After speaking with parents and child care staff members, and reviewing the video footage from 10/2/2025, it was determined that Child A was seated in a chair across from Teacher 1. When Child A's Father arrived, Child A 2 LANDMARK BUILDING • 105 W. ALLEGAN STREET • LANSING, MICHIGAN 48933 Michigan.gov/MiLEAP independently got down from the chair and ran to him.

On 09/20/2021, an onsite inspection was completed. I discussed the allegations with licensee Ms. Kelli Johnson. Ms. Johnson stated that she does not swear or have inappropriate conversations around child care children. She does swear at her own children while they are on the fourth floor of the home, but child care children are in the child care area in the basement, and they cannot hear her. On 09/28/2021, I interviewed Child A's Mother. She reported that Child A attended Tiny Toes Childcare for approximately one and a half years. She has noticed that Ms. Johnson's inappropriate language and conversations have gotten progressively worse over the last several months. On one occasion, she overheard two child care children arguing in the basement, while she and Ms. Johnson were standing in the living room. Ms. Johnson went to the gate that leads to the basement and screamed, "Shut up. Oh my God." Child A's Mother overheard one of the child care staff members say, "Oh my gosh. You're so mean." One of the child care staff members told Child A's Mother that the children do hear Ms. Johnson screaming and swearing, and it startles them. Child A's Mother has overheard Ms. Johnson swearing when children were present. On 09/28/2021, I interviewed Child B's Mother. Child B's Mother stated that she has never heard Ms. Johnson talk inappropriately in front of child care children. She has observed that Ms. Johnson is usually on the main floor of the home and does not appear to directly work with the children. She generally only communicates with the child care staff members. On 10/01/2021, I interviewed Child C's Mother. Her interactions with Ms. Johnson are usually only at pick up and drop off times. She recalls instances of Ms. Johnson swearing while Child C was present. She recalls her saying things like "shit, hell, and fucker." On 10/01/2021, I interviewed child care staff member 1 (CCSM). She reported that Ms. Johnson screams at her own children all the time. This happens in the kitchen, 3 living room, and outside. Child care children hear this and some of the children are afraid of Ms. Johnson because of this. Ms. Johnson speaks negatively and in a demeaning manner to child care staff members in front of children in care. On 10/01/2021, I interviewed Child D's Mother. She has never felt that children in care are abused or neglected in any way while at Tiny Toes Childcare. Child care staff members do a great job with the children in care. Ms. Johnson is usually on the main floor of the home and children and child care staff members are in the basement. Ms. Johnson swears and has inappropriate conversations with parents often. Child D is often present when this is occurring. On 10/18/2021, I interviewed Child E and F's Mother and Father. When Child E and F first began attending Tiny Toes Childcare, everything was great. However, as time went on, Ms. Johnson became more of a bully. On one occasion, Ms. Johnson told Child E and F's Father that Child E and F's Mother was a bitch. On another occasion, Ms. Johnson was talking about another parent's husband having an affair. Ms. Johnson referred to sex and used the terms "whore" and "slut." Child E and F were present when this conversation occurred. On 10/18/2021, I interviewed Child G and H's Mother. She reported that Child G told her that Ms. Johnson yells. Ms. Johnson would tell inappropriate jokes and make inappropriate comments while Child G and Child H were present. Child G and H's Mother stated that she really liked the child care staff members and felt that they do a great job with the child care children. Ms. Johnson would make negative comments about the child care staff members. She stated that Ms. Johnson is just not a nice person. On 10/20/2021, I interviewed CCSM 2. Ms. Johnson will yell at her own children, and child care children may overhear her while they are walking down to the child care area. 11/01/2021, as of the date of this report, CCSM 3 and 4 have not returned my ph

