    R 400.8140 · R 400.8140 Discipline. (4) A written policy must be developed and implemented regarding the age appropriate, non-severe discipline of children. The policy must be provided to staff and parents. 1

    On 06/30/2023, I interviewed the Complainant via telephone. The Complainant stated the same information that was provided in the above allegations. On 06/30/2023, I interviewed Child A's Mother via telephone. Child A's Mother stated CCSM called her on 06/26/2023 at 2:00 p.m. informing her that she needed to pick up Child A because he exposed himself, and female children saw him expose himself. When she arrived at the center, CCSM gave her the incident report and said that other male children encouraged Child A to expose himself. Child A's Mother asked Child A more questions about the incident once they were home. Child A said while waiting to enter the swimming pool, he and three other male children were telling "yo mama jokes" to each other. One of the children turned to Child A and told him if he did not prove that he was a boy he was going to throw him in the pool. CCSM did not fully disclose all of the details to her when she picked up Child A. She believes that Child A was bullied, not encouraged as CCSM stated. Child A's Mother requested the center change the wording in the incident report to reflect that he was bullied, which they changed the wording to state he was peer pressured. When she asked Ms. Lancina about disciplinary actions for the other male children, Ms. Lancina told her that she could not disclose that information with her to protect confidentiality. However, she did tell her that the incident was addressed with all the children and parents who were involved. Child A will no longer be attending the center. On 07/03/2023, I completed an unannounced on-site inspection. I interviewed Ms. Lancina and CCSM. General manager, Marian Menzo was present during the interview. Ms. Lancina stated no other staff members heard the conversation between the children nor did they see the incident. CCSM stated on 06/26/2023 children and staff were waiting on the pool deck for their turn to go into the swimming pool. Child E told him that Child A exposed himself. Ms. Lancina stated Child E said she was just sitting there, and the male children were just joking around and then she looked over and Child A had exposed himself and was laughing about it. She just looked quickly and brought it to staff's attention right away. Child A and the other male children were separated from the group and the incident was discussed with them separately. From the conversations with the children, it 3 appears that the children were joking with each other, and one of the children told Child A to prove he was boy. None of the children stated that Child A was told that if he did not prove that he was a boy, he would be pushed into the swimming pool. CCSM stated he did not hear the conversation between the children, nor did he see the incident. After Child E made him aware of the incident, he asked the other staff that was working if they had heard or seen anything occur between the children and they said they had not heard or seen anything. CCSM called Child A's Mother, and CCSM explained to her what occurred and informed her that she needed to pick him up from the center. When she arrived to pick him up, CCSM had her sign the incident report. Ms. Lancina stated Child A's Mother then contacted the center later that day asking them to again explain what had occurred and requested to know how they handled the incident with the other children. Child A's Mother did not believe she was told the full story of what had occurred and she did not like the wording that was stated in the incident report. She felt Child A was bullied into exposing himself and not encouraged to expose himself. Ms. Lancina stated that the center takes all incidents of bullying and inappropriate behavior very seriously. Ms. Lancina and Child A's Mother had email exchanges regarding her concerns and she attempted to address them. The wording in the incident report was changed to state that Child A was peer pressured into exposing himself instead of stating that he was encouraged t

    The center followed their incident report policy when addressing the incident with Child A and the other children. The center handled the incident appropriately. The center notified the children's parents about the incident face-to-face and via a written parent communication form, which was signed by the parents. The center had a discussion with the children about appropriate conversations, behavior, peer pressure and bullying. Wording in the written parent communication form was changed per the request of Child A's Mother.

    On 08/05/2021, l made contact with Child A's father. He shared both he and his wife were at work during the incident. He received a voice message from the facility requesting a return call back regarding something with his When the message was received his wife went to the facility to pick Child A up. He shared, "From what I gathered it was all over some sort of bullying stuff." He shared there was a child who was cutting and this is where Child A got the idea from. He shared there was "some kind of group chat with boys and girls and that's where the bullying came from." I asked if he knew when the phone contact between the children took place and he shared most of it was after camp hours. I asked if there were any concerns, he or Child A's mother have shared regarding supervision while was in care. He shared Child A never reported any concerns and shared ■ ■ never spoke with any CCSM's about concerns while in their care. On 08106/2021, I made contact with Child A's mother. She shared she was made aware of the incident when the facility called her and told her that Child A had taken some scissors and cut■ wrist while working on an art project. She shared she believes they treated Child A and then promptly called her husband and eventually called her. I asked if she could share what Child A indicated what lead to the incident and what took place when the incident happened. She shared there was a thread of text messages between several of the children enrolled in the camp. Prior to her _ bringing this to her attention, she wasn't aware of any problems at the camp, including a text message chain. Some of the exchange took place via Facetime as well. I asked if she was aware of the time frame in which the text messages were exchanged. She shared there was one day that she saw a text message thread from 2pm and some at 4:30pm during camp hours. All the other messages were afterhours. Child A specifically spoke about Child B being a bully to ■ and other children and staff have spoken to him about his behavior. I asked specifically about Child A's incident where she cut_ She shared Child A told her that there was another child who showed her pictures of herself with cut marks on her body. Child A told her that she got the idea from this child. On 08/09/2021, l conducted an unannounced onsite inspection. I spoke with program supervisor, Heather Lancine. Ms. Lancine shared Child A and CCSM, Amber Staudt came into her office and shared that Child A had just used scissors to cut wrist. Ms. Lancine shared she spoke with Child A and asked what happened M 0 an w at caused to cut Child A responded by telling she was tired of feeling bullied by ild B. Ms. Lancine shared she provided com ort to Child A, and they discussed bullying and ways to address it. She was told contact was made with 2 parents to make them aware of the incident. Child A shared that was sad and upset with Ms. Lancine shared Child A cut both wrists and had superficial cuts on them. CCSM, lbs. Staudt is a paramedic an was able to assist with an immediate evaluation of the wounds and provide first aid. I asked about ratio and supervision. Ms. Lancine shared the incident occurred while in arts and craft electives outside. There were 3 CCSM's total and 23 children present all ages 6 and Lip. I asked Ms. Lancine who contacted the parents and how they responded. She shared initially she only contacted Child A's father because that was the only number provided on the child information card. A message was left requesting a return call back. After waiting for a return call back, she asked Child A if had a contact number for mother. This is when a number was provided, an called Child A's mother. C A's mother arrived for pick up and they were able to iscuss the incident in detail and in person. Ms. Lancine shared during their internal investigation they learned about a group of children who created a group thread. Child A specifically discussed concerns as well as other children regar
