On 03/23/2023, 1 spoke with who had spoken with Child A's Mother. I left a message for Child A's Mother. On 03/23/2023, and I interviewed Child A utilizing forensic interviewing protocol. Child A atssh e sometimes feels sad at daycare when it is clean up time or when she misses her mom. She said that she cries outside sometimes. Child A said that her first daycare was "really mean." She explained that a child care staff member (CCSM) said "go" and grabbed her chin really tight, almost made her cry and said she had to go out of the house. She stated, "I don't know why." She said that this happened on the playground. She said that the same CCSM tells her "come on, your mom is here." She did not know the CCSM's name but described short light brown hair and no glasses. She went on to talk about feeling sad because of a Barbie dream house nightmare that she had. Child A's speech was not clear, and it was not always easy to understand what she was saying. On 03/23/2023, and I completed an unannounced on-site inspection and spoke with center director /licensee designee Lynn Goodin. Lynn Goodin reported that she had spoken with Child A's Mother the previous day about Child A sitting at the table in time out and she explained to Child A's Mother that Child A was not sitting in time out but because Child A arrives after the other children are already at other centers, that is the spot available for her to play. Child A only attends before and after she attends a preschool program and full days on Fridays. Lynn Goodin explained that Child A and as other children to complete tasks like putting her stuff away, lining up, going 3 to the bathroom, and eating snack. Child A often did not get to play outside before her mom came to pick her up because she . Child A's Mother told her that Child A does not like the CCSMs. Child A's Mother told her that Child A said that a CCSM with brown hair was mean to her. Child A's Mother did not know when the incident happened, so she was not able to determine who was working with Child A at the time. Last week, Child A was only at the center for about an hour on Tuesday and Wednesday and for 7 minutes on Thursday. Lynn Goodin said that she does not have any employees with short hair. Lynn Goodin was not sure what days the children played outside last week. Lynn Goodin said that CCSM 2 was the CCSM that most resembled the description, so she asked Child A's Mother if it was her, Child A's Mother said that it was not CCSM 2. CCSM 2 is not with Child A in the afternoon. Herself, CCSM 1 and CCSM 3 are the leads for the classroom. There are several different CCSMs that work in the afternoons. RR and I interviewed CCSM 1 who reported that she d Child A in Per"assroMom after school and on Fridays. She said that she has never forced Child A to sit at the table. She said that when Child A was at the table, she was usually playing with someone, she has never seen other CCSMs place Child A at the table as discipline. She only recalled having to redirect Child A about using a loud voice. She has not seen any other CCSMs upset with Child A for and has not seen anyone grab Child A's face or seen Child A with red marks or crying. CCSM 2 is the only CCSM with short hair. She has not had concerns about Child A and thought she seemed happy. CCSM 1, Ms. Goodin, licensee designee Jeannie Bulk and CCSM 2 are the ones who normally care for Child A. and I interviewed CCSM 2 who reported that she cared for Child A beforeschool to put her on the bus and had her on one Friday. She said that Child A did not often come on Fridays. She never saw Child A have to sit at the table. She did not see anyone raise their voice at Child A, grab her face or see red marks on Child A's face. She never heard of it happening either. and I interviewed CCSM 3 who reported that she "asnot worked th Child A. She leaves work at 2:30 PM and has Fridays off. On 03/23/2023 and I interviewed Child A. Child A said that she gets sR"e"r alls house all the time. She explained that when she visits her dad, he picks her up from a place where they have Frappuccino and she "asks for a lot of whip cream." Child A was asked about drinking milk. She said that she can't drink cows' milk but can drink soy and almond milk. She said that she has only drank milk at her preschool (which is a different facility than Little Champs) and had drunk chocolate milk at Subway. She said that at the center, they don't give her milk and she only gets orange or apple juice. Lynn Goodin reported that the center is aware that Child A cannot have cow's milk and they do not serve it to her. They have Silk brand plant-based milk for Child A. CCSM 1 explained that the center has a list in the kitchen that has children's food allergy information. Child A's name is on the list. She said that the center has Silk milk for Child A. She has never seen Child A drinking cow's milk or heard about it happening. CCSM 2 reported that Child A's milk allergy is listed on her child information card and on the list in the kitchen. She has never seen Child A drink cow's milk or noticed her having any kind of reaction. CCSM 3 said that there is a list posted with food allergies and the CCSMs are also informed by the center's director when children have allergies. Jeannie Bulk reported that there is a list of food allergies in the kitchen and milk should not have been served to Child A.

