    Based on the interviews that were completed and the documents that were reviewed, there is insufficient evidence to support that program staff deprived Child A of a snack or meal when she attended the child care center. Program staff served Child A the food that Child A’s Mother sent. In spite of program staff using different techniques to encourage Child A to eat her food during mealtimes, there were times that she would either eat all of it, some of it, or none of it.

    On 0311612023, I spoke to the complainant via telephone. The complainant stated that CCSM A, CCSM C, CCSM D and program director, Janelle LoGiudice hit and kick the children in the re-k classroom. The complainant shared that one day, CCSM A cut Child A with and CCSM B witnessed the event. On 03/16/2023, I spoke to Child A's Mother. Child A's Mother shared that Child A would come home from the child care center with bruises that she did not have before. Child A has been attending the child care center for approximately one year. When Child A's Mother asked Child A how she received the bruises, Child A told her that the child care staff members hit and kick the children. Child A shared with Child A's Mother that CCSM A hit her in the face with a backpack and CCSM C punched her. When she asked Child A why the staff members would do that; Child A replied, "All the teachers are naughty:". Child A shared that Ms. LoGiudice gives out snacks in the morning, and Ms. LoGiudice would kick her in the shins when she passes by her. Child A also shared that the child care staff members wake the children up from naptime by screaming in their faces. Child A and her friends hide behind the couch in the classroom when the child care staff members are being mean until licensee designee, Derick Doe tells them it's safe to come out, and that "the teachers are being nice now." Child A's Mother shared that on 03115/2023, Child A had a cut on her thumb. and the physician regarding bruises and a cut on Child A's finger. The physician noted that Child A had a shallow cut on her thumb with dried blood. The physician also noted that Child A had small bruises on the shin, hip, and lower back above the right M When she took Child A to the doctor, Child A informed Child A's Mother and eocior that CCSM A had cut Child A with at the child care center and Ms. CCSM B yelled at her for cutting her with the ater that evening at home, Child A told Child A's Mother about the staff members hitting and kicking all the children in the classroom. When Child A's Mother asked Child A why she didn't tell her what was going on, Child A said that the staff members told the children not to tell their parents what happens at the child care center. Child A could not recall the days or dates of the incidents, but Child A's Mother believes it has been happening during the past eight months or so. On 03/1712023, l spoke with . I informed that I had spoken to the complainant and Child A's Mother via telephone. informed me that she had met with Child A. Child A's Mother, and Child A's Father. Child A's Mother informed _ that Child A will not be returning to the child care center. On 03/24/2023, 1 conducted an unannounced onsite inspection with and from 9:02 am to pm. We informed program director, Janelle LoGuidice of e allegations. Ms. LoGuidice stated that she was shocked and had no knowledge of the allegations. Ms. LoGuidice informed us that the child care center has cameras on the outside of the building only. Ms. LoGuidice shared that she has had to speak to staff in the past regarding the child care discipline policy. The child care center has had a special investigation in the past, regarding discipline. Ms. LoGuidice center's"W", shared that there were no findings as a result of the special investigation and the alleged staff member no longer works at the child care center. Ms. LoGuidice denies ever witnessing any staff member hitting, kicking, or pushing a child. Ms. LoGuidice denies ever kicking or hitting Child A or any other child at the child care center. Ms. LoGuidice shared that she is typically never alone in a classroom with children and there are usually multiple staff members present. Ms. LoGuidice had never received any complaints from parents against herself or any of the staff members. Ms. LoGuidice said that she passes out snacks to the classrooms but denies ever kicking Child A while doing so. Ms. LoGuidice reported that she was not aware of any altercations b

    On 03/16/2023, I spoke to the complainant. The complainant shared that Child B is allowed to hit all the girls in the classroom. The complainant shared they did not know why Child B only hit, kicked, and pushed the girls in the classroom. The complainant also shared that all the parents in the classroom are aware that Child B bullies the girls, but the child care center will not do anything to stop it. The complainant did not provide any specific dates or time frames. On 03/16/2023, I spoke to Child A's Mother. Child A's Mother shared that she was informed by Child A that Child B hits and kicks her and the other girls in the classroom at the child care center. Child A's Mother shared that she has received three incident reports pertaining to Child A being injured due to Child B. Child A's Mother also shared that she has received a phone call or a message about incidents involving Child B hurting or harming Child A. Child A's Mother shared that the child care staff members and administrative staff