    R 400.8125 · R 400.8125 Staff; volunteer; requirements. (1) All staff and volunteers shall provide appropriate care and supervision of children at all times.

    Child A’s Mother stated that Child A was at home on July 1, 2023, when Child A attempted to stick a colored pencil in the buttocks of the family’s cat. Child A’s Mother asked Child A why she tried to stick the colored pencil in the cat’s buttocks and Child A stated that a boy at child care put a crayon in her bottom. Child A’s Mother asked Child A where the boy got the crayon from. Child A said the crayon came from a green pencil box on a drawing table in the classroom. Child A stated that the boy followed Child A into the bathroom and put the crayon in her bottom. Child A stated that she could not remember who the boy was or what he looked like. Child A’s Mother asked Child A if she told anyone, and Child A said that she told Child Care Staff Member 1 and Child Care Staff Member 1 responded by saying “bad boy.” Child A’s Mother stated that Child Care Staff Member 1 retired at the end of the school year. Child A’s Mother sent a message to Child Care Staff Member 1 on Facebook informing Child Care Staff Member 1 of what Child A reported to her. Child Care Staff Member 1 responded that Child A never told her anything about a boy putting a crayon in her bottom. Child Care Staff Member 1 also said that she can’t think of anyone in her class that would ever do that. Child A’s 2 Mother stated that Child A’s last day at the center was June 8, 2023, when the program let out for the summer. Program director Patricia Payment stated that Child A was in Child Care Staff Member 1’s class las school year. Ms. Payment stated that there were 10 preschool children in Child Care Staff Member 1’s classroom and Child Care Staff Member 1 was the only child care staff member in the room. Ms. Payment stated that Child Care Staff Member 1 informed her that Child A’s Mother reported that Child A stated that a boy in the classroom put a crayon in her butt in the bathroom at the center. Child Care Staff Member 1 stated that Child A never told her that anything like this happened. Child Care Staff Member 1 could not remember a time that Child A was ever upset about anything. Ms. Payment stated that there is a bathroom in the classroom with two stalls. Children typically line up against the wall and go the bathroom two at a time while Child Care Staff Member 1 stands at the door. If children need to go to the bathroom any other time they are allowed to go on their own. If two children needed to go at the same time they would be allowed to go at the same time because there are two stalls in the bathroom located in the classroom. Ms. Payment stated that Child A knew every child in the preschool classroom very well so she did not understand why she would say that she didn’t know who the child was that put the crayon in her bottom. Ms. Payment stated that she didn’t believe that the incident occurred at the center. Child Care Staff Member 1 stated that Child A’s Mother called her in July 2023 and told her that Child A said that a boy at school put a crayon in her bottom. Child Care Staff Member 1 stated that she told Child A’s Mother that she doesn’t believe that anything like that happened at the center. Child Care Staff Member 1 stated that she told Child A’s Mother that Child A never acted upset or differently any time while she was the center. Child A was always happy. Child Care Staff Member 1 stated that Child A is the type of child who would have definitely told her if something like that happened but she never reported anything like this to her. Child A knew all of the children in the classroom and there were no new children before the end of the school year. Child Care Staff Member 1 stated that she lined the children up to go to the bathroom located in the classroom at certain times during the day. If a child needed to use the bathroom any other time they were allowed to go on their own. Child Care Staff Member 1 stated that children were never in the bathroom for long time.
