    Mr. Eric Feldman, superintendent of human resources, stated that he was informed that an individual reported to human resources that Ms. Danielle Mungar, program director, holds children down during nap. Mr. Feldman reported the allegation to Ms. Nicole VanDaele, licensee designee, on 03/23/2023. There were no specific dates or children named in the allegation. Ms. VanDaele made a verbal report of the incident to the department on 03/23/2023. She submitted a written report regarding the incident later that day. I completed an unannounced on-site inspection at the center. The inspection occurred during nap time. Some children were already asleep, and others were having their backs patted. No children were being held down. Child Care Staff Member 1 stated that there are several children in the classroom with special needs. A few children do not lie down to nap. The children's cots are placed in zones and each child care staff member works on getting the children in their zone asleep. Once all the children in the child care staff members zone are asleep, then the child care staff member can help in another zone. One of the children in care does not nap and likes to follow Ms. Mungar around while she pats other children's backs. He will often sit in Ms. Mungar's lap and do an activity during nap time. Another child likes to be rocked to fall asleep. The child care staff members try to be flexible with the nap time process to fit the needs of the children in care. Children are not required to go to sleep. Child Care Staff Member 2 stated that no child care staff members holds children down at nap time. One of the children in care likes to be rocked like a baby, so sometimes Ms. Mungar will rock the child in her arms to help him fall asleep. None of the contact that child care staff members have with the children is inappropriate. Child Care Staff Member 3 stated that children are not held down on their cots during nap time. Sometimes a child runs around during nap time while the other children are resting. Ms. Mungar may hold that child in her lap if this happens so that the child does not run around the room and potentially hurt themselves or others. This holding is not done inappropriately. 3 Ms. Mungar stated that she does not hold children down when they nap. Sometimes during nap time, a child will run around the classroom while the other children are laying down and it is a hazard for the running child and the children in care. She will have the child sit between her legs while she sits on the floor next to a cot and pats another child's back. One child likes to be rocked like a baby. Most children like their backs to be patted. Child A's Mother stated that she has no concerns about the care and supervision that the center child care staff members provide. The child care staff members have worked with her on helping Child A at nap time since he often doesn't want to rest. Child A loves going to the center. Child B's Mother stated that Child B sometimes struggles with nap time. The child care staff members have worked with her to help her rest. Child B's Mother stated that the child care staff members have done a great job with regard to getting Child B to nap. She has no concerns regarding the care and supervision that the child care staff members provide. Child B enjoys attending the center.