are very friendly and nice but believes they only tell her what she wants to hear and/or only what they want her to know. On 03/24/2023, I interviewed program director, Janelle LoGuidice. Ms. LoGuidice stated that there were concerns regarding Child B's behavior at the child care center and that Child B no longer attends due to those concerns. Ms. LoGuidice said that Child B would hit, kick, and push other children in the classroom, however, Child B never hurt anyone to the point where they would need to seek medical attention. Ms. LoGuidice was concerned about Child B's behavior because Child B appeared to have no remorse after hitting or kicking other children. Ms. LoGuidice also shared that they had meetings with Child B's Father regarding Child B's behaviors. Ms. LoGuidice has never met Child B's Mother. Ms. LoGuidice shared that child care staff members are required to complete incident reports whenever a child is hurt in the center. Child B had been sent home several times due to his aggressive behavior towards the other children, including hitting and kicking. Ms. LoGuidice stated that several parents complained that Child B had been hurting their daughters. While Child B would become aggressive with the other children, Child B was allowed to attack the other children in the classroom. Child B's last day attending the child care center was 03/08/2023. Child B's Father sent an email on 03/23/0223, stating that Child B was enrolled at another child care center. On 03/24/2023, I interviewed licensee designee, Derick Doe. Mr. Doe shared that CCSM A had informed him that parents were becoming frustrated with Child B's behaviors. Mr. Doe stated that the pre-k classroom is a busy room as the children are older and there are more children in the classroom. Mr. Doe stated that he had conversations with Child B's Father about Child B hitting and kicking other children in the classroom. As Child B's behavior progressed, they began to send Child B home. Mr. Doe shared that Child B no longer attends the child care center. While Mr. Doe reported there were challenges with Child B, he did not state that child care staff members allowed Child B to hit and kick the children. Mr. Doe shared that in addition to the staff assigned to the classroom, there is also support staff at the child care center. On 03/24/2023, I interviewed CCSM A. CCSM A is the lead caregiver in the pre-k 1 classroom and stated there are 25 children enrolled. CCSM A shared that Child B no longer attends the center but did have behavior issues such as hitting other children in the classroom. On 03/24/2023, I interviewed CCSM D. CCSM D works in the pre-todds classroom but also assists in the pre-k 1 classroom when needed. CCSM D stated that she is aware of Child B's behavior and hitting/kicking of other children in the classroom. CCSM D shared that she believes Child B cannot control himself when he is in large group settings with the other children. She reported that Child B

    On 11/22/2021, I made contact with Program Director (PD), Janelle LoGiudice. Ms. LoGiudice self-reported the allegations made by Child A, which was brought to their attention by Child A's father. Child A's father asked for a meeting with the program director on 11/18/2021, which was scheduled for 11/19/2021. I asked Ms. LoGiudice how long Child A had been in care at the facility. She shared since September 7, 2021. Child A was enrolled in the Pre-K 1 room. She shared CCSM Jacey Renirie was subbing for CCSM Morgan Smith, who is the lead caregiver for the room. She was off for maternity leave. Ms. Renirie was in the room from August through November 12, 2021. She was working with CCSM Ester Dunckel. She shared the facility has begun their own investigation, and at this time there have been no findings. She wanted it to be noted that CCSM Ms. Renirie has medical back problems that limits her ability to lift more than 10lbs at this time. She shared it would be hard to believe that she would physically be able to pick Child A up by his head as noted in the allegations. She denied any past disciplinary action being taken against Ms. Renirie due to physical interaction with children or temperament concerns. On 11/29/2021, I completed an announced visit to the child care facility. I interviewed designee, Derick Doe. Mr. Doe was aware of the allegations as they were self-reported by the facility. Mr. Doe shared the family was new to their facility (enrolled late August 2021). Child A attends half-days (7:30am-12:pm). Mr. Doe shared the allegations brought to their attention were shocking because Child A was such a well-behaved child, and he is always interactive and appears to be happy while in care. Mr. Doe shared Ms. Renirie isn't typically in the Pre-K classroom. She was filling-in for a CCSM that was on maternity leave. He shared their internal investigation has been completed and there were no findings to support the allegations. In addition, 3 PD Ms. LoGiudice does classroom observations, and she's never noted concerns regarding Ms. Renirie's interaction with children. I asked if any other parent has expressed concerns or shared concerns by their children regarding Ms. Renirie. He denied any concerns ever being brought to his or the PD's attention. Mr. Doe shared Ms. Renirie has a severe back condition that wouldn't allow her to pick up a child the size of Child A. I asked how long Ms. Renirie has been employed at the facility. He provided April 29, 2019, as her