On 05/24/2023 1 spoke with Child B's mother via telephone. Child B's mother stated that while at home on 05/17/2023 Child B told her that Child A had and told her tha Child also said at Child A rAdA. In the past month, Child B has started to have 2 and said that she was afraid to go to the but would not give a reason. Child B's mother stated that Child A and Child B are close friends, and they play all the time together at the center. Child B's mother is concerned that the CCSM's are allowing the children to and are not continuously supervising them. On 05/1812023, Child B's mother contacted Deann Rega, the program director and reported her concerns. Child B's mother asked for Child A and Child B to be separated into different classrooms. Ms. Rega agreed and immediately separated the children. On 05/1912023, Child B's mother took Child B to the . completed. The did not find any Child B is still enrolled On 05/30/2023 1 conducted an unannounced on-site inspection. I interviewed Deann Rega (program director), CCSM-1 CCSM-2, CCSM-3, and CCSM-4. Interviews were conducted privately in an office off the main lobby. Ms. Rega stated that Child B's mother spoke with her on 05/18/2023 and informed her of concerns regarding interactions between Child A and Child B. Child B's mother stated that Child A- Child B RM Ms. Rega said that Child B's mother asked that the two ren be separated into different classes. Ms. Rega has since moved Child A into a different classroom. Ms. Rega said that she spoke with staff members on 05/18/2023 and confirmed that the center's policy of only one child is being followed in the Pratt classroom. Ms. Rega indicated a she also Roo e with Child A's mother, who denied seeing or hearing about Child A Ms. Rega stated that neither Child A nor Child B have disclose*an of these concerns to CCSMs at the center. Ms. Rega stated that Child B has a but that no recent changes have been noticed by the CCS While on-site I observed the Pratt classroom. The room is located directly in the middle of the center and opens into the main lobby/hallway. There is a half wall running the entire length of the classroom, so any staff members walking down the hall or sitting in the lobby has a direct line of sight into the classroom. The bathroom is a single toilet with a 3/ door, so an adult can see into the bathroom while still allowing the children to have privacy. The bathroom is located near the front of the classroom and can be seen from the lobby and hallway area. The classroom also has circles painted on the floor in front of the bathroom door, indicating where children should wait to use the bathroom facilities. CCSM-1 stated that she AM seeing Child Chi CCSM-1 said that s e w, she has never seen Child A act in any concerning way. CCSM-1 describes Child A as a very sweet and caring child that gets along with her peers. CCSM-1 said that many of the female children play with the classroom dolls, and often pretend that they are changing diapers and bathing the dolls. CCSM-1 indicated that this play is completely ageappropriate. M-1 stated that she has seen Child A but no more than an averse child. between her, and 41scosedany.... Child A. CCSM-1 indicated that she only ever allows one child to go to the bathroom at a time and indicated that all the children know this rule and will wait in line for their turn to use the bathroom. CCSM-2 denied ever seeing inappropriate behavior between any children, including Child A and Child B. On 04/12/2023, I interviewed the complainant via telephone. She is concerned about how the flood in January 2023 at the child care center was handled. As a result of the flood, the entire center and all the carpeting was flooded. She assumed when the center opened back up, the carpet had been replaced. She was informed last week that the Pratt room was closed due to moldy carpet and none of the carpet was replaced. The associate director was unaware of there being moldy carpet in the room but assured her that the carpet was going to be replaced over the weekend. The carpet had not been replaced as of 04/11/2023 and an estimated time of completion has not been provided. On 04/19/2023, I, along with Ms. Erve, completed an unannounced on-site inspection. I interviewed Ms. Rega and Ms. Wood. When the flood occurred in January 2023, the facility received an A rating on their environmental health inspection that was completed on 01/26/2023. Belfor