R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
I initially spoke with Licensee Designee, Zechariah Hoyt, on 09/13/2021. He stated that he had a Child Care Staff Member (CCSM) expressing concerns regarding another CCSM being too rough with a child. I directed Mr. Hoyt to the Licensing and Regulatory Affairs online complaint form. This complaint was assigned on 10/05/2021 for investigation. I conducted an unannounced onsite inspection on 10/06/2021 and interviewed Program Director, Holly Dienes. She advised at the end of August 2021, former CCSM 1 texted CCSM 4 expressing concerns about CCSM 3's interactions with Child A. CCSM 3 was rough with Child A when putting her down for a nap and then did not console Child A enough after being pushed down by another child. CCSM 4 told Ms. Dienes that she did not believe it was true. Ms. Dienes tried to meet with former CCSM 1 to discuss the concerns but was unable prior to her leaving for vacation. Ms. Dienes talked to all CCSMs that worked with CCSM 3 and none of them had reported any concerns. When former CCSM 1 returned from vacation, her version of the events and concerns had escalated. Ms. Dienes indicated that CCSM 3 is very good with the children, and she cannot see her doing that to a child. She stated that former CCSM 1 was very bonded and attached to Child A and did not feel that Child A was ready to transition to another classroom which was upsetting her. Ms. Dienes felt that this may be impacting former CCSM 1's perspective on the matter. I requested contact information for CCSMs and child information cards. On 11/15/2021, I spoke over the telephone with former CCSM 1. She advised that on 08/25/2021, she was sitting by the gate separating the infant and toddler classrooms. She was caring for eight infants and CCSM 3 was caring for 12 toddlers. The other CCSMs had all left the room. She indicated that happened frequently when she worked at the center, and it would leave the rooms out of ratio. Child A did not want to lay down, out of the corner of her eye, she saw CCSM 3 yell at Child A and slam her into the cot. Child A started screaming but former CCSM 1 "didn't want to get involved." She did not observe any physical injury and thinks it just scared Child A. There was another incident when another child pushed Child A down and she started crying. Child A wanted to be held but CCSM 3 would not hold her or provide her with the comfort she needed at the time. Former CCSM 1 stated that she was surprised that CCSM 3 would do that to Child A. CCSM 3 did not treat any other children in this manner. Former CCSM 1 did not feel comfortable confronting CCSM 3, so she texted CCSM 4 and tried to talk with Ms. Dienes about her concerns. They were not able to discuss her concerns before she left for vacation. She talked with Ms. Dienes and Mr. Hoyt when she returned. Mr. Hoyt and Ms. Dienes questioned why she did not report these concerns as she 3 is mandated reporter. She decided that the center was not a good fit for her, and she resigned. I attempted telephone contact with CCSM 2 on 11/15/2021 and left a voicemail. I have not heard back from her as of the writing of this report. I spoke with CCSM 3 on 11/15/2021 over the telephone. She stated the incident did not happen. She believes that her co-worker made stuff up. Former CCSM 1 told CCSM 4 about her concerns. She was later told about the allegations. She denied any issues or concerns regarding Child A or any other CCSMs working at the center. I spoke with CCSM 4 on 11/15/2021 and 11/16/2021 over the telephone. She did not witness CCSM 3 being rough with Child A. She was feeding an infant and heard Child A crying but that is not unusual when putting the children down for a nap. She did not notice any escalation in Child A's cries or hear anyone shouting at children. CCSM 4 advised that former CCSM 1 texted her about her concerns and she told Ms. Dienes the next day.