date of hire and shared no disciplinary action has ever been taken against her. I interviewed CCSM Ester Dunckel. Ms. Dunckel shared she and Ms. Renirie recently worked together for a few weeks in the Pre-K classroom. Ms. Renirie was filling-in for another CCSM who was on work leave. She shared during the months of September and October, she worked with her daily. I asked if she ever noticed any concerns regarding Ms. Renirie's interaction with Child A. She denied any concerns and shared Child A is a "good" kid. I directly asked if she's ever observed Ms. Renirie grab Child A by his face, pick him up in an aggressive manor or hurt him. She denied seeing this. I asked if she's observed this behavior with any of the children in care. She denied this as well. Ms. Dunckel denied that Ms. Renirie uses the bathroom as a redirection or disciplinary space, specifically locking a child in the bathroom as stated in the allegations. She shared there was an incident that occurred weeks back when Child C was upset and unable to calm himself down. He was being aggressive by tossing a chair. She observed Ms. Renirie remove him from the area to avoid other children getting hurt or him hurting himself. She took him to the bathroom so he could have a space by himself and eventually he calmed down. She shared there was a second incident when Ms. Renirie took Child C to the bathroom so he could calm himself down. She could not recall the specifics of this incident nor the time in between the

    On 10/27/2020, I conducted an unannounced onsite inspection. I spoke with program director, Jayme Harding and CCSM's Devin Smith and Nadia Bayani. I spoke with Ms. Harding who self-reported the incident. The day of the incident there were eight children to two staff members. She shared that CCSM, Ms. Bayani brought Child A to the office after her class went outside and Ms. Bayani noticed Child A's class was not outside and Child A was unattended. Ms. Harding observed Child A to be calm and did not appear to be distraught and did not appear to have been crying. Ms. Harding and program director Ms. LoGiudice allowed Child A to remain in the office until CCSM, Ms. Smith came and got her. Ms. Harding shared that the department and the parents were notified immediately. Contact was made with Child A's father and later during pick up contact was made with Child A's mother. Neither parent expressed concerns. Child A's father main concern was how Child A was doing emotionally. Ms. Harding provided me with the attendance sheet which verified eight children signed into the classroom. Child A is enrolled in the Get Set room ages 2 -3-year- '/2 olds. Ms. Smith is the lead caregiver of the classroom. I inquired about any other incidents involving Ms. Smith or Ms. Jolly, who was the other CCSM working with Ms. Smith, leaving children unattended. She denied any history of them leaving children unattended. I observed video footage from the day of the incident. At 10:57am I observed the class enter the building and Child A remained in the play tunnel out of sight of the CCSM's. During a timeframe of five minutes, Child A was walking outside of the tunnel looking around before entering the tunnel again. She came out another time and walked around and stood outside the tunnel. It was shortly after that Ms. Bayani walked up to Child A, which was at 11:02am, and took her inside the building. I walked outside to observe the play area. The area Child A was in is completely fenced without any noticeable safety hazards. I interviewed CCSM, Devin Smith. Ms. Smith confirmed being the lead caregiver in the Get Set room. She has been employed for the facility for two years. She confirmed working with CCSM, Ms. Jolly. I asked about the incident that took place with Child A. She shared it was time to transition from outdoor play, so she and Ms. Jolly lined all the children up. She was at the door and counted the children as they walked in. She did not use the Tadpoles app, which is part of the protocol. Ms. Smith told me the one time she didn't follow their protocol is the time this incident 3 happened. She didn't know why she didn't follow protocol because the day was running smoothly and there weren't any specific stressors or changes she could think of. She miscounted because she believed she counted eight children total. She confirmed with Ms. Jolly that she saw her count eight and she confirmed. While inside the room, she began working on setting up the children's cots while Ms. Jolly took the children to the restroom. When Ms. Jolly finished up with all the children, she asked her where Child A was. Ms. Smith thought that Child A was with Ms. Jolly, and Ms. Jolly didn't think much about it because she thought Child A was with her. It wasn't until all the children were done with restroom breaks that she noticed Child A was not with her and this is when she immediately looked outside. She saw Ms. Bayani's class outside. She asked Ms. Bayani if Child A was outside, and this is when she found out she was taken to the office. She went to the office and Child A was with Ms. Harding and Ms. LoGiudice. When she got Child A, she was calm and did not appear to be distraught. Ms. Smith denied that she's ever left a child unattended before. She spoke with Child A's mother during pick up and shared with her what took place in person. Child A's mother did not express any concerns with her. Ms. Smith said she normally does face to name to face but this time she only