Water completed remediation for the flood damage and the affected areas were cleaned. They denied there being moldy carpet in the Pratt room. CSSMs made Ms. Rega aware of an odor in the Pratt room which resulted in an air quality test being completed at the center two weeks ago. It was determined that there were no concerns. The Pratt room was closed last week for completion of the air quality test. The Pratt room was only closed for a week and no other rooms in the center were closed. Brand new carpet is being installed in the entire center, except for three rooms. During the interview, Ms. Rega stated she informed parents that the Pratt room was going to be closed but did not indicate a date that it would be reopened. After completion of the interview, Ms. Rega could not find the email she sent to the parents concerning the room closure. She thought she sent an email to the parents but she actually did not. On 04/19/2023, I, along with Ms. Erve, interviewed CCSM 1 at the center. She stated she has not observed mold on the carpet. The week the Pratt room was closed, she smelled a musty odor in the room and she recalled having a headache. She did not recall smelling the musty odor prior to the room being closed. She informed Ms. Rega about the smell and the room was closed the next day. An air quality test was completed and they found no concerns. 3 During the on-site inspection, I observed the Pratt room. I did not observe mold on the carpet nor did I smell an odor. On 05/09/2023, I interviewed CCSM 2 via telephone. CCSM 2 stated she has not observed mold on the carpet or smelled an odor in the room. New carpet has been installed in the classrooms since the on-site inspection on 04/19/2023. On 05/09/2023, I interviewed CCSM 3, CCSM 4, and CCSM 5 via telephone. They all stated they have not observed mold on the carpet or smelled an odor in the room. On 05/10/2023, I interviewed CCSM 9 via telephone. She stated she did not observe mold on the carpet but did smell a mildewy odor the week the room was closed. She was congested that week. Ms. Rega closed the room immediately so that testing could be completed. On 05/09/2023, I left voicemail messages for CCSM 7 and CCSM 8. They did not return my phone call. I reviewed documentation regarding the air quality test that was completed at the center. All-State Environmental Services performed fungal air testing in the center's reception lobby, the Pratt Room, and outside on 04/01/2023. Fungal air test results indicated acceptable fungal concentrations in the indoor samples at the time of testing.

On 04/12/2023, I interviewed the complainant via telephone. The child care center was short staffed on 04/03/2023. In the morning in the Otis room, there was one CCSM with an unknown number of children. It appeared chaotic in the room because there were so many children running around in the room with only one staff supervising them. On 04/19/2023, I, along with Ms. Erve, completed an unannounced on-site inspection. I interviewed Ms. Rega. Ms. Rega said she believes that the Otis room was out of ratio for a short period of time because they were caring for an extra child and the CCSM that was assigned to work in the room was late arriving to the center. On 05/10/2023, I interviewed CCSM 9 via telephone. She stated the room was out of ratio for no more than five minutes. The CCSM who was supposed to work in the room arrived late for work. There was one staff in the room and CCSM 9 could not recall how many children the CCSM was caring for. CCSM 9 did not believe the room was chaotic. She said there were no problems during the time the room was out of ratio. While on-site on 04/19/2023, I observed the Otis room which is a 4-year-old preschool room. The child care staff member-to-child ratio was 1:12. I reviewed the name-to-face sheet for the Otis room for 04/03/2023. The child care staff member-to-child ratio was not maintained from 8:30 a.m. to 8:33 a.m. The child care staff member-to-child ratio was 1:16. 5 On 05/26/2023, I interviewed Child A's Mother and Child B's Mother, and on 05/30/2023, I interviewed Child C's Mother separately via telephone. They all said their children are assigned to the Otis room. They could not recall how many staff and children were in the room when they dropped their children off at the center on 04/03/2023. They had no concerns about the supervision of the children as it pertains to ratio.