On 10/11/2022, I completed an unannounced on-site inspection and spoke with licensee designee Marie (Jeannie) Bulk. Ms. Bulk reported that Child A was discharged from the center due to nonpayment on 10/03/2022. Over the weekend, Ms. Bulk received messages on social media from Child A's Mother asking if he could come back. Ms. Bulk explained that Child A was in the preschool 2 group with CCSMs Emily Ann, Kim Lewis, and Jessica Luchie. Child A has a hard time at drop off and when Child B (female, 4 years old) is not present. Ms. Bulk denied that the allegations were true. She said that Child A's Mother had made a comment to her about the CCSM telling Child A they did not like him, but she would not tell Ms. Bulk which CCSM it was. Ms. Bulk denied that Child A was even in time out for extended periods. I asked Ms. Bulk if she ever told Child A's Mother that he had been in time out for 30 minutes and she denied ever stating that. The center uses redirection, moving children to another area, talk to them, and last resort is to sit at the table for three minutes as forms of discipline. The children are not told to look down. The center does not put children in time out for soiling their clothes and it has been over two months since Child A has had any accidents. Ms. Bulk recalled one time that Child A was outside playing and had been throwing sand and mulch at other children. He was redirected to the table to play with marker boards. Child B told her mom that Child A was in time out and she then told Child A's Mother. The center staff talked to Child A's Mother about it and explained what had happened. I interviewed center director Lynn Goodin who denied the allegations were true. She has never heard anyone tell Child A that they do not like him. She explained that Child A would be asked to sit at the table to play with toys when he has a hard time keeping his hands to himself. The center discipline is to progress through giving a warning, move to a different area, and then a 2-3-minute time out with playing at the table afterwards. Ms. Goodin reported that Child A's Mother never brought up any concerns about how Child A was being disciplined until after she was told that Child A could not return until she paid her bill. Child A's Mother called the center but refused to speak with Ms. Goodin and only wanted to speak with Ms. Jeanie Bulk. She explained that Child A had an accident in the spring, and she was with Ms. Luchie and Ms. Lewis when it happened. Child A was not wearing underwear, so feces were also on the floor. They had him sit while they cleaned up and got him clean clothes to change into, but it was not a time out. I interviewed CCSM Jessica Luchie who denied that the allegations are true. She was working with Child A when he soiled his pants. She said that he was not given a time out, but they had him sit in a chair while they were working on cleaning him up. He did not have underwear on so there was a mess on the floor to clean up too. The discipline used at the center is to talk to the child, have them sit at the table and play with toys or sit by themselves for a few minutes. I interviewed CCSM Kimberly Lewis who reported that she had not heard anyone tell Child A that they did not like him. She never saw anyone have extended time outs as the longest time she has seen is a couple minutes. Ms. Lewis described her discipline as giving warnings, moving children to a different spot, after the third redirection a time out would be given and then the child can go play again. I interviewed CCSM Emily Bulk who reported that she had no knowledge of the allegations and denied that they occur at the center. She described the discipline 3 used as talking, redirection, and separating children who are having issues with each other. She does not use time out with the children. On 01/03/2022 the Child Care Licensing Bureau, (CCLB), received the complaint 3 i ne cnii care :opyof the video from the day in question. She emailed photos of the mark on Child A's neck which shows a red me mark on neck. ■ I then spoke with Lynn Goodin by telephone. I asked she send an incident report as required under the rule for this incident. She had emailed her assigned consultant informing him on the situation. She emailed the incident report on this date. The incident report states: 12130/2021 I was in the office, and I heard my preschool staff constantly talking to [Child A] about ■ behavior. The preschool group went into the kitchen to have snack (there were 14 kids present and 2 staff members Kim and Makenna). 