R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.
On 07/08/2022, I received a complaint alleging, in part, that child care staff members from three of the classrooms sit in the hallway with the classroom doors closed once all of the children are napping. I arrived at the center during naptime. Upon entry into the building, visitors are in a long rectangular enrichment room. One side of the room has doors leading to three classrooms. The other side has a door leading to the infant/toddler classroom. All the children present in the center were resting or napping when I arrived. I observed child care staff members in each room sitting with the children and rubbing their backs. The two-and-a-half-year-old classroom had eight children present with one child care staff member in the room and one child care staff member directly outside the open doorway, cleaning up lunch dishes. Program director Ms. Bethany Kulesza stated the appropriate child care staff member to children ratios are always followed, except that staff may step into the enrichment area to wash dishes or use the bathroom. She denied that staff ever sit in the hallways with the doors closed. Child care staff member Ms. Lisa Cardinal is the lead caregiver for the infant/toddler classroom and has worked in the center for almost two years. Ms. Cardinal stated that sometimes child care staff members do come in to the hall during naptime but clarified that you can see in each room from the hallway. She denied that she ever leaves the infant room during naptime. Child care staff member Ms. Kim Dalga is the acting lead caregiver in the three-year- old room and has worked at the center since 2015. Ms. Dalga is always in her room during naptime and denied that staff from other rooms are in the hall during nap. She denied any concerns with the center. Child care staff member Ms. Lindsey Eyestone is the lead caregiver in the four-year- old classroom and has worked at the center for ten years. Ms. Eyestone reported that she stays in her classroom during naptime, although she might step out to use the bathroom or make a phone call. She denied that she is ever gone from the room for any period of time and stated that there is always someone present in the room. Child care staff member Ms. Leah Dobb is an assistant caregiver who is normally in the infant/toddler room. She has worked at the center for approximately one year. Ms. Dobb reported that she is always in her assigned classroom during nap time and thinks that other staff are in their rooms as well. Ms. Dobb does not have any concerns related to the center. Child A's Mother reported that things at the center are going well. Staff occasionally take children who do not nap to the enrichment area during naptime but denied that she has ever seen staff sitting in the hallway. 3 Child B's Mother denied any concerns with regards to Child B's care, stating that she has observed staff with Child B and has arrived unannounced at the center, and has never had a concern. Child B's Mother has arrived at the center during naptime before and has never see staff members sitting in the hall. Child C's Mother denied that she has ever seen staff sitting in the hallway, but she comes in a door that leads directly into the infant room. She also denied that she has ever been present during naptime. Child C's Mother stated that things at the center are going great and denied that she has any concerns.
Child care staff members do not provide appropriate care and supervision of children when sitting in the hallway with doors closed during naptime. Infants are put to bed wearing sleep sacks at over two months of age, with a pacifier clip attached. The center utilizes a multi-purpose cleaner instead of utilizing a three-step process for cleaning and sanitizing. A six-month-old infant was put to bed with a bottle. 7 The center is not maintained in a clean and sanitary way; it has ants.

