Child Care Staff Member (CCSM) 1 is inappropriate with some of the children. He and the Program Director are the only male staff members in the facility. CCSM 1 appears to favor some of the female children in the facility. He will disregard the male children in the facility when they need help but not the female children. The female CCSMs have stated they will change diapers and clothing for the female children, however CCSM 1 will often change the female children before the female staff are able to change them. Child A is "clingy" and likes to put her head into staff's laps. She will put her head into CCSM 1's groin area and he does not make her move away.

On 07/18/2023, I completed an unannounced on-site inspection. Prior to completing interviews, I observed CCSM 1 working in the Pre-K II classroom from 11:13 a.m. to 11:46 a.m. CCSM 3 was also working in the Pre-K II classroom. I observed the children coloring and making an art project. CCSM 1 engaged appropriately with all the children. He assisted both male and female children with their art project and helped male children make paper airplanes. When it was time for clean up to transition to large group time, he redirected both male and female children in the same tone and manner. I interviewed Mr. Joseph, CCSM 1, CCSM 2, CCSM 3, CCSM 4, CCSM 5 and CCSM 6, separately. Mr. Joseph stated he has no concerns regarding CCSM 1's interactions with the children. He has not received any complaints from parents or staff about the allegations stated above. Although he has not received any complaints about CCSM 1, Child B's parents do not want Child B to be cared for by CCSM 1 because they stated they do not feel comfortable with him caring for her. There were no incidents that occurred between CCSM 1 and Child B. CCSM 1 has not received any disciplinary action since working at the center. Since Mr. Joseph has experienced situations of people not feeling comfortable with a male caring for female children, he has had discussions with CCSM 1 about setting appropriate boundaries with female children. CCSM 1 denied that he favors female children more than male children. He stated that no one has brought to his attention that it appears that he is favoring female children. He gives both male and female children the same attention when they need help. He rarely changes diapers because the children in the classrooms that he works in are potty trained. He will assist both male and female children if they have a toileting accident and need help being changed. Since he is one of two male adults working in the center, he tries to make an extra effort to set boundaries with the female children such as giving them high-fives instead of hugs. However, there are times when female children will give him hugs and he hugs them back. He denied having inappropriate contact with any of the children. 3 CCSM 2 stated she believes CCSM 1 favors Child A over other children. Child A has sat in his lap at the activity table while the children are completing an activity. There was no need for her to sit in his lap. CCSM 1 has not made any inappropriate comments or did anything inappropriate while Child A was sitting in his lap. If male and female children are doing the same thing such has not cleaning up toys, CCSM 1's tone will be harsher when redirecting the male children than when he is redirecting female children. She has not observed CCSM 1 disregard the male children when they need help. She has not observed inappropriate behavior regarding CCSM 1 diapering female children. CCSM 3 stated she has not observed CCSM 1 favor female children over male children. He plays with all the children when they are building with the blocks and at the water sensory table. When CCSM 1 plays with a child, either male or female, for a long time, she has had to remind him that there are other children in the classroom that need his attention. She has not observed any inappropriate interaction with Child A or any other female child during diapering or toileting. She has not observed Child A lay her head in CCSM 1's lap. She has no concerns with CCSM 1 working with the children. CCSM 4 stated CCSM 1 engages appropriately with the children. The children have fun with him. She has not observed CCSM 1 show favoritism over Child A or any other female child. She has not observed Child A lay her head in CCSM 1's lap. CCSM 1 helps both male and female children. He is the type of staff that does not like to sit around and do nothing. He likes to help in any way that he can. She has not observed any inappropriate interaction with Child A or any other female child during diapering or toilet

On 09/30/2022, I received an incident report from the child care center relaying that Child A was left unattended in the PreK classroom when the children went outside. On 10/03/2022, I completed an unannounced on-site inspection at the child care center. I interviewed program director, Christopher Joseph. Mr. Joseph shared that Child A was left unsupervised in the classroom for about two minutes. The incident occurred on Friday, September 30, 2022, around 10:00 AM. Mr. Joseph shared that Friday was picture day and most of the classrooms were thrown off their normal routine. Child A had gone to the bathroom to change clothes after he had his pictures taken. Mr. Joseph was in his office when he received a phone call from Child A's Mother. Child A's Mother notified Mr. Joseph that she was watching the camera of the PreK classroom and noticed her child was not with the class as they were going outside. When Mr. Joseph arrived in the classroom, child care staff member Deepa Kundapur was with Child A. Child A was visibly upset as he was crying and had not finished changing his clothes. Child care staff member Bhaswati Saha-Mitra was outside with the other children. On 10/03/2022, I interviewed child care staff member, Deepa Kundapur. Ms. Kundapur shared that it was a busy day because it was picture day. Children were coming and going in and out of the classroom to have their picture taken. Child care staff member Bhaswati Saha-Mitra was conducting story time with the children, which ran a little longer than it should have. Ms. Kundapur rushed story time because they go outside at 9:30 AM and they were past the time. She instructed the children to use the bathroom, put on their coats, and grab their water bottles. Ms. Kundapur stood by the entrance door to the classroom while Ms. Saha-Mitra had the children outside. She was helping a child who could not find his jacket, and because the classroom is L-shaped she did not see when the children went outside. She was confused because they normally do not take the children outside that way, they normally line the children up and count them. Ms. Kundapur had assumed that Ms. Saha-Mitra had counted the children because they were all outside. Ms. Kundapur went outside and told Ms. Saha-Mitra that is not how they should take the take the children outside. When she turned around, she saw Child A at the window half- dressed and crying. She went inside and began to comfort Child A. Shortly after she went back inside the classroom to comfort Child A, Mr. Joseph came into the classroom. He helped Child A finish getting dressed and she went back outside with the children. Ms. Kundapur gave Child A, a hug and told him to make sure he tells them before he goes to the bathroom, so they always know where he is. Ms. Kundapur shared that she felt ashamed, and the incident could have been prevented. She apologized to Child A's Father. Ms. Kundapur shared that Child A's Father understood and things do happen sometimes. There were about 18 or 19 3 children present that day and she had recently been moved to the PreK classroom after having been with the preschoolers. Ms. Kundapur has worked at the child care center for nine months, and this had never happened to her before. Ms. Kundapur insists that she checks the bathroom every time before leaving the classroom since the incident occurred. On 10/03/2022, I interviewed child care staff member, Bhaswati Saha-Mitra. Ms. Saha-Mitra has worked at the child care center for six months but has worked in child care for 12 years. Ms. Saha-Mitra shared that she is familiar with face to name sheets but has not done them before working at the child care center. She is accustomed to working alone with a 12:1 ratio, but as of September she has almost 20 children daily with another child care staff member. She was moved into Ms. Kundapur's classroom because her children had gone to kindergarten. Ms. Saha- Mitra is adjusting to the classroom and the children are still adjust