On 04/12/2023, I interviewed the complainant via telephone. The menus are not always posted in the child care center. The food on the lunch menu is not child friendly. For example, one day the center served tex mex, rice, beans, and mandarin oranges. Children are going hungry because they do not like the food and will not eat it. The center uses the SproutAbout app to provide parents information about meals, however, it is not always accurate. The app may say that the child ate all of their food, but when the child goes home, he is starving and tells his parent that he only ate fruit. Parents are not always informed of changes the center makes to the menu. A On 04/19/2023, I, along with Ms. Erve, completed an unannounced on-site inspection. I interviewed Ms. Rega. The menu for the following week is posted every Friday on the wall in the front lobby and can be found on the SproutAbout app. The menu is also posted in the classrooms. CCSMs use the SproutAbout app to document the amount of food the children are eating. The staff are consistent with posting what the children eat each day for the parents to see. There have not been any substitutions but when there are substitutions, Ms. Rega informs parents of the change on the SproutAbout app and will write the substitution on the posted menu at the center. The center recently changed their menu and not all of the children are liking the new menu items. For example, the center tried meatless Mondays serving meals with no meat, such as tex mex which includes rice, beans, and fruit. Some parents do not like the new menu and have said that their children are not eating while at the center. There is always a protein, fruit, and vegetable component to their lunches. CCSMs will inform Ms. Rega of menu items that the children are not liking and she will replace the item with something different. CCSMs encourage children to at least try the main course that is being served and if they do not like it, then they serve them more vegetables and fruit. The center does not receive funding from the Child and Adult Care Food Program. On 04/19/2023, I, along with Ms. Erve, interviewed CCSM 1 at the center. CCSM 1 stated the menu is posted every week in the font lobby area and in the SproutAbout app. The amount of food the children eat is entered in the SproutAbout app. There have not been any substitutions. The center recently changed the menu and some of the children do not like the food and will not eat it. The new menu items are not always child friendly and she sometimes does not want to try the new food. For example, the chickpea stew is something that she nor the children wanted to eat. CCSM 1 eats the food in front of the children to try to encourage them to eat it. If they do not eat the food, they are given more vegetables and fruit. CCSM 1 informs Ms. Rega about the new menu items that the children do not like and the center does not serve the food anymore. She has not received any complaints from parents about the new food items. I observed the menu for the week of April 17, 2023, posted in the front lobby and posted in some of the classrooms. The following example is a meal that was provided to the children: • Breakfast — all bran wheat flakes, pineapple, and milk. • AM Snack — mini bagel and yogurt. • Lunch — chicken cordon blue casserole, stuffing, fresh carrot ranch salad, applesauce, and milk. • PM Snack — whole wheat pita with ranch bean dip. I observed the meal intake on the SproutAbout app for 04/19/2023 for children in the Terance room and Pratt room. What the staff had entered in the app was consistent with what was posted on the menu for that day. On 05/09/2023, I interviewed CCSM 2 via telephone. CCSM 2 stated the menu is posted in the front lobby, in the classrooms and on the SproutAbout app. The 7 amount of food the children eat is entered in the SproutAbout app. There have not been any substitutions. The center's new menu items are "a hit or miss" with the children in her

The children have not been outside in the past two months because the center says it has been too cold. 10 On 04/19/2023, I, along with Ms. Erve, completed an unannounced on-site inspection. I interviewed Ms. Rega. Ms. Rega stated the children go outside during the winter months and when it is cold outside. They do not go outside when there is heavy snow or when the wind chill factors are low. In the weekly news flash, they inform parents that the children go outside when it is cold and they request parents to bring appropriate winter outdoor clothing. On 04/19/2023, I, along with Ms. Erve, interviewed CCSM 1 at the center. The children go outside when it is cold outside. She could not recall how often the children did not go outside when it was cold. The children do not go outside if it is below 20°F or if there is heavy snow. They have some extra clothing for children who do not have appropriate winter clothing. The children go to the gym if they cannot go outside due to inclement weather. On 05/09/2023, I interviewed CCSM 2, CCSM 3, CCSM 4, CCSM 5 and CCSM 6 and on 05/10/2023, I interviewed CCSM 9 separately via telephone. They all stated the children go outside during winter months and when it is cold outside. If the wind chill is below 30°F, the children do not go outside. If it is too cold, raining, or snowing heavy, the children do not go outside and instead go to the gym or complete movement activities in their rooms. Some parents do not bring appropriate winter clothing and they have some winter clothing that children can wear. I reviewed the rule with Ms. Rega and the staff and informed them to use the chart provided in the TA manual as a guide when determining if it is too cold to go outside. On 05/09/2023, I left voicemail messages for CCSM 7 and CCSM 8. They did not return my phone call. On 05/26/2023, I interviewed Child A's Mother via telephone. To her knowledge, the children go outside during the winter and cold months. When she picks her daughter up from the center, the winter clothing that she sends is packed differently than how she packed it in the morning. She has no concerns about the center. On 05/26/2023, I interviewed Child B's Mother via telephone. The children go outside during the winter and cold months. She did notice that this winter they did not go outside as much as she would have liked them to. On 05/30/2023, I interviewed Child C's Mother via telephone. She believes that the children go outside during the winter and cold months. She has to wash the snow gear that she packs for her child because it is sent home dirty.