R 400.1910 · R 400.1910 Ratio of personnel to children. (1) The ratio of personnel to children present in the home at any 1 time must be not less than 1 member of the personnel to 6 children. The ratio must include all children in care who are not related to any personnel and any of the following children who are less than 6 years of age: (a) Children of the licensee. (b) Children of a child care staff member or child care assistant. (c) Children related to any member of the household by blood, marriage, or adoption.
I completed an onsite inspection at the child care facility on 3/10/2021, at that time I spoke with Ms. Johnson about the allegations. Ms. Johnson stated that sometimes her staff will help her out with her other business or running errands, but if they do help it is because they are in ratio in the child care. For example, if both Ms. Tucker and Ms. Rowe are working with twelve children, Ms. Davis could be helping with her other business upstairs. This does not happen often, but if it does, they are always within ratio with child care children. On 4/7/2021 I interviewed child care staff members Kara Davis, Charity Rowe, and Erin Tucker. In addition, I interviewed previous child care staff member Alexis Liddle. Ms. Davis stated that she never helps Ms. Johnson with her other business or errands if she is needed within ratio. However, if they drop down to six children at 3:00 PM and another child care staff member is there, she may work on projects for Ms. Johnson for extra hours. Ms. Rowe stated that she never does work for Ms. Johnson's other business. If she does run out to drop kids off at school or something, they are always within ratio at the child care. Ms. Tucker stated that she does help with Ms. Johnson's other business on occasion and will run errands if they are within ratio with children and child care staff members. Ms. Liddle stated that at times child care staff members may go upstairs to help Ms. Johnson with her craft business during nap time. On other occasions, child care staff members may run out to do errands for Ms. Johnson. They are in ratio because Ms. Johnson is at the home with another child care staff member, but many times Ms. Johnson is upstairs in the home while the child care children are all downstairs in the child care space. On 4/27/2021 I spoke with Child C's Mother, Child D's Mother, Child E's Mother and Child F's Mother. Child C (female, age 2) has been attending the child care for about a year and a half. When she has been at the child care home, she has never seen child care staff members doing anything outside of caring for the children. Child D (female, age 10 months) has been attending the child care for the last couple months. Child D's Mother noted no concerns with the supervision the 3 caregivers give to Child D. The child care staff members are always downstairs with the children when they arrive. Child E (male, age 15 months) has been attending the child care since he was three months old. Child E's Mother stated that the child care staff members never seem distracted from caring for the children when she is there. Child F (female, age 2 years) has been attending the child care for the last year. Child F's mother stated that she always does the pick up and her husband does the drop off. When they pick up and drop off, child care staff members are always alert and ready to take their child. She has never noted them being busy anyone doing any other activities.

I explained to Ms. Johnson that we had received allegations that she takes marijuana gummies during child care hours and that the children have access to these gummies. Ms. Johnson stated, "Children do not have access to anything I do. And if I do something like that, its legal and I can do it after hours." 4 All caregivers indicated they have never known Ms. Johnson to be under the influence of anything during child care hours and the children do not have access to anything that is harmful to them. During my onsite inspection I did not observe any hazardous items in reach of children. This visit was unannounced and child care space was observed. During my phone conversations with Child C's Mother, Child D's Mother, Child E's Mother and Child F's Mother on 4/27/2021 I asked if they have ever witnessed Ms. Johnson under the influence or any marijuana products being accessible to children in the home. All parents stated that they have never noted any concerns with either.

(1) A licensee shall ensure that all of the following requirements are met: (a) Each child shall be provided with nutritional and sufficient food pursuant to the minimum meal requirements of the child care food program, as administered by the Michigan department of education. These minimum meal requirements are based on the dietary guidelines for Americans made by the National Academy of Medicine, which are available at https://www.fns.usda.gov/cacfp/meals-and-snacks. I completed an onsite inspection at the child care home on 3/10/2021, during my inspection I interviewed Ms. Johnson in regards to the allegations. I asked her if at any time she has denied the children in care adequate food for meals and snacks. Ms. Johnson explained that the children are never denied food of any sort and especially food that is programmed out on the menu per the food program. This program follows all CACFP guidelines, staying in compliance 5 with this program assures that the children are all receiving adequate food for meals and snacks. Ms. Davis indicated that the children are fed very well at the child care, that they are never denied food at any time and that she has never heard. Ms. Rowe has been working at the child care center for a month, but prior to that she brought her son there for a year and a half. She feels that her son is fed better at the child care then he is at home. Since working at the home, she has never noted the children ever being denied food. Ms. Tucker has never witnessed any children being denied food at any time. She has no concerns of how the children are fed at the child care facility. Ms. Liddle worked for the child care for four years. On 3/4/2021 she put her four week notice. However, after I completed my onsite inspection, Ms. Johnson felt she was the one who called the allegations in and told her not to come back to work. Ms. Liddle stated that children were never denied any food that was prepared for them, only on occasion would they be told they could not have a sugary snack when asking for one.

On 09/17/2020, Ms. Liddle, Ms. Tucker, and Ms. Davis all reported that Ms. Johnson is not providing third shift care. According to recent attendance records, the earliest child arrives at 7:00 am, and the latest child leaves by 4:30 pm. On 09/17/2020, Ms. Johnson stated that she has never provided third shift care. On 10/28/2020, Ms. Johnson reported that she has never provided third shift care. She stated that attendance has gone down significantly since the beginning of COVID-19 and she is currently only operating from 7:00 am to 4:30 pm. On 11/11/2020, Child A and Child B's Mother reported that they arrive at 7:30 am. Child A is only there until she leaves for school and Child B is there until 3:30 pm. She has never heard anything about third shift care being provided. On 11/11/2020, Child C's Mother reported that Ms. Johnson has never offered third shift care. Child C is dropped off at 7:00 am and she is usually the first child to arrive. She stated that if she arrives a few minutes early, she sits in her car until she sees the lights go on at 7:00 am. Child B and Child C's Mother stated that there are two other child care children who arrive about the same time, and these are the only children that she ever sees. On 11/11/2020, Child D's Mother drops Child D off at 7:00 am and picks her up between 3:30 and 4:00 pm. The only other children that Child D's Mother has ever seen are children who are dropped off at 7:00 am.