1 hear both Kim and Makenna talk to [Child A] several times during snack about behavior again. As the kids were finishing snack, Kim went to the bathroom (right by the kitchen) while the kids finished, and Makenna started wiping down the tables. I heard Makenna yell at [Child A] this time because was hitting and kicking other kids. I heard ■ [Child A] tell Makenna "no", so I stepped out of the office. I told [Child A] to come here was sitting on the floor by the sink, waiting for others to finish a snack). [Child A] told me "no" to which / told "now" and walked over to [Child A] refused to stand up, so / picked up by the armpits and carried into the staff room to away from the o er kids (maybe moved ■ 7 fee . hen et* l icked■ up, refused to put legs down and was squirming all over. 1 of Ii in the staff room and kept my nds in armpits as I elled at l told to stop touching friends and asked i would like friends to do what was doing to them. I also told if idn t straighten up, would be calling mom and sendin ■ home. on released my hand from under■ armpits and sent- to outdoor clothing on to go outside. I watched [Child A] get ready to o outsidge,eIng which never said anything about the rug burn/rash/scratch on neck never cried or flinch like something was hurting so / don't andl know when or how he got it. As I told the Trooper, I may have gotten intentionally with my thumb nail when was squirming, but / don't know, as never flinched or cried when / was dealing ■ with I also told the Trooper that we have had behavior problems with this child that ave gotten worst in the last month. I also told the Trooper that after I yelled at [Child A], was fine behavior wise the rest of the afternoon and never complained of the "injury." I sent a copy of the incident report to On 01/0312022 I spoke with Child A's Mother by telephone. She repeated the events that took place. She explained on 12/30/2022 Child A was picked up from the child care center by a relative who immediately noticed had a red mark on ■ neck. When she picked up Child A the relative informed her of it and Child A told her, "Ms. Lynn grabbed m neck,:'. demonstrated to her using 2 hands a squeezing motion around neck. She said Child A has been in care at the facility for■ years and prior to t is incident she has never had any concerns with care or supervision. She said Child A told her, was not listenin and that's why got in trouble however she was not aware of any issues with at the center. S e has not had any documentation provided to her aboutR behaviors or had any meetings about concerns. On 01113,2022 I conducted an announced inspection at the child care facility with . We interviewed Lynn Goodin outside the presence of others. Ms. Goodin relayed the same information as documented above. She was highly emotional stating she felt "attacked and accused" as she would never hurt a child. She said she heard Child A being talked to several times b the staff member in room. She went out to the hallway to intervene askin P to come with her, told her "no", so she went and picked up "under arms to carry into another room and continued to kick and squirm." Ms. Bulk was asked if any notifications were sent out in late October early November. Ms. Bulk stated she was not aware if any notifications were sent and identified that program director Lynn Goodin typically handles these notifications. Ms. Bulk provided me with Ms. Goodin's phone number. On November 23, 2020 I spoke to Lynn Goodin by phone. I informed Ms. Goodin of the allegations. Ms. Goodin was asked about any communicable disease notifications that were sent out in October or November of this year. Ms. Goodin denied the center had any communicable diseases and confirmed that no notifications were sent out to families. I spoke to Ms. Goodin about Child A and ■ RwAil ec . Ms. Goodin stated Child A's Mother knew about and stated that it was no longer contagious. Ms. Goodin stated she has never heard of children getting She confirmed that notification of this communicable disease was not communicated to the other enrolled families. Ms. Goodin stated she spoke to staff and asked them to keep an eye on other children to see if anyone else showed symptoms. Ms. Goodin denied being notified by any other parents of children with similar symptoms. When asked about Child B having the same , Ms. Goodin denied that Child B's Mother notified the center. She stated that Child B's attendance is inconsistent because Child B's Mother does not work full time. She stated that parents are not required to pay for care when children are not in attendance. She confirmed that Child B was not in care around that time, and she was never notified of an illness. On November 23, 2020 I spoke to Child A's Mother by phone. Child A's Mother stated she took Child A to urgent care on when she noticed the on Child A. Child A's Mothostatedd followin this doctor visit she told Ms. Goodin and sent her a picture of the . Child A's Mother stated the center did not send out notification communica le disease. Child A's Mother spoke to Child B's Mother and was informed that Child B also had a - around the same time as Child A.
