(1) A licensee shall be responsible for all of the following provisions: (g) Report to the department within, 3 business days, any changes in the household composition or when any new or existing member of the household or child care personnel has any of the following: (i) An arrest. (ii) A conviction. (iii) An arraignment for an offense that if convicted would lead to that individual's ineligibility to be connected with a child care home. (iv) Is being investigated by the state department of health and human services for an allegation of child abuse or neglect. (v) Is under court supervised parole or probation. (vi) Has been admitted to, or released from, a correctional facility. (vii) Has been admitted to or released from a health facility or agency that was providing mental health or substance use disorder treatment services to the individual.

On 07/18/2022 I received a complaint alleging, in part, that Ms. McDaniel is currently under investigation for child abuse or neglect. Ms. McDaniel denied that this is true. None of Ms. McDaniel's staff members or the parents that I contacted had any knowledge of Ms. McDaniel being investigated for an allegation of child abuse or neglect. On 08/29/2022, I received documentation from the Muskegon County Department of Health and Human Services stating that Ms. McDaniel is not currently being investigated for abuse or neglect.

R 400.1913 · R 400.1913 Discipline; child handling. (3) Personnel shall not do any of the following: (a) Hit, spank, shake, bite, pinch, or inflict other forms of corporal punishment.
The allegation also stated that Ms. McDaniel has been observed by child care staff members pinching and restraining children on numerous occasions. I interviewed Ms. McDaniel regarding her discipline policy. She stated that she utilizes time outs, redirection, and "talk about it." She clarified that time-out is only used for children over the age of three and that children receive one minute per year of age. She said that if children are arguing over a piece of equipment, for example, they will be instructed to play elsewhere. If they do not want to go to time-out, she will talk to them and give them the choice to walk to time-out or be carried. Ms. McDaniel denied that she has ever pinched or restrained a child. Child care staff member Ms. Lillian McGuire reported that staff try to redirect children. If that does not work, they will remove the child from the group and give them something else to do or will put them in time-out. They start using time-out at 2-3 years of age but do not use this form of discipline often. She denied that they use any restraint or that she has seen Ms. McDaniel pinch or restrain a child. If they do not want to go to time-out on their own, staff will pick them up and move them. Child care staff member Ms. Lillianna Rooney has worked at the child care since 6/13/2022. She denied that anyone at the home utilizes physical discipline or restraint. They talk to the children and try to talk through any issues. They utilize time-out for children three years of age or older. Former child care staff member Ms. Danielle Cummins reported that Ms. McDaniel aims to redirect children but also does a fair amount of time-out. She clarified that when children are put in time-out, there is also a "talk about it" process. Time-out is utilized for children ages 3 and up, and they sit down and talk with children too young for time-out. She denied that she has ever observed Ms. McDaniel or any other staff member hit, pinch, or restrain a child care child, or utilize any other form of physical discipline. She has seen her use her body to redirect children, but never in an inappropriate manner. Child A's Mother has been utilizing Ms. McDaniel for child care for approximately one year and said that "she's amazing for my boys," providing a lot of structure. She utilizes time-out, which includes the child sitting in a quiet space. She does not know what Ms. McDaniel attempts prior to time-out. She denied that she has any knowledge of or concern regarding Ms. McDaniel using any physical discipline. Child B's Father reported that Child B seems to enjoy child care. Ms. McDaniel utilizes time-out. He denied any knowledge of physical discipline and does not think it occurs. Child B rarely requires discipline. 4 r -•• - •- _•• A•