R 400.8176 · R 400.8176 Sleeping equipment. (13) Soft objects, bumper pads, stuffed toys, blankets, quilts, comforters, and other objects that could smother a child must not be placed in, or within reach of, a crib or porta-crib with a resting or sleeping infant.
The allegation stated that an infant over two months of age was put to bed wearing a sleep sack on 06/20/2022. Sleep sacks are appropriate sleeping equipment for infants, so it is assumed that the allegation is referring to swaddlers, which are not allowed beyond two months of age. Further, although pacifier clips are frowned upon, the child care licensing rules do not explicitly prohibit them. According to attendance records, the children present on 06/20/2022 were 11 months old, 14 months old, and 15 months old. At the onsite inspection, I observed two infants napping. Neither infant was in a sleep sack, swaddler, or had a pacifier. Ms. Kulesza denied that they use swaddlers on any children or that any of the infants they have had in care recently take a pacifier. She stated that they do not allow pacifier clips during naptime. Ms. Cardinal reported that there is one toddler in care who sleeps with a sleep sack. She stated that they had a parent of an infant who wanted a sleep sack but could not find one they liked. She denied that they use swaddlers in the center. She denied that infants are put to bed with pacifier clips. 4 Ms. Dobb denied that any children currently use a pacifier, denied that any children are put to bed with a pacifier clip, and denied that any children use swaddlers. Ms. Eyestone, and Ms. Dalga all denied knowing what goes on in the infant room. Child A's Mother reported that Child A does not take a pacifier and did not use a swaddler. Child B does not take a pacifier. Child B's Mother reported that Ms. Kulesza is very conscious regarding safety when it comes to sleep. Child B does not use a swaddler. Child C does use a pacifier and has a pacifier clip, but Child C's Mother denied knowing if the center uses the clip during naptime. Child C does sleep in a sleep sack on a cot, but never used a swaddler.

Multi-purpose tables must be thoroughly washed, rinsed, and sanitized before and after they are used for meals or snacks.
Ms. Kulesza reported that all the rooms utilize the same 3-step process for washing and sanitizing dishes and surfaces. The center has a large rectangular enrichment area centrally located where some staff do dishes. Ms. Cardinal reported that she cleans and sanitizes high chairs and the diaper changing area with Method cleaner, clean water, and bleach water. She makes a new spray bottle of bleach water daily. Ms. Dalga utilizes a 3-step process before and after eating, consisting of cleaning with soapy water, clean water, and bleach water. She also uses Method cleaning spray for other surfaces in the room, such as bookshelves. 5

The complaint alleged that a six-month-old infant was put to bed with a bottle on 06/20/2022. On this date, the center did not have any six-month-old infants in care. The three children in the infant room were 11 months old, 14 months old, and 15 months old. During the onsite inspection, two infants were napping in cribs and one toddler way napping on a cot. None of the children had a bottle with them. Ms. Kulesza reported that infants are held to eat and that they never have bottles or cups in bed. Ms. Cardinal reported that, currently, only one infant in care takes a bottle. She denied that children in care ever have a bottle in bed. Ms. Dobb denied that infants or toddlers ever get bottles in their cribs. She discussed how hard it is to transition infants who receive a bottle in their crib at home. Ms. Eyestone and Ms. Dalga denied knowing what goes on in the infant room. Child A's Mother denied that Child A ever had a bottle in his crib. Child B's Mother denied that Child B gets a bottle while in her crib. She reported that Ms. Kulesza is very conscientious regarding safety with feeding. Child C's Mother reported Child C does not take a bottle in bed. The center's policy is that they hold all infants for feeding and she specifically heard a child care staff member say that bottles are not allowed in beds.

The complainant alleged that, if food gets dropped on the floor and does not get cleaned up immediately, the center gets ants. During the onsite inspection, I observed the center to be very clean and sanitary. I did not observe ants anywhere in the center. Ms. Kulesza denied that there is an ant problem in the center. She reported that they have had instances of ants in the past, and that she utilizes a commercial ant spray after hours. Ms. Cardinal reported that the infant room sometimes gets ants under an exterior door. She mops often and makes sure that the floors are always clean. I observed that the floors in the infant room were clean and did not note any ants. Ms. Dalga reported that they sometimes have ants at the back door in the spring. They spray for them at night, then vacuum and mop the area in the morning. She denied that there is ever an ant problem. Ms. Eyestone stated that they have had ants in the center, but that they vacuum daily and it has never been a problem. Ms. Dobb denied that there is an ant issue at the center, stating, "maybe an ant or two," but stating that she would not consider it a problem. To her knowledge, the center gets vacuumed once per week, mopped once per week, and swept after every meal. They also keep food off the floor. Child A's Mother denied that the center ever has an ant problem. Child B's Mother denied ever seeing ants at the center. Child C's Mother denied ever seeing ants and stated that the center is very clean.
