Based on review of the Two's classroom attendance records on 02/24/2026 and 03/03/2026, the Two's classroom did not maintain the required ratio of 1:4. On 02/24/2026, from 8:40am to 8:43am there were 2 teachers to 9 toddlers and from 10:58am to 12:11pm there were 2 teachers to 12 toddlers. On 03/03/2026, from 8:45am to 8:51am there were 2 teachers to 9 toddlers.

On 3/13/2023, I spoke with program director, Rebecca Bennett. She was aware of an incident in which Child A and Child B were playing with the Junior K classroom ipad and Child A snapped a picture, not a video, of Child B while Child B was in the bathroom. Child Care Staff Member 1 (CCSM1) was present and saw Child A hand the ipad to Child B to take his turn, but CCSM1 took the ipad. The picture was taken from inside the classroom, pointed towards the bathroom door that was open a little bit. Child B was standing up to urinate, with his back to the door. The picture was deleted, and parents were notified. On 3/13/2023, I spoke with CCSM1, inside of the Junior K classroom. CCSM1 stated that on 2/8/2023, Child A and Child B are friends and were using the 2 classroom ipad to record themselves as weather reporters in front of the large map in the classroom. Both children were being appropriate with the ipad. The map is about ten feet from the bathroom door that is inside of the classroom. CCSM1 stated that Child B went to the bathroom. Some of the children in the Junior K room leave the door open slightly when they use the restroom. Child B did just that. CCSM1 stated that Child A did not leave the map area of the classroom but was able to snap a picture of Child B in the bathroom. Child B was standing with his back to the door. Child B's face and body parts were not showing. CCSM1 stated that as Child B came out of the bathroom, Child A was going in and they exchanged the ipad. CCSM1 obtained the ipad right away and saw the picture. CCSM1 told CCSM2 immediately. CCSM2 called Child A's parents and Child B's parents. CCSM2 deleted the picture. CCSM1 stated that after that, there were no more ipads in the classroom. CCSM1 stated that Child A and Child B were very innocent and did not know that what happened was wrong. On 3/13/2023, I spoke with CCSM2. CCSM2 was working in the office when CCSM1 called her to the Junior K room on 2/8/2023. CCSM1 showed CCSM 2 the picture of Child B's back as he was standing over the toilet. The picture was deleted and the ipads were removed from the classroom. CCSM2 informed the district manager and then called both sets of parents. Child A's parents knew the boys were just being silly, but apologized to Child B's parents because they were not happy about it. CCSM2 stated that Child B stayed about a month or so after the incident but disenrolled on 3/10/2023.

R 400.8350 · R 400.8350 Toilets; hand washing sinks. (1) A center shall provide toilet and hand washing sinks as follows: (b) A center operating with children in attendance 5 or more continuous hours a day shall provide at least 1 toilet and 1 hand washing sink for every 15 children or fraction thereof.
On 3/13/2023, Ms. Bennett showed me around the center. At this time all toilets were in working order. Ms. Bennett said that one of the two toilets in the Pre K room was out of order for a couple of months and the class was using the bathroom in the multipurpose room directly across the hall when a second toilet was needed. The Pre K room has 16 children enrolled. 3 On 3/13/2023, CCSM1 stated she did not know about the toilets in the Pre K room but she did know that the children can use any of the many toilets in the facility at any time. CCSM2 stated that there was a toilet in the Pre K room that kept getting clogged. CCSM2 stated that there are other toilets the children can use if needed. She had not heard any complaints about it or that children were having accidents waiting for the toilet. There are 15 toilets and 27 sinks in the building. Even with one broken toilet, this are more than enough for the capacity of 136 children based on one toilet for every 15 children.

On 3/13/2023, Ms. Bennett stated that staff do clean their areas throughout the day and that a cleaning crew comes in daily after hours. CCSM 1 and CCSM 2 agreed that the classrooms are used by the children during the day, but the staff members clean during the day and a crew comes in at night to deep clean as well. On 3/13/2023, I observed all the classrooms and bathrooms. Every room appeared clean and appropriate for the children. There were no carpet stains or odors. The bathrooms had been used that day but were not dirty. There was no urine build up by the toilets and no foul odors. 4

On 01/06/2022, I completed an unannounced onsite inspection. I spoke with program director, Rebecca Bennett. Ms. Bennett was aware of the allegations made against the facility because it was self-reported by her. Ms. Bennet shared Child Care Staff Member (CCSM) Cole David was working in the pre-school 1 classroom with 5 children the day/time of this incident which was 12/30/2021 at approximately 4:40pm. Ms. Bennett 2 was in the front of the building speaking with another CCSM, Molly Devendorf when they both heard a crying sound in their large motor room, Brooke. This room contains a large open space where small ride along toys, books, a soft sitting area and a board connected to the wall with multiple hands-on activities are available for use. The room is in the center of the building and does not have direct access to the outdoors. CCSM, Ms. Devendorf made it to the Brooke room first, and by the time Ms. Bennet made it to the room, Ms. Devendorf had Child A comforting her and walking her back to her classroom. As she was walking Child A to the room, Ms. David was meeting her. Ms. Bennet said she walked to the room to speak with Ms. David about the incident. She shared their transition from the Brooke room to the classroom was not typical. There were some behavior problems with other children, including one child that she physically had to hold in her arms because the child did not want to leave the room. I asked what time the incident occurred. She shared approximately, 4:40pm. I asked if there has been concerns in the past regarding supervision with Ms. David. She denied any concerns or disciplinary actions being taken against Ms. David for improper supervision. I asked if the parent was called regarding the incident. She shared Child A's mother was called immediately by her. She appeared to be very understanding and did not express any concerns. Child A's mother did follow up with her in-person the following day and wanted to make sure CCSM, Ms. David wasn't going to get in "trouble." I spoke with CCSM, Molly Devendorf. She shared she was working in the preschool 1 classroom with Ms. David until around 4:15pm. She was able to leave for the day due to low numbers. She confirmed 12/30/2021 as the date of the incident. She stayed after to finish some light cleaning and then she started speaking with PD, Ms. Bennett in the front hallway of the building. While speaking with Ms. Bennett she heard a child cry. When she walked towards the Brooke room where she heard the crying come from, she observed Child A who was at the door. She provided Child A with comfort and then walked her back to her classroom. While walking her to her class, Ms. David was already walking towards the room to get her. I asked if she had any prior knowledge of any incidents of supervision occurring with Ms. David. She denied any knowledge. I spoke with CCSM, Cole David. Ms. David confirmed that Child A was left in the Brooke room alone. She said during transition from the Brooke room to the classroom she had a difficult time managing the behaviors of a couple children. Child A was one of the children. She was tearful and upset because she didn't want to start cleaning up for preparation to leave the room. She also had another child who was refusing to walk, so she physically picked him up to carry him to the room. She had the children line up, and she led the line to the classroom. Once in the room she put on gloves to start preparing for restroom time. By the time the children got into the room, and she put gloves on she noticed Child A was not in the room. She ran out of the room and was greeted by CCSM, Ms. Devendorf who had Child A with her. I asked for a timeframe in which she believed Child A was in the Brooke room alone. She shared "it was like 3 minutes." She shared Child A was tearful when she got her. She apologized and hugged her. She was able to be consoled and stopped crying. She shared Child A was able to return to her normal classroom routine
