On 06/09/2023, an incident report was submitted that stated a CCSM 1 grabbed two children by the arms in a way that violated the center's code of conduct. The center's internal investigation (staff interviews and camera footage) confirmed the child care staff member did mishandle the children. There were not any visible signs of physical harm, and parents of the children were notified. On 06/14/2023, 1 completed an onsite inspection. I completed an interview with the program director, Deborah Morrow. Ms. Morrow confirmed the information in the incident report and provided clarifying information in which CCSM 1 pulled on the children's arms, and which CCSMs were witnesses to the incident. CCSM 1, who has since been terminated, pulled on the arms of Child A and Child B. Ms. Morrow provided video footage of the incident. The video showed children in a line to enter classroom 202 after going to the bathroom. CCSM 2 was in the front of the line, and CCSM 3 was in the back of the line. CCSM 1 was helping in room 206 but was outside the classroom in the hallway and appeared to be emptying the trash. The video then showed CCSM 1 crossing the hallway to the line of children going into room 202, and then pulling Child A and Child B back into the hallway. Ms. Morrow conducted interviews with the staff members, who reported to her that CCSM 1 told them that Child A and Child B were running, and that is why she pulled them back into the hallway. However, when Ms. Morrow interviewed CCSM 1, CCSM 1 reported to her that Child A and Child B were pushing each other and that is why she grabbed them and pulled them back. Ms. Morrow stated that CCSM 2 did not see what the girls were doing. However, Ms. Morrow stated that regardless of what the girls were doing, CCSM 1 had no reason to intervene, since there was already a child care staff member there. Ms. Morrow also stated that they have a code of conduct staff follow, which provides other ways that staff are to intervene instead of "snatching" children. Child A was crying as a result of her arm being forcefully pulled on. Ms. Morrow contacted the parents of the children the same day to let them know what happened. Ms. Morrow placed CCSM 1 on paid leave while she looked into the incident. CCSM 1's employment was terminated on 06/08/2023. CCSM 2 and CCSM 3 witnessed the incident, however, neither staff member was present at the center at the time of the onsite inspection. The center will be closing for the summer. I obtained the phone numbers of CCSM 2 and CCSM 3 to interview by phone. I also obtained child information cards. On 08/03/2023, 1 interviewed CCSM 2 by phone regarding the incident. On the day it occurred, CCSM 2, CCSM 3 and CCSM 4 were responsible for approximately five children in care. They were all coming back to the classroom from a bathroom break. CCSM 2 heard CCSM 1 say that the children needed to stop running and come back to walk. CCSM 2 did not see the children running, but out of respect for CCSM 1, she also told Child A and Child B to walk back. The children did not follow CCSM 1's instructions, and then CCSM 1 grabbed Child A and Child B and pulled them back in the hallway by their arms to walk. Child A was crying hard, and due to that, CCSM 2 thought Child A might have been hurt. She now believes that Child A was likely just startled and had hurt feelings for getting in trouble. CCSM 1 was a floater for the day and was not in charge of the children in that classroom at that time. CCSM 2 has never seen CCSM 1 be physical with children before but does not believe that CCSM 1 has the compassion needed to work in the child care field. The center has a discipline policy that children are given verbal redirection and reminders and are not redirected by pulling on them. On 08/04/2023, I interviewed CCSM 3 by phone. I spoke with Child A's Mother on 12/1/21. She stated that the school had called to let her know that her son had "ducked" away for a minute and was left unsupervised for a period of time. Child A gets distracted easy, so she believes something caught his attention and he wondered off. She has no concerns with the child care or their supervision. She believes this was an isolated innocent. When I arrived at the child care facility, I spoke with licensee designee Deborah Morrow. She stated that Child A was in lead caregiver Kathy Richards class. Child care staff member (CCSM) Bridget Gilbert is also in the classroom and both of them were present on 11/30/21 and today as well. I spoke with Kathy Richards first. She stated that they were outside on the playground and as they were getting ready to go inside. They lined the children all up on the fence. Ms. Richards counted thirteen children, which was the amount of children in care that day. Ms. Gilbert started walking inside with the children that were in line. Child B (male, age 4) and Child C (female, age 4) were refusing to get off the playground, so she was working with them to do so. Ms. Richards assumed that Ms. Gilbert had all the children besides Child B and Child C. Ms. Gilbert had made it through the first gate and the second gate by the time Ms. Richards got to 2 the first gate. After the second gate, the sidewalk turns before entering the school building, so there is not a line of sight from the playground to the entrance of the school. Ms. Richards got Child B and Child C into the classroom, when CCSM Rebecca Darke brought Child A to her. Rebecca Drake is the curriculum director for the licensee. Ms. Richards stated that they now stop and count at the gate with one child care staff member in the front of the group, the other in the back of the group. Then they stop at the door before entering the school building and count one last time in the classroom. I then spoke with Bridgett Gilbert, Ms. Gilbert stated that they lined the children up on the fence to make sure all the children had their masks on and ready to enter the building. At that time, they counted to ensure that all children were in line and ready to go. Ms. Gilbert was in the front of the line and opened the first gate to exit the playground and walk towards the school building. Ms. Gilbert said "let's go," three times and started marching towards the second gate. As she opened the second gate she looked back she saw students coming. As they got to the door of the elementary school where Ms. Richards and Ms. Darke were standing, many children stopped to give them hugs. She counted the children at the door and noted that she was missing three children. She assumed they were with Ms. Richards as she did not see her either child. She waited with the children at the door for a minute to make sure Ms. Richards and the other three were coming, but they were taking a while to come. This was out of character for them because they typically walk into the building with all the children together. On that day, a couple of children that struggle with transition were having a hard time coming in and that is why the separation of the teachers. Ms. Gilbert stated that they now have a plan to keep one child care staff member in the front of the line and one in the back of the line, in addition to counting at each gate, the door to the school and once in the classroom. I confirmed with Ms. Marrow that she was standing at the door when the children entered the building that day. She stated she was saying goodbye to Ms. Darke and she saw Ms. Gilbert and some of the children. She walked back to her office, so she did not see Ms. Richards and the other children. Ms. Darke was the one that saw Child A and brought him back to the classroom. I spoke with Ms. Darke on 1/25/2022. She stated that she was at the child care facility on 11/30/2021.