On 03/21/2023, Ms. Rega called me to report that on 03/21/2023 around 11:00 a.m. to 11:15 a.m., Child A was left in the Terance classroom bathroom unsupervised and alone in the classroom. Child Care Staff Member 1, the lead caregiver, was taking siblings to get their center pictures taken while a new child care staff member, Child Care Staff Member 3, took the other children outside. Child Care Member 2 found Child A in the bathroom alone. The name-to-face and count of the children was not completed when Child Care Member 3 took the children outside. On 03/21/2023, Ms. Rega emailed me an incident report. According to the incident report, at 10:40 a.m. on 03/21/2023, Child A was asked to go to the bathroom before going outside. Child Care Staff Member 1 put the coats on the children to take them outside with the help of Child Care Staff Member 3. Name-to-face was not properly completed as they were going outside, and Child A was left in the bathroom for approximately 15 minutes. Child Care Staff Member 2 found him in the bathroom. Child Care Staff Member 4, who is the associate director, then took him outside to reunite him with his class. On 03/23/2023, I, along with Child Care Licensing Consultant Renee Erve, interviewed Ms. Rega at the center. Ms. Rega stated it is still unclear which staff was specifically responsible for leaving Child A in the classroom bathroom alone while the class went outside. She will check with her manager to determine if I can review video footage for 03/21/2023. Staff will be retrained on the center's name-to-face policy and active supervision policy. Child Care Staff Member 1 and Child Care Staff Member 3 have received written warnings regarding the incident. On 03/23/2023, I, along with Ms. Erve, interviewed Child Care Staff Member 1 at the center. She said she is a lead caregiver in the Terance classroom. On 03/21/2023, she and Child Care Staff Member 3 were caring for 14 children. Throughout the morning, Child Care Staff Member 3 complained that her head hurt, and she was not feeling well. Consequently, Child Care Staff Member 3 was not really helping her with caring for the children. Before going outside, some children were going to the bathroom while the other children were putting on their coats. She asked Child Care Staff Member 3 to complete the name-to-face with the children while she went on the other side of the room to get the iPad and emergency cards. Child Care Staff Member 3 said all the children were present. Child Care Staff Member 3 did not use the iPad to complete the name-to-face. She is unsure if Child Care Staff Member 3 completed the name-to-face using the name-to-face sheet because she went to the other side of the room to get the iPad and emergency cards. When she returned to the group, Child Care Staff Member 3 said all the children were present. Child Care Staff Member 1 did not complete her own name-to-face with the children to ensure that all the children were present. 3 Child Care Staff Member 1 could not recall the exact time the class went outside; however, she believes it was around 10:15 a.m. When they were outside, Child Care Staff Member 4 brought Child A outside to her and Child Care Staff Member 3. Child Care Staff Member 1 stated, normally before going outside, staff will complete the name-to-face with the children using either the iPad or the paper name-to-face sheet. Once outside, the children will line up against the wall, and the name-to-face will be completed again before the children are allowed to go play. Before the children go back inside, they line up against the wall and the name-to-face is completed. Once inside the classroom, staff count the children to ensure that all the children are present. On the day of the incident, once the children were outside and before they were allowed to play, Child Care Staff Member 1 and Child Care Staff Member 3 did not have the children line up against the wall to complete a name-to-face. She did not hear Child A
