On 6/9/2021 I placed a telephone call to the complainant. The complainant said she spoke to Child A on 6/4/2021 regarding a rug burn on his spine. The complainant believes Child A received the injury on 6/3/2021 because that is when Child A's Mother observed the injury on Child A's back during bath time. Child A's Mother said the injury was not present on Child A the morning of 6/3/2021. Child A told the complainant he received the injury when Child B was dragging Child A around on the carpet in the yellow room at daycare. Child B told the complainant that Child B was dragging Child A on the carpet because they "thought it would be fun." The complainant said the injury on Child A is on his spine. There are 3 round marks about the size of a quarter in a line down the middle of his back. The 3 round marks are red with scraping, consistent with a rug burn. The complainant went to the child care center on 6/7/2021 to speak to the child care staff members. The child care staff members told the complainant they were not aware of Child A receiving an injury at the child care center. The child care staff members do not recall seeing Child B dragging Child A around on the carpet. The child care staff members said Child A did not report any injuries to them. The complainant said Child A's Mother is upset that the child care center did not report the injury to Child A's Mother. On 6/15/2021 I completed an unannounced on-site inspection at the child care center. I informed program director and licensee designee, Andrae Higgins of the allegations. Ms. Higgins said she first heard Child A had an injury when Child A's Mother sent a picture of the injury to Ms. Higgins on 6/4/2021. Child A's Mother inquired how Child A received the injury. Ms. Higgins spoke to child care staff members Ally Nortley and Becca Williams who worked with Child A on 6/3/2021. The child care staff members reported that they were not aware Child A received an injury at the child care center. None of the child care staff members observed Child B dragging Child A across the carpet. Ms. Higgins said Child A is "very sensitive." Child A will typically immediately tell a child care staff member if he feels he is injured or being treated unfairly by another child. Ms. Higgins said she explained to Child A's Mother that the child care staff members did not report the injury to Child A's Mother because they had no knowledge of the injury. Ms. Higgins said Child A has not returned to the child care center since 6/3/2021. I reviewed video footage of Child A's classroom which is called the "yellow room." I reviewed footage from 6/3/2021 from 11:05am until 4:10pm, the entire time Child A was signed in at the child care center. I also reviewed video footage of Child A playing outside on 6/3/2021. I did not observe any incidents where it appeared Child A was being dragged around on his back by any other children or playing in a rough manner that would cause an injury to his back. I observed the child care staff members in the video to be spread out amongst the children and supervising them appropriately I interviewed child care staff member Ally Nortley. Ms. Nortley said she worked in Child A's classroom on 6/3/2021. Ms Nortley does not recall observing Child B 3 dragging Child A across the carpet. Ms. Nortley said Child A typically tells a child care staff member right away if he doesn't get his way or if another child hurts him or takes his toy. Child A will report "every little bump" he receives while at the child care center. Ms. Nortley said Child A gets along well with all the children in the classroom. Child A is not a child who gets bullied or picked on by other children. Ms. Nortley said Child A is "not aggressive or rough" and "very easy going." Ms. Nortley said Child B is also not usually an aggressive child. Ms. Nortley said she is aware that Child A and Child B have play dates outside of the child care center. On 6/9/2021 I placed a telephone call to the complainant. The complainant said she wonders if Child A received an injury at the child care center because the child care staff has too many children to supervise or if the child care center is short staffed. The complainant said she did not count the children while she was at the child care center. She guesses there was around 10 children with 4 child care staff members. On 6/15/2021 I completed an unannounced on-site inspection at the child care center. I informed program director and licensee designee, Andrae Higgins of the allegations. Ms. Higgins said both she and the child care staff members maintain ratios at all times. Child Care staff members will merge classrooms or move child care staff members around in order to assure ratios are met at all times. The preschool room contained five children and one child care staff member. The toddler room contained three children and one child care staff member. The white room contained four children and one child care staff member. The infant room contained three children and one child care staff member. There was also one extra staff member for making lunch or helping where needed along with Ms. Higgins throughout the day. The infant and toddler room ratios require one child care staff member to four children. The remaining classrooms are preschool rooms that require ratios of one child care staff member to either eight or ten children. All the classrooms were within the appropriate ratios during my on-site inspection. I interviewed child care staff members Becca Williams and Ally Nortley. Ms. Williams and Ms. Nortley said the child care center plans ahead as much as possible to maintain ratios in all of the classrooms at all times. There are usually enough child care staff members where an extra child care staff member can be pulled from another classroom if a child arrives at the child care center early or if a child's parents are late to pick up a child causing a classroom to be out of ratio. 5
