On 09/09/2022, the licensee designee and program director, Carol O'Shea, emailed the department that on 09/08/2022, Child A was left on the playground unsupervised. On 09/12/2022, I conducted a telephone interview with Ms. O'Shea. She indicated that at the end of the day on 09/08/2022, Child A was found outside by child care staff member, Leigh DeMaggio. Child A was outside with the classes that combined at the end of the day and he was left on the playground after the other children came in. Ms. O'Shea thought Child A may have been outside unsupervised for about five to seven minutes. I informed Ms. O'Shea that a special investigation would be opened. On 09/12/2022, I conducted an unannounced onsite inspection at Anchor Bay Early Childhood Center. I met with Ms. O'Shea regarding the complaint. Ms. O'Shea indicated that on 09/08/2022, she was assisting with releasing children at parent pick up. Parents are not allowed to enter past the vestibule, so children are walked to the front by a child care staff member to be released to parents. At around 5:25p.m., Ms. O'Shea stated she had a group of children being released and another child care staff member, Margaret Dal Pra, had a group of children coming in from the playground. Ms. O'Shea observed Ms. Dal Pra counting the children as they were coming in. Around 5:30p.m., after Ms. O'Shea's group of children went with their parents and Ms. Dal Pra's children came in from outside, she and Ms. Dal Pra both left for the day. At around 5:50p.m or 5:55p.m., Ms. O'Shea received a telephone call from Ms. DeMaggio that "she had a problem". Ms. De Maggio explained to Ms. O'Shea that she was getting ready to close and went around the building to make sure that all of the doors were secured when she saw Child A standing outside on the playground. Child A was not crying or in distress when he was found. Child A is usually the last to leave and had not been picked up yet. Child A's Mother was not able to pick up Child A that day, so he was released to a relative. Ms. DeMaggio did not want to tell the relative what happened so Ms. O'Shea told her to call Child A's Mother. Ms. DeMaggio notified Child A's Mother of the incident immediately after Child A was picked up. Ms. O'Shea stated that both Ms. DeMaggio and Ms. Dal Pra were outside with the children at the end of the day. The rooms were combined for closing and children were being released from the playground to their parents in the lobby. A walkie talkie is used to communicate between child care staff members when parents 3 arrive, and a child care staff member walks the children to the front lobby. Ms. O'Shea indicated that the rooms are not combined until there are less than 16 children in attendance so that there is a 2:16 child care staff member to child ratio. Ms. O'Shea provided a copy of the attendance record for 09/08/2022. Child A was signed out for the day at 5:47p.m. During the onsite inspection, I interviewed Ms. DeMaggio. Ms. DeMaggio stated that on 09/08/2022 at around 4:50p.m., she and Ms. Dal Pra were outside on the playground with children after classrooms were combined. A lot of children left between 5:10p.m. and 5:20p.m. and Ms. Dal Pra came back into the building with the remaining children. Ms. DeMaggio was taking children to the lobby for pick up and was not sure how many children Ms. Dal Pra had remaining when the children were brought back inside. Ms. Dal Pra then left for the day. Ms. DeMaggio walked the last three children to the lobby for parent pick up. After all of the children left, she began to go to the classrooms to ensure the doors were locked when she saw Child A outside on the playground. He was just to the left of the doors and was not in any distress. No other children were on the playground. Ms. DeMaggio brought him inside and gave him a drink since it was warm that afternoon. A relative was picking Child A up so Ms. DeMaggio called Child A's Mother to inform her of the incident after Child A was picked

IIf"TW*4ilef-iil+I►A During the 02/04/2021 interview with Ms. O'Shea she stated that one of the days in care, Child A had a wate bowel movement while ■ was sleeping. The child care staff changed when woke-up, and Child A was red and did not want to be changed. Chi 's Father arrived while they were attempting to change . Ms. O'Shea stated that Child A's Mother had sent in various over the counter and diaper rash ointments. Child A's Mother was advised that per their policy, they could not put on the ointment without a Ms. F O'Shea stated the next day,Child A's Mother contacted her indicating she _ Child A from Ms. O'Shea stated that a daily schedule with the child's eating, diapering, and sleeping patterns are provided to parents. The only hard copy is given to the parents at the end of day. During the 02/04/2021 interview with Ms. DeMaggio, she indicated that there was one day when Child A had a "wet and runny" bowel movement and was red when she changed.. Ms. DeMaggio stated it was around 2:30p.m. when she changed and put on a zinc diapering ointment that was provided by Child A's Parents. s. DeMaggio stated she changed ■ again near 5:00p.m. on the day when Child A's Father arrived for pick up. She informed Child A's Father that Child A was red and that the zinc diapering ointment seemed to be making things worse. Child A's Father then changed Child A in the vestibule of the child care center. Ms. DeMaggio stated she was not sure if Child A was red or had a rash when arrived that morning. During the 02/04/2021 interview with Ms. Holmes, she indicated that she did not change Child A's diaper any of the days that she worked with Child A. She indicated that Child A's Mother gave very specific and detailed instructions on how she wanted Child A changed and brought different diapering ointments on the Ms. Holmes was not aware of a diaper rash on Child A. During