Ms. Owens and CCSM 1 had 10 children in attendance on the day of the incident. Ms. Owens went inside with an infant for several minutes leaving CCSM 1 with 9 children outside. It was during this time that Child A and Child B got out of the outdoor play area.

On 12/17/2020, I initiated the special investigation by contacting the assigned consultant Mike Skonieczny to gather additional information. On 12/22/2020, I completed an unannounced on-site inspection at Ms. Liz's Daycare. The group child care home was found to be clean and safe for children's use. I met with and interviewed the licensee Elizabeth Owens. Ms. Owens has never had any child in care that had head lice that she is aware of. Ms. Owens' own children have never had head lice either. Ms. Owens is not aware of any children in care having bug bites. She reports no parents have informed her that their child had head lice or bug bites. Ms. Owens does not use a playpen. Ms. Owens has placed Child A (female, age two) and other younger children in a play yard in the past. The play yard is not considered a playpen however is similar to a baby gate. The incident the complainant source is referring to is regarding a picture Ms. Owens posted to Ms. Liz's Daycare Facebook page. Ms. Owens posted a picture of the older children painting in the playroom on Valentine's Day 2019 and there were two younger children in the play yard to prevent them from getting into the paint. The two children (including Child A) were only kept in the play yard for approximately 10-15 minutes. Ms. Owens pulled up her Facebook page and displayed the picture that caused the concern. The older children are seen painting Valentines on a table and there are two younger children in the play yard who are standing up and watching the older children paint. The children did not appear to be in any distress. Child A is brought to child care by the mother and the mother has not expressed any concerns to Ms. 3 Owens. She no longer has the play yard as it broke several months ago, and she has not replaced it. I then met with and interviewed caregiver, Danielle Bentley. Ms. Bentley has been employed at the group child care home for almost three years and there have never been any children with head lice or bug bites. If a child had head lice or bug bites it was not brought to their attention. Child A has never been observed to have head lice or bug bites. Child A loves to get her hair braided and head lice have never been observed in her hair. Child A has never been kept in a playpen. Ms. Owens used to have a play yard that the younger children have been placed in for short periods of time. The play yard is like a baby gate however you can change the shape of it and make it square, octagon or round. The longest period of time children were in the play yard was 15-20 minutes. The play yard broke months ago and Ms. Owens has not replaced it. I then obtained copies of Child A — Child I's children information cards while at the on-site inspection. On 12/22/2020 and 01/26/2021, I attempted to contact the complainant source and there was no answer. A voice mail message was left requesting a return phone call. To date the complainant source has not returned my telephone calls. On 01/26/2021, I contacted Child A's mother and an interview was conducted. Child A did not catch head lice at Ms. Liz's Daycare. Child A caught lice from her older sister who contracted it at school. Child A did not attend Ms. Liz's Daycare when she had head lice and was treated for the head lice before returning. She had not informed Ms. Owens that Child A had head lice, as she purposely kept her out of child care until the head lice was gone. Child A and her sister did have some marks that appeared to be bug bites and were taken to their pediatrician who could not determine what the marks were. The marks have since cleared up and are no longer visible. She has seen the play yard in the past however Child A was never in it when she was present. The play yard was large and if Child A were to have been in it, she would not have had any concerns. She has no concerns with the quality of care provided to Child A at Ms. Liz's Daycare. On 12/22/2020, I conducted an unannounced on-site inspection at Ms. Liz's Daycare and the home was found to be maintained in a clean, safe and comfortable condition. I contacted Child A, Child B, Child C, Child D, Child E, Child F, Child G, Child H and Child I's parents and they all denied that their child had ever contracted lice or bug bites at Ms. Liz's Daycare, and they had no concerns with the group child care home being unclean or unsafe.
