On 10/04/2021, a complaint was received alleging that Child A (male, months) received burns on his hand resulting from hot water while he was washing is hands.Concerns were noted that there was not a consistent story provided from the child care staff members as to how he was burned. i ogemer we interviewed child care staff member Ms. Savanna Donahue. Ms. Donahue identified that the handwashing procedure is that the child stands on a stool at the sink, gets soap put on their hands, and rubs them together. Ms. Donahue then turns on the 2 warm water to rinse the child's hands. At the time of the incident, Ms. Donahue had just changed Child A's diaper. It was approximately 11:40 A.M. Child A stood on the stool, washed his hands, and took his hands out of the water. Ms. Donahue does not know exactly what happened next because it happened quickly. but she thinks that she turned the hot water up, intending it turn it down, and turned the cold water off. Child A immediately put his hand into the water, pulled it out quickly, and said "ow." Ms. Donahue ran his hand under cool water until he said that he was ok. She then wrapped it in a cold wet paper towel and brought him out of the bathroom. She noted that his hand was red and he started crying a couple of seconds later. Ms. Donahue snuggled him until Ms. Sternberg took over Child A's care until he was picked up. Ms. Donahue finished changing diapers and made lunch. Ms. Sternberg noted the incident in Brighttwheel (an app the center uses to communicate with parents) and called Child A's Mother. Child A's Mother arrived about 20 minutes later. Child A cried almost the whole time. He ate some food but spent most of the time having his hand run under water. Ms. Donahue denied seeing any blisters. Ms. Donahue denied that there have been issues in the past with the water temperature but noted that she touched the water immediately after Child A had his hand in it and it was very hot. Lead caregiver Ms. Jillian Sternberg reported that she was playing on the rug with some of the children while Ms. Donahue changed diapers. She heard water running, Child A cry out, then Ms. Donahue comforting him. Ms. Donahue brought Child A out and said that she had accidentally turned the hot water on. Ms. Sternberg noticed that Child A's hand was red. She took Child A to a sink and ran his hand under cool water. Once it appeared Child A was feeling better, she took him back to the classroom and messaged his mother on Brightwheei. Child A started crying again and Ms. Sternberg took him back to the classroom bathroom and ran his hand under cool water. Once Child A indicated that he was fine, she sat him down to lunch and he started eating. Child A's Mother messaged saying that his grandmother would be picking him up. Child A started acting like his hand hurt so Ms. Sternberg found a burn cream "that made it really bad" and he became "hysterical." She tried to wash the burn cream off but he would not settle back down. She tried a cold paper towel but that did not work either. His grandmother picked him up shortly thereafter. Ms. Sternberg identified that she took a picture of his fingers and he had 1 blister and she saw that he had developed another blister as he was leaving. Center owner Ms. Sheryl Miller was aware of the incident. Ms. Miller reported that that sink has an on-demand water heater and they have determined that if the flow of water slows, the temperature raises. Ms. Donahue thought she was turning the hot water off but must have left it at a trickle, then turned the cold off. They have a plumber coming to install mixing valves on the sinks. Child B's Mother denied any concerns with the center and identified that they are "great" with Child B. She reported that they are good at providing communication through the app and denied any concerns regarding supervision. Child C's Father reported being satisfied with the center and denied any concerns regarding supervision.

In her interview, Ms. Miller reported that the center has an on- demand water heater and they have determined since the incident that if the flow of water slows, the temperature raises. Ms. Donahue thought she was turning the hot water down but apparently did not turn it off. They have a plumber coming to install mixing valves on the sinks. Ms. Sternberg reported that the center did not have hot water until April, when the tankless water heater was installed under the bathroom sink. The center's handyman looked at it again after Child A was burned and stated that he did not know how it got hot enough to burn him. He turned the hot water supply off at that time. While we were present at the onsite inspection, the handyman returned and showed us how the water heater works. There is no temperature indicator on it but rather is adjusted by turning a single screw with a screwdriver. He returned the setting to where it was the day of the incident. When I measured the temperature of the water coming out of the faucet after it had been running, it measured 95.7 degrees Fahrenheit. When I turned the hot water to a trickle, it measured 155 degrees Fahrenheit for a couple of seconds, then went back down.
