On 01/05/2023, I interviewed the Complainant. The Complainant expressed that there are two adults living in the child care home who are Adult Foster Care residents that moved in with licensee Ms. France when they could not find placement. There is concern that these two individuals are being taken advantage of because they appear vulnerable, and Ms. France is using them to care for the children. On 01/05/2023, I interviewed Child A's Mother. Child A's Mother expressed that at drop off and pick up times Household Member 1 assists with the care of the children and lives in the same household with Ms. France and her family. Household Member 1 is seen assisting Ms. France in the daily tasks during the child care hours, however, it is unclear how involved in the caregiving she is since she appears to have her own special needs. Household Member 2 also lives in the home and does not provide any kind of assistance with the child care caregiving from what has been observed. On 01/10/2023, I received an email from DHHS worker Debra Johns. Ms. Johns reported that she is currently investigating a complaint that Household Member 1 and Household Member 2 are Adult Foster Care residents living with child care licensee Tanya France who is using them to care for child care children. Ms. Johns conducted home visit where she interviewed Ms. France and Household Member 1 and Household Member 2. On 01/12/2023, I conducted an unannounced onsite inspection. Present in the home was Ms. France, Household Member 1, Household Member 2, and Household Member 3. There was a total of 12 child care children in the home. Household 1 and Ms. France were downstairs with the children and Household Member 3 was upstairs in the kitchen area. Household Member 2 was observed eating and then went into her room. Household Member 1 was observed assisting in cleaning the children's tables as the children had finished lunch and began free play with 3 playdough. During the duration of the visit, either Ms. France or Household Member 3 were accompanying Household Member 1 when with the child care children. Ms. France reported that Household Member 1 is never left alone with the child care children as she only assists in cleaning around the child care area. Household Member 1 assists with the child care children with supervision. Household Member 1 is not officially an assistant but helps out because she enjoys helping with the child care. Household Member 2 does not assist in caring for the children in any way. Both Household Member 1 and Household Member 2 are household members that live in the home and provide rent, they are not Adult Foster Care residents and can care for themselves. Ms. France and her husband used to own and operate an Adult Foster Care home a couple years ago, but no longer operate one. Household Member 1 stated that she is a household member, lives with Ms. France and her family. Household Member 1 loves helping with the child care and enjoys spending time with the children. Household Member 1 did complete her First Aid and CPR training. Ms. France or another adult household member is always present in the home during child care hours. On 01/27/2023, I had a conference call with DHHS worker Debra Johns. Ms. Johns explained that she interviewed both Household Member 1 and Household Member 2 legal guardians who had no issues with their living arrangement in Ms. France's household. Both Household Member 1 and Household Member 2 can care for themselves independently, but needed stable housing because they are still vulnerable with their health. However, Ms. France is not their caregiver. Household Member 1 expressed that she does assist with the child care, but Household Member 2 does not assist in the child care at all. On 04/17/2023, I interviewed Child B's Mother, Child C's Mother, Child D's Mother, Child E's Mother, Child F's Mother, and Child G's Mother. On 12/29/2022, I interviewed Child A's Mother. Child A's Mother expressed that Child A will not return to Ms. France's child care. Child A experienced multiple biting injuries from other children that were all under Ms. France's care. On 12/20/2022, Child A was bitten by another child on his face and arm during circle time while the children were singing songs. According to Ms. France, another child from child care came up to Child A without being provoked and bit him on his face and then arm. The incident was explained by Ms. France as something that happened so fast and out of nowhere. If that were the only incident, Child A's Mother would be understanding of the situation. However, there were more incidents with bites that occurred prior to 12/20/2022. On 09/07/2022, Child A was bitten by another child on his arm while in Ms. France's care. According to Ms. France, Child A and another child were sitting next to each other and the other child at some point bit Child A on his right arm. These two biting incidents Ms. France was aware of, but it did not appear like Ms. France was taking them serious enough since she simply expressed that "kids will be kids." Ms. France did not communicate any kind of safety plan after those known incidents occurred, other than the children apologizing to Child A for the biting upon pick up. In addition, there were two other bite marks found on Child A upon returning home from being cared by Ms. France. On 05/11/2022, Child A was bit on his right arm leaving a distinct mark, and on 05/17/2022 a bite mark was found on Child A's right top foot. Both injuries were discovered by Child A's Mother, and she inquired with Ms. France who was unable to explain how or when the incidents occurred. In addition, a week during 6/11/2022 - 6/16/2022 Child A had multiple bug bites from playing outside. There were also a couple of days upon pick up where Child A's face had scratches, and Ms. France did not know how it happened. With all these incidents and multiple injuries, Child A's Mother did not feel like Child A was safe to remain in Ms. France's care. Child A's Mother provided copies of Child A's injuries while in Ms. France's care and they were consistent with Child A's descriptions. On 01/03/2023, I conducted an onsite inspection and interviewed Tanya France. Ms. France stated that she does the best she can to ensure all the children are cared for while they are with her. Child A did get bit by other children while in care a couple times and felt bad for those incidents. The first incident occurred when Child A and Child I (male, 1 year old) were sitting next to each other during lunch time in the Fall. Child I was in his highchair and Child A was attempting to grab something 3 from Child I and, and that is when Child I bit Child A on the arm. Ms. France picked up Child A who was not crying but soothed him and made sure the boys were separated the rest of the day. Discussed this with Child I's Mother because it was an unusual behavior for Child I. The second incident that Ms. France is aware of is when they were doing circle time around the last week of child care before the holidays. The children were looking for letters and colors on the carpet floor and there was no fighting between the children. Child I was toddling around Child A while he was bending over to point to patterns and bit him on the cheek and arm. The bite came out of nowhere. Upon pick up for both times, Child A's Mother and Child I's Mother were informed of the incidents and Child I's Mother apologized for Child I's behavior. Discussed redirecting and talking to the children when these kinds of incidents occur with the parents. Discussed disenrolling Child I if the biting behaviors continue with Child I's Mother. There was another child, Child E (female, 2-year-old), that also bit Child A in the lip area while they were dancing and singing at circle time, but Ms. France could not provide a time other than it occurred in the Spring or S

On 12/29/2022, I interviewed Child A's Mother. Child A's Mother explained that Ms. France did notify her for the two incidents she was aware of in person upon pick up. Ms. France did not have anything in writing but did report the two incidents in person. On 01/03/2023, I conducted an onsite inspection and interviewed Tanya France. Ms. France stated that each time she was aware of an injury with any of the children, including Child A, she would notify the parent and inform them either in text message, phone call, and in person upon pick up. Ms. France stated that she did not have any incident reports to provide the parents since none of incidents that occurred required a written incident report—none of the incidents required medical treatment. On 04/17/2023, I interviewed Child B's Mother. Child B's Mother stated that when she discovered that Child B had multiple bites on him, Ms. France did notify her through text message and then again in person upon pick up. On 04/17/2023, I interviewed Child D's Mother, Child E's Mother, Child F's Mother, Child G's Mother, Child H's Mother, and Child I's Mother. All the parents reported that if they have experienced any incidents with the children while in care, Ms. France did notify them.
