    R 400.1911 · R 400.1911 Care; supervision; children. (1) A licensee shall ensure appropriate care and supervision of children at all times.

    I interviewed the complainant. The complainant re-stated the allegations. The complainant verified that Mrs. Moore is not currently caring for children. I interviewed Trooper Weitzel with the Michigan State Police. He responded to the residence on 5/25/21. There were several children in care. The children were awake when he was at the residence. Interviews were conducted with Mrs. Moore, Mr. Moore, and their adult child, Adult Household Member Ms. O. Moore. At the time of the incident, there were three children located in a room adjacent to the kitchen. The other children were in another room of the house. It was not reported that the children observed the incident. Mrs. Moore indicated that she and Mr. Moore were in the kitchen fighting over her cellular phone when Mr. Moore twisted her arm behind her back and padded her down looking for the phone. Mr. Moore swung his hand around and stuck her in the stomach. Mrs. Moore reached out to a neighbor who called law enforcement. She did not have any injuries. Mrs. Moore indicated that Mr. Moore has been emotionally and mentally abuse for approximately one year. Trooper Weitzel stated that Mr. Moore had a different version of the events. He denied intentionally striking her but wanted to check her cellular phone as he thinks she has been unfaithful. Mr. Moore was arrested and lodged at the Monroe County Jail with charges pending for domestic violence. According to Troop Weitzel, he is not aware of any other law enforcement involvement to the residence. I reviewed the Michigan Department of State Poice report number 14-2522-21 dated 5/25/2021. Law Enforcement responded to the residence on 5/25/21. Mrs. Moore was interviewed. She indicated that she and Mr. Moore have been arguing for about a year. Mr. Moore suspected her of "martial unfaithfulness", and this would continuously cause arguments between them. She was in the kitchen when he approached her, demanding to see her phone. When she refused, he began to grab her trying to find the phone. When he did not find it, he backhanded her stomach with the palm side of his hand and walked away. Mrs. Moore stated that she was not injured or in pain, nor did he knock the wind out of her. Mr. Moore was interviewed. He indicated that Mrs. Moore was texting other men and being 5 unfaithful to him. He was trying to take her phone for proof of cheating. He denied getting physical with her, saying that he was patting her down and reaching for her back pocket looking for her phone. It was possible that Mrs. Moore's arm was pushed backwards but he did not intentionally twist her arm behind her. He denied backhanding her in the stomach. Adult Household Member Ms. O. Moore was interviewed. According to Ms. O. Moore, she was upstairs showering at the time of the incident. She did not observe the incident. During the investigation, I had contact with Mrs. Moore on several occasions, including 5/26/21, 5/27/21, 5/28/21, 5/30/21, 6/1/21, 6/2/21, and 7/1/21 via telephone, face to face, or text messages. During my first telephone and first face- to-face interview, she was accompanied by Adult 1. Adult 1 works as a domestic violence advocate. Mrs. Moore stated that on 5/25/21 between 2-2:30p.m., there were 11 children in care with two adults. Mr. Moore works as a child care staff member, and he was present at the residence. There were three young children napping in the living room, which is directly connected to the kitchen. The children in the living room included Child B, Child C, and Child D, all of whom are 3 years of age or younger. There is direct line of sight from the kitchen to the living room; however, as the children were laying down the furniture would block this line of sight. There were also eight children either napping or participating in quiet time in another room at the front of the house. The kitchen is located at the back of the house. Their adult daughter, Ms. O. Moore was upstairs. Mr. Moore and Mrs. Moore were in the kitchen. Mr. Moo

(1) All firearms must be unloaded and properly stored in a secure, safe, locked environment inaccessible to children during hours of operation or while children are in care at the child care home. A secure and locked environment means a locked commercial gun safe, or a trigger lock installed and locked according to the manufacturer's recommendations to prevent discharge. ........ .............. ............... .......... ......

