On 03/01/2023, I spoke with the complainant via telephone. They said that they had children that attended the center in the past. They learned of the allegations from an acquaintance who is a former child care staff member. Her acquaintance told her that she tried to report the concerns to the director when she worked there but was told to mind her own business. She did not know the names of the children that Child A allegedly touched. On 03/01/2023 I contacted FCCMS 1 via telephone. She reported that she did not see Child A touch any children inappropriately. She heard about it from other CCSMs that there were several incidents reported to the director and they were told it was not their responsibility to report to Children's Protective Services. FCCMS 1 heard that Child A was touching Child B, who is the complainant's child. She was not sure of the name of the other child that Child A allegedly touched but it was a school aged child. She said that Child B told her that Child A had told her about performing oral sex on boys. FCCMS 1 said that she told the director. This happened between the end of September and November 2022. Child A also told her about how her sister was having boys over and friends of her sister did sexual things and told her stories about sex. Former Child Care Staff Member 2 (FCCSM 2) told her that Child A was touching children at school and on the school bus. FCCSM 1 said that she was told that Child A's Mother "isn't one to mess with about allegations that aren't true because she throws a fit." FCCSM 1 said that she had a concern that Child A touched Child B because of how Child B tried to stay away from Child A and acted anxious around Child A. FCCSM 1 said that Child A was in the gym or the preschool room in the morning during the school year. She said that Child A would often go in the loft and go to sleep. No one else was up in the loft with her when she was sleeping to her knowledge. The children built forts in the gym with blankets and coats on chairs after school. FCCSM 1 did not work in the afternoons, so she did not know what happened after school. Child A was at the center all day on Fridays with CCSM 4. FCCSM 1 said that Child B's Mother is "out to get [the center]" because 3 they did not take her child back. She said that she reached out to the school too to try to find out what happened. FCCSM 1 said that she did not know anything about the allegations and was only told about things Child A had said. On 03/03/2023, I completed an unannounced on-site inspection. I interviewed program director Jordyn Woodard who reported that Child A is no longer enrolled at the center and has not attended the center since 09/21/2022. Ms. Woodard reported that Child A's Mother disenrolled her due to her work hours changing. Child A has been cared for by Shaneann's since 2018. Ms. Woodard said that the loft area is closed in the classroom when there is only one CCSM working. Nothing has ever been reported to her about Child A having inappropriate contact with other children or her talking about inappropriate behavior. Ms. Woodard was Child A's preschool lead caregiver in 2019 and 2020 and she had no inappropriate behavior other than she would try to leave the classroom. Child B had very sporadic attendance and per their records was only enrolled at the center from 12/9/2021 to 06/09/2022 and 6/28/2023 to 06/29/2022. Child A and Child B were not together very often because they were in different classrooms. Child A would be dropped off around 5:00 AM and would go to sleep for about 1 hours on a mat in the gym. The center had cameras 1/2 then, but they only recorded motion. I interviewed CCSM 1 who reported that she was not aware of any issues with Child A except that she liked to run away from the classroom. On 03/07/2023, I spoke with Former Child Care Staff Member 2 who reported she has worked at the center for six months. She did not know who Child A was. Child A (6 years old, female) inappropriately touched other children while in care during three incidents over the last year. On 03/01/2023, an additional allegation was received alleging that staff served children expired milk and staff did not date the milk after opening it. R 400.8335 · R 400.8335 Food services and nutrition: provided by center. (8) All of the following apply to milk: (a) Containers must be labeled with the date opened. (b) Milk must be served within 7 days of opening. (c) Milk must not be served if the contents appear to be unsanitary or have been unrefrigerated for a period exceeding 1 hour. (d) Milk must not be combined with the contents of other partially filled containers.
The complainant said that she was also told that the center was serving expired milk. FCCSM 1 said that she addressed the kitchen staff about serving expired milk and about how it was not dated after opening. She said that on 11/13/2022, they tried to make her serve milk that was expired on the 6th. She said that CCSM 2 told her that she smelled it and that it is good for a week after the date because it is a sell by not a use by date. FCCSM 1 said that the milk was her number 1 issued with the center other than diapering. I asked Ms. Woodard about the milk complaint. She said that there was one time that she knew of that the milk was not expired but it was spoiled and not served because they discovered it when it was opened. Ms. Woodard said that CCSM 2 does smell the milk because of the time that they discovered spoiled milk when they opened it. CCSM 1 stated she has not had spoiled milk or milk served after the date in her classroom. I interviewed CCSM 2 who stated she is the cook for the center and rarely works in the classroom. She said that she opens the milk and dates it. She said that the center goes through a lot of milk, and they never have milk last long enough to get outdated. She uses the milk up to 7 days past the date on the gallon. She has never had spoiled milk. She pours the milk out into a glass before serving so that she can smell it and see the consistency as a way to avoid serving spoiled milk. No one has ever told her they had spoiled milk. She said that FCCSM 1 would bring her the milk back if it was past the date on the gallon, but she thought they could serve it for seven days after the date. Child Care Licensing does not have a rule requirement regarding the date of the milk, there is only a requirement that the milk be dated when opened and served 5 within 7 days of opening. The United Dairy Industry of Michigan website states, "The sell-by date or the date code is typically the last day the grocery store plans to sell the product. The milk is usually good 7-10 days past this date if it has been properly refrigerated. Former Child Care Staff Member 2 had no concerns with the milk.