R 400.8155 · R 400.8155 Child accidents and incidents; child and staff illness. (1)A center shall have a written plan for how and when a parent is notified when personnel observe any of the following: (b) A child experiences an accident, injury, or incident.
On 03/30/2021, I received an incident report from Ms. Bennett. The report stated that on 03/26/2021 at 4:50pm, Amanda Knight, the caregiver was 2 changing Child A's diaper. While Ms. Knight turned to dispose of the diaper, Child A rolled off the changing table and fell to the floor. On 03/31/2021, I conducted an unannounced on-site inspection. I interviewed Amanda Bennett (program director), Christopher Joseph (school education manager), and Caitlin Scicluna (lead infant caregiver) in-person. Amanda Knight (assistant caregiver) was interviewed via telephone. Interviews were privately conducted in the program director's office. Ms. Bennett stated that she received a phone call from Mr. Joseph on Friday (03/26/2021) at 5:50pm. Mr. Joseph informed her that Child A had fallen off the changing table in the infant classroom while Ms. Knight was changing his diaper earlier in the day. Mr. Joseph was told to contact Child A's mother and informed her of the incident. Ms. Bennett spoke with Ms. Knight on Monday (03/29/2021) regarding the incident. Ms. Knight told her that Child A fell from the changing table when she turned to throw away his diaper. Ms. Knight stated that Child A did not seem hurt, so she gave Child A a bottle and did not report the incident until the end of her shift, as she was leaving for the day. Ms. Bennett indicated that all staff are trained on the center's diaper changing policy and the incident reporting policy. Ms. Bennett provided a copy of the center's diaper changing policy. It states that "staff must never leave a child unattended in the designated diapering area" and that staff are required to "keep one hand on the child at all times." Ms. Bennet provided a copy of the incident reporting policy. It states that "any incident (i.e. accident, injury, illness, or observation) involving children, however slight, must be documented on an incident report and the parent/guardian must be notified immediately, or as soon as practicable." Ms. Bennett provided a copy of the face-to-name sheet for the infant classroom on 03/26/2021. It documents that Ms. Knight came into the classroom at 4:43pm and Ms. Scicluna left the classroom at 4:50pm. Ms. Knight was caring for 4 infants until she left at 5:45pm. While on-site I viewed the infant classroom and the changing table area. I also viewed the camera which covers the diaper changing portion of the classroom. Ms. Bennett stated that Ms. Knight has been employed at the center since 09/2020 and indicated that she is not aware of any past concerns with Ms. Knight. Ms. Knight's employment was ended on 03/31/2021. Mr. Joseph stated that on 03/26/2021, Ms. Knight had finished her shift and was walking out the front door of the center at 5:45pm. As she was leaving, she turned around and informed him that Child A had fallen off the changing table earlier in the day. Ms. Joseph asked Ms. Knight for more information, but Ms. Knight was unable to tell him how Child A fell or how Child A landed on the floor. At that time, Child A 3 was no longer at the center and had been picked up by his mother around 5:30pm. Mr. Joseph contacted Ms. Bennett via telephone and reported the incident. He then called Child A's mother and informed her that Child A had fallen from the changing table earlier that day. Ms. Joseph denied any past concerns with Ms. Knight. Ms. Scicluna stated that she works with Ms. Knight occasionally but indicated that Ms. Knight usually works in the 2's classroom. On 03/26/2021, Ms. Scicluna was getting ready to leave for the day at around 4:45pm. Ms. Knight came into the classroom to relieve her. While Ms. Scicluna was retrieving her belongings from the closet, she heard Ms. Knight say, "Oh no". Ms. Scicluna ran over to Ms. Knight and saw her holding Child A in her arms. Child A was visibly upset and crying. Ms. Knight told Ms. Scicluna that Child A had fallen onto the floor from the changing table. Ms. Scicluna looked Child A over and did not see any visible injuries. Ms
