The licensee failed to ensure that all staff provided appropriate care and supervision of children at all times when most of the child care staff members reported witnessing Child Care Staff Member 2 treating toddlers inappropriately by being too rough with them, scaring them and raising her voice with them. Child Care Staff Member 2 also admitted to placing part of her hand over Child A's mouth to quiet her.

On 10/27/22, Child Care Staff Member 1 said Child Care Staff Member 2 was rough with Child A on 10/21/22. Child Care Staff Member 2 is a lead caregiver with the older toddlers. Child A was screaming and crying while Child Care Staff Member 1 was helping her off the toilet and trying to comfort her. Child A is working on toilet training. A small toilet with a training seat on the inside of it is used. Child Care Staff Member 2 was getting frustrated with her screaming and roughly pushed her back down on the toilet even though she was done trying to go. Child A started screaming and crying louder and Child Care Staff Member 2 got more frustrated and put one hand over Child A's mouth. Her other hand was behind Child A's head. Child A was not able to scream for about 30 seconds during this. After this, Child Care Staff Member 2 said "Oh my God, she is so annoying" then walked away. Child Care Staff Member 1 said that Child Care Staff Member 2 has done many things that she does not agree with. She yells at the children a lot and says inappropriate things. Chilc Care Staff Member 1 said she has reported her concerns to Ms. Hill but she doesn't do anything about it. She said she cannot fire her because there is not enough staff. 3 When Child Care Staff Member 1 asked Ms. Hill what would be done about the incident on 10/21/22 she said she would talk to Child Care Staff Member 2 and give her extra training hours. Child Care Staff Member 1 said she was so upset about nothing being done about Child Care Staff Member 2 that she resigned. On 11/2/22, I interviewed program director Ms. Hill during my on-site visit. Child A wears pull-ups and does have some anger issues and also throws tantrums at home. On 10/21/22, Child Care Staff Member 1 came to the office to tell her about her concerns. She said that Child Care Staff Member 2 grabbed Child A's cheek. She did not say anything about Child Care Staff Member 2 pushing Child A aggressively down on the toilet or putting her hand over Child A's mouth. Child Care Staff Member 1 asked what would be done about this. She did not give specifics to her about what would be done but let her know that she would be talking to her and working with her. Ms. Hill said she talked to Child Care Staff Member 2 about the incident and assigned her positive guidance courses. Child Care Staff Member 2 told her she grabbed Child A's face to get her attention because she would not stop screaming. There are no written warnings in Child Care Staff Member 2's file. She was not aware of her grabbing children's arms or using force with children. She has had to speak with her about using a quieter voice with the children. Child Care Staff Member 1 has come to her in the past about Child Care Staff Member 2 being too loud with the children and not doing her share of the work. On 10/31/22, Child Care Staff Member 2 completed the courses and she planned to follow up with her on how things were going. They are short of staff. Child Care Staff Member 1 quit with only a four day notice and a college student left. Ms. Hill shared with me that there were no warnings or written reprimands in Child Care Staff Member 2's file. Assistant program director Stephanie Ehrhardt was interviewed on 11/2/22. She was in the office when Child Care Staff Member 1 came in. She heard her report that Child Care Staff Member 2 grabbed Child A's cheeks. When she took over for Child Care Staff Member 2 later that day, she seemed fine. So did Child A. On 11/14/22, Child Care Staff Member 2 said that on 10/21/22 Child A was screaming and throwing a tantrum by throwing herself down on the floor. She did not put Child A on the toilet seat, just took her off. She was working with Child Care Staff Member 1 that day. When Child A would not stop screaming, she put two of her own fingers over her lips and said, "don't scream". She raised her voice because Child A was screaming too loud to hear her. She denied covering Child A's mouth with her hand. She said