R 400.8137 · R 400.8137 Diapering; toileting. (6) Diapers and training pants shall be checked frequently and changed when wet or soiled.
FCCSM 1 said that the center was logging diaper changes every two hours but was not actually changing the children. She knew that they were not changing them because no child should be soaked in a pull up after two hours. Regarding the diapering complaint, Ms. Woodard said that the only thing she knew of was when children are dropped off with wet diapers in the preschool room. Staff did not check them at arrival so when the children sat down it squished out because they had been wearing the diaper overnight. She spoke with the staff about it and their practice now is to check children at arrival. CCSM 1 had no knowledge of any issues with diapers. She checks the children at arrival, and they are changed every 1 to 2 hours after that. 1/2 Former Child Care Staff Member 2 reported that she followed a schedule for diapering and 2 hours is the maximum amount of time between changes. She changed immediately when children were soiled or wet or when they had an accident in their underwear. A

R 400.8188 · R 400.8188 Sleeping, resting, and supervision. (11) Infants and toddlers who fall asleep in a space that is not approved for sleeping shall be moved to approved sleep equipment appropriate for their age and size.
On 7/1/2022 I completed and unannounced visit to the child care center. I met with Assistant Director Jessica Young. Ms. Young stated any children who are in swings and bouncy seats are immediately transferred to a crib if they appear sleepy or are falling asleep. Staff are trained on safe sleep practices and they know infants are not allowed to sleep in bouncy seats, swings, or any other unapproved area. She has helped in the infant room and staff in the room do not allow infants to sleep in areas except their cribs. I interviewed Program Director Jordyn Woodard. Ms. Woodard stated staff in the infant room do not allow infants to fall asleep in bouncy seats or in swing chairs. Staff are monitoring infants and if they are getting tired, they place them in their cribs to sleep. Staff do not allow infants to fall asleep in unsafe areas. She has helped in the infant room recently and has seen first hand how staff work very well with sleeping times for the currently enrolled infants. Staff are trained well on safe sleep practices. I interviewed Lead Caregiver Laina Kilts. Ms. Kilts stated when infants are tired and are sitting in swings or bouncy seats, they are moved to cribs. Staff are monitoring infants and are aware of signs when a specific child is becoming tired, and they immediately move them to their assigned cribs. Staff are trained on safe sleep and they do take it seriously in the classroom. Ms. Kilts stated as a lead, she is monitoring other staff and knows they are also following the same procedure that she is, and infants are transferred to cribs, and they do not sleep in unapproved sleeping areas. I interviewed Staff Member Rebekah Kortman. Ms. Kortman stated she works in the infant room full time. Infants are not allowed to sleep in swings, bouncy seats, care seats, or other areas that are not approved. Infants fall asleep in their assigned cribs. Infants use bouncy seats and swings, and when they appear tired or are getting close to their normal naptime routines, they are transferred from the swings or bouncy seats and placed in their cribs. Ms. Kortman stated they are trained on safe sleep, and they are aware that infants must sleep in their approved cribs only. I interviewed Staff Member Arianna Miguel. Ms. Miguel stated infants do not sleep in bouncy seats or in swings. If an infant appears sleepy or is about to fall asleep, they are transferred immediately to their approved crib. Staff are trained on safe sleep practices and they follow them. She has not seen any infants sleeping in bouncy seats or swings. On 08/23/2022 I contacted Child A's Mother. Child A's Mother stated she has never witnessed any other children or her own child sleeping in a swing or bouncy seat. She has been at the center during different times, and she has not witnessed children sleeping in swings or bouncy seats. She feels the center has done an amazing job with her son and she is extremely happy. Staff are very attentive to children in care from what she has seen. 3 On 07/01/2022 and 08/23/2022 I attempted to contact Child B's Mother. I left voice mail messages for a return call. As of the completion of this report I have not heard back from Child B's Mother.