the 02122/2021 telephone interview with ,she indicated that she was not aware of any concerns about a diaper rash until she was later informed of Child A's Mother's concerns by Ms. O'Shea. During the 03/04/2021 interviews with Child B and Child C's Mother and Child D's Mother, they both stated that they did not have any concerns regarding diapers being changed frequently or any issues with diaper rashes. During the 03/09/2021 exit interview with Ms. O'Shea, I explained that I had not found sufficient evidence to support a violation of the diapering rules. During the 03/10/2021 telephone interview with Child A's Mother, she explained that on the= Child A attended care, Child A's Father arrived, and Child A's diaper was "super full". Child A's Father asked for a diaper to change ■ and was told they could not find any. Child A's Mother explained that she had dropped off a large number of diapers and could not understand why Child A did not have any. Child A's Mother stated that Child A had a rash "all over" and "screamed for over two hours`, when they got home. Child A's Father was told by a child care staff member, she was not sure which child care staff member but possibly Ms. Holmes, that Child A refused to allow them to change. Child A's Mother denied that Child A had a history of diaper rashes. She in icated that she bought over the counter creams to try and relieve the rash. Child A's Mother stated that she changes Child A as soon as ■ is wet. She acknowledged that it was probably not possible for a child care center to change that frequently, but she did not expect Child A to be soaking wet at pick up. I aske Child A's Mother if she received a daily sheet showing when Child A was changed for the day. Child A's Mother stated she received the daily sheet, but it could not be correct because of how wet Child A was at pick up. Child A's Mother stated that based on the last time Child A had snack and a drink, would not have been that a wet at pick up if■ had been changed according to w at was on the daily

On 02/04/2021, 1 conducted an unannounced onsite inspection at the Anchor Bay Early Childhood Center. I met with the licensee designee. The Child A was in care, went i a and the child care staff member in the cassroom, Leigh DeMaggio, realized had boots in ■ bag, so she changed Child A's shoes while they were still ou side. Ms. O'Shea denied that Child A was barefoot in the snow or ice. Ms. O'Shea stated that the Child A was in care, ■ was getting a diaper change when Child A's Father arrived for pick up. Child A had been squirming while getting diaper changed and Ms. DeMaggio was having some difficulty gettin Child A s clothes back on. Ms. O'Shea indicated that Child A may not have had pants and shoes on upon pickup because was in the process of being changed. Ms. O' Shea stated the next day, she receive an email from Child A's Mother Child A. We informed Ms. O'Shea that another allegation was that the pulled on Child A's arm causing ■ to fall. Ms. O'Shea identified the as Ms. O'Shea indicated that due to COVID-19 protocols, parents are not currently allowed to enter the building past the vestibule. However, Child A's Mother was having a very difficult time leaving Child A, so allowed Child A's Mother to walk with them to the classroom. Child s Mother was already "Usett about having to wear a mask in the building. Ms. O'Shea denied observing pull Child A's arm or Child A falling. Ms. O'Shea denied ever receiving a complaint from staff or parents regarding interaction with children. On 01127/2021, Child A's Mother sent an email expressing her concerns to Ms. O'Shea. Child's A's Mother wrote that on 01/26/2021, she did not like how she and Child A were treated at drop off. She indicated that they were asked to put on masks, and they have never worn masks due to breathing issues. The "lady" hurriedly took Child A to the classroom. Child A's Mother wrote that as they were E walking into the classroom, pulled Child A by arm into the classroom. Child A was in tears falling to the floor and dropped stuffed animal. Child A's Mother reported that she `tried to be very calm" about a incident. Child A's Mother indicated that when Child A's Father arrived for pick up on 01/26/2021, "My _ was in ■ = no pants". The "teacher" told Child A's Father that Child A had had an accident and was not letting them chan e pants. Child A's Mother indicated that they were Child A so Ms. _ O'Shea . Child A's Mother then asked if Child A could be moved to Per assroom and she was ed on a waitlist. Child A's Mother made arrangements to . informeWkik6" During the 02/04/2021 onsite inspection, and I conducted an interview with Ms. DeMaggio. Ms. DeMaggio denied that Child A had been outside barefoot. She indicated that when she arrived that day, she could not recall the exact date, the kids were already outside, and she noticed that Child A had indoor boots on outside. She went back inside and found Child A's snow boos and while outside 4 changed Child A's indoor boots outdoor boots. She denied that Child A was to* barefoot at any time. Ms. DeMaggio stated that she was not aware and did not observe pull Child A by the arm. She did not have any concerns on how or the other child care staff member in the room, Pamela Holmes, interacts with the children. She indicated that she would speak with Ms. O'Shea if she had any concerns with how children were cared for. Ms. O'Shea stated that Ms. Holmes had been reassigned to the child care program at Maconce Elementary. and I conducted an onsite inspection at Maconce Elementary to interview Ms. Holmes. Ms. Holmes denied that Child A was outside barefoot. She indicated that Child A had on a pair of suede like or cloth boots when they went outside. Ms. DeMaggio joined them outside and went back inside to get Child A's outdoor boots. Child A was never barefoot in the snow or i
