It was alleged that on 08/23/2022, Child A (10 years, male) was outside playing on the playground at the center. He pulled his pants down and showed Child B (5 years, female) and Child C (6 years, female) his and asked them to touch it. Child A and Child B did not touch Child As They ran away. lbs. Teresa Anderson, child care staff member, stated that Child A has attended the program for many years. He has several medical diagnoses that result in him having behavior issues. Child A does not ave friends his age, He tends to play with younger children. On 08/23/2022, which was the last day of summer care, Child A, Child B, Child C, and Child D were playing on the swings. Ms. Anderson was standing in the middle of the playground supervising all the children outside. She turned to look at another group of children. When she turned back to the swings, she noticed that Child A and the other children were no longer there. She headed to the corner of the building to see if they were hiding. As she started to walk over to the corner, Child E walked toward Ms. Anderson and stated that Child A was showing his privates. When Ms. Anderson turned the corner, she saw Child A with his pants down. Child B and Child C were standing near him. Child A stated to Child E, "I told you not to tell." Child B and Child C told Ms. Anderson that Child A pulled down his pants. Child A started to get upset and said, "I'm sorry" repeatedly and "don't call my mom." Ms. Anderson stated that she was the only child care staff member present during the incident. Ms. Anderson contacted Child A's Mother and told her that Child A needed to be picked up. She told Child A's Mother that Child A could not return to care for the remainder of the week, which was three days. Ms. Anderson reported the incident to Child B's and Child C's parents. Child B's and Child C's parents spoke to their children about what happened. Ms. Anderson stated that they reported to her that Child A asked Child B and Child C to touch his after he pulled his pants down. The girls did not want to, so one of them touched it with their shoe. Ms. Anderson stated that she learned that Child D walked away from the group when Child A W spoke about showing his as she didn't want to see. Ms. Anderson did not speak to Child D's Mother since Child D did not witness any private parts. Ms. Anderson added that earlier this summer there was an incident where Child A showed a couple of boys in care his Ms. Mindy Sinclair, child care staff member, witnessed that incident. After learning more details about the incident, the administration made the decision to disenroll Child A from the program. Ms. Anderson stated that she was not aware of the 08/23/2022 incident being reported to the center's licensing consultant. Mindy Sinclair, child care staff member, stated that she worked in the summer program with Child A. She stated that his pants fall down a lot. The child care staff members are always telling Child A to pull his pants up. When Child A's pants fall down, he shakes his buttocks. Ms. Sinclair stated that Child A has had several behavioral issues. He always seems angry. He storms out of the room when he gets upset. He gets upset easily. Child A struggles to make friends his own age, so tends to hang out with children a lot younger than him. Melissa Ryan, child care staff member, stated that Child A is very hands-on and physical. He loves hugs. He also likes to boss the other children around and be in charge. He tends to hang out with the younger children. Ms. Ryan stated that Child A recently and his behavior had improved, although there were still some issues here and there. Child A doesn't respond well to being told not to do something. Ms. Ryan added that she tends to keep a closer eye on Child A due to his behavior. Child B and E's Mother stated that she was informed of the incident by Ms. Anderson.
