he feels Mrs. Fuller is always relaxed and kind to all the children. Child A’s Father stated Mrs. Fuller would never encourage another child to make fun of another child. He stated that he has known Mrs. Fuller his whole life and has never heard her speak like that to anyone. Next, we made an onsite inspection at Mrs. Fuller’s home. Mrs. Fuller stated this is “ridiculous” to say that she or Adult Household Member has teased or made fun of a child for being sick. She stated she would never do this or force another child to be mean to another child. Mrs. Fuller stated that the children there are all kind to each other. She only has two older children, and the rest are all young. She would never have anyone make fun of a child. Mrs. Fuller stated none of the children have been sick at her home recently, sent to her home sick or stayed home due to a sickness. She stated that if a child was to 5 get sick at her home, she would call their parent immediately. Mrs. Fuller again denied having any child make fun of another child for any type of sickness. She stated that her two oldest children have not been there a lot lately and stated their last day at her home was last week, Thursday. She has no other older children and usually does not take older children, but she was helping out their family. and I then spoke to CCSM 1, and she denied ever hearing Mrs. Fuller make fun of a child. She stated that is not how they conduct things at the home and would never make fun of a child for being sick. She stated they would call their parents immediately to come get them if someone was sick. CCSM 1 also denied having other children make fun of a child for being sick. On 08/14/2023, interviewed Child B at their home. Child B denied that Mrs. Fuller made fun of any kids at the child care or made fun of them for being sick and did not call the children names. Next, interviewed Child C at their home. Child C stated Mrs. Fuller never made fun of him or Child B or picked on them, but Child C did have diarrhea once and Mrs. Fuller was telling all the younger children about it and was telling everyone to stay away from him because he was sick. Child C said he did not ask her to stop because he did not want to make her mad. Child C denied she said anything else mean. On 08/21/2023, I interviewed Child D’s Mother, and she stated that Child D and her older children who previously attended Mrs. Fuller’s home has never complained that Mrs. Fuller has teased or made fun of any child.

Elaine Fuller made fun of children due to having diarrhea.

Disposition: Substantiated

Elaine Fuller did not provide appropriate care and supervision of Child A; Child A was sexually assaulted by a household member while in her care. On 0813012021. I made an onsite inspection at Mrs. Fullers residence with At this time. Mrs FuHer had six childr with assistant Ms. Hill. so"in e home was Mrs. Fuller and~were both visibly upset and insisted that they and Ms. Hill always watch the children and do not allow others to care for the children in the home. Mrs. Fuller stated was living in her home when she was not providing licensed care to children. She stated he slept on her couc room and never went upstairs. Mrs. Fuller stated she believes that lived in the home for five or six months, and it was about five years aao. Ica does not come to the home "Wen child care children are there. and Mrs. Fuller stated repeatedly they feel Child A is a" liar and a storyteller". Child A attended last in and Mrs. Fuller stated she was not licensed as a child care provider during this time. She stated it was after this time that she became licensed (2017). Mrs. Fuller stated she used to watch grandchildren prior to 2015 and then decided to take on Child A as well. On 12/15/2015, Mrs. Fuller was informed she must be licensed to care for unrelated children and then started the process of being licensed, which she obtained in 2017. Mrs. Fuller signed a safety plan at this time will not come to her home during child care hours. She will stcaotimngpWl WAi Picensing throughout the investigation and will always provide appropriate care and supervision of all the children. On 09/2912021, l spoke to Child B's mother via telephone. Child B's mother stated Child B is years old and has never said or acted in a way that would be alarming. She state is there each morning with Mr fl I r nc1 Ms. Hill is there in the afternoon. Child B's mother stated she knows who is and she has never seen him in the home or anyone else in the home that was not supposed to be there. Child B's mother stated she does not have any concerns and feels her child is always appropriately supervised. Next, I spoke to Child D's mother via telephone, and she stated Child D has been attending Mrs. Fuller's for three years and loves it there. She stated Mrs. Fuller always has three adults at he uller, and Ms. Hill. Child D's mother stated she knows who s; however, she has not seen him at the home in four to five years. She stated that she knows uniia U.S moiner she feels her child is safe there along with all other children at the home. APPLICABLE RULE R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times. 4 ANALYSIS: Mrs. Fuller provided appropriate care and supervision of the children while she has operated as a licensed child care home provider. During the time Child A was in her care in -, Mrs. Fuller was not a licensed provider. She did not become licensed until 2017.