    I interviewed the complainant. The complainant re-stated the allegations. I interviewed Mrs. Moore. She stated that on 5/25/21, she was looking in the garage to find their various car titles and car keys. While looking, she found an unregistered and unsecured handgun locked inside Mr. Moore's 68' Chevy Camero located in the garage. The garage is not used as child use space. She found the gun along with an ammunition clip inside a cardboard box. The box also contained a bank statement from an account he opened with their adult daughter without her knowledge, and a large amount of cash. Mrs. Moore said she was not aware that there was a gun at the residence. She did not know if the ammunition clip was loaded. The gun has since been turned into law enforcement. The children in care never had access to the gun. I interviewed Mr. Moore. He stated that the pistol has been at the residence for 1 '/2 to 2 years. He received the hand gun from a friend that passed away, so it had sentimental value. He never registered the gun and no one in the home has shot the gun. Initially, the gun and ammunition clip were stored together unlocked on a tall shelf in an upstairs bedroom. Mrs. Moore knew about the gun being at the home. He moved the gun and ammunition clip to the locked trunk of his car 2-3 months ago but did not tell Mrs. Moore that he moved it to the garage. He decided to move the gun to the truck after they started verbally arguing and threatening each other in anger. He stressed that he "never" feared that they would ever hurt each other but decided it would be best to remove the gun to "keep everyone safe." Mr. Moore stated that the gun was never loaded. I interviewed Ms. O. Moore. She did not report any knowledge regarding a gun being at the home. I interviewed Child A's Mother. She was present at the residence when the gun was found inside the garage. Mrs. Moore was looking for car titles and car keys in the garage. There were several keys "all over", they were individual and not labeled. Mrs. Moore found the keys to the Chevy car and opened the truck. Child A's Mother also observed the gun. The hand gun, two ammunition clips full of bullets, cash, and medication were found inside a blue unlocked cardboard box inside a locked car trunk. She also observed Mrs. Moore when the gun was found. She described Mrs. Moore's reaction as "genuinely surprised" by its existence. I interviewed Child D's Mother and Child E's Mother. They did not report any concerns regarding safety hazards in the home. 17

    I interviewed Complainant 2. They did not have any firsthand information regarding this allegation, as they had heard it from someone else. I interviewed Mrs. Moore. She adamantly denied the allegations. She stated that children are "never" allowed to sit outside unattended. She does not allow the children to open the door by themselves. She believes that she "knows" her families and knows who is picking up the children. She has excellent communication with the parents, and they "always" communicate and give written permission who will pick up the children. She stated that since COVID19 started, the parents do not come inside the home at drop off or pick up unless agreed upon. At the time of pick up, she will stand in the door to great the parents and allow the child to join their parents outside. Sometimes the parents do not get out of the car, but she observes the children until they are safe in the car. If there is more than one car in the driveway, she will have the parent walk up to be sure the child is safe in the driveway. She remembered that Child A was often picked up by individuals other than the parents, but she "always" had parent permission and knew who was picking up the child. In the past, she has asked parents to send a picture of the person picking up, as well as would verify with the older children at pick up if this was the correct person. If the person were driving the parent's car, that would also be something that would be recognized. Despite "knowing" who was picking up the children, Mrs. Moore acknowledged that she has not checked people's identification at pick up if it was someone other than the parent. Regarding 5/14/21, Mrs. Moore referenced her attendance log for that day. Both she and Mr. Moore worked that day from 7:15a.m. — 4:30p.m. Child A was picked up at 4p.m., but she does not record who picks up the children. I interviewed Mr. Moore. He denied the allegations. He stated that children are never allowed to be outside alone. The children wait inside until their parent arrives for pick up. The children are supervised until they are with their parent. He has never released a child to someone that he did not already know. I interviewed Ms. 0. Moore. She does not work as a child care staff member, but she has been present in the home daily. She stated that the children stay in the house until they are picked up. Mr. and Mrs. Moore know the individuals picking up the children. She has never observed children outside alone. I interviewed Child A's Mother. Child A has been in care since February 2020. She has never witnessed Child A sitting outside unsupervised while waiting to be picked up from care. However, there have been two incidents that that caused her concern regarding Child A during pick up time. The first incident involved Child A's Grandmother. The date of the incident was not known. Child A's Grandmother told her Child A was sitting alone on the front porch by herself and the door to the house was not open. She picked up Child A without talking to anyone inside the residence. Child A's Mother did not discuss her concerns with Mrs. Moore. The second incident occurred on 5/14/21, with her friend, Witness 1. Child A's Mother arranged with Mrs. Moore to have Child A picked up by Witness 1. No one in at the child care home had ever met Witness 1. Witness 1 used Child A's Mother's car to pick up Child A, so they "may have" recognized the car. Witness 1 called her while she was standing outside the residence. Witness 1 told her that she pulled in, parked the car, and got out. Witness 1 told her on the phone that Child A ran out of the house without Witness 1 speaking with any adult. Witness 1 asked Child A's Mother if she needed to knock on the door, saying that she had her license ready to show them. Child A's Mother instructed Witness 1 to pick up Child A and leave. Child A's Mother did not discuss her concerns with Mrs. Moore. Child A's Mother stated that Mrs. Moore has since found out about
